    Special Notice Page 5 of 5 Page 5 of 5 Page 5 of 5 Page 4 of 5 Page 4 of 5 Page 4 of 5 PRE-SOLICITATION NOTICE OF INTENT TO SOLE SOURCE This Notice of Intent is to inform all parties the Department of Veterans Affairs, Office of Acquisition, Logistics, and Construction (OALC), Regional Procurement Office West (RPOW), Network Contracting Office (NCO) 21 intends to award a sole source procurement for the following requirement to the large business manufacturer, Olympus America Inc., located at 3500 Corporate Pkwy, Center Valley, PA 18034. The VA Palo Alto Health Care System (VAPAHCS), at 3801 Miranda Avenue, Palo Alto, California 94304 has a requirement for a to lease endoscope systems for multiple specialties in Surgical Service. Specialty endoscopes systems will be used in the Operating Room (OR) for surgical specialties such as Bariatric Surgery, Thoracic Surgery, General Surgery, Otolaryngology, and Urology as well as in the outpatient setting in Otolaryngology and Urology clinics. VAPAHCS requires the leasing and maintenance of endoscopy scopes and systems that are compatible with the endoscopy systems currently used by Surgical Service providers in Bariatric Surgery, Thoracic Surgery, General Surgery, Anesthesia, Otolaryngology, and Urology. The vendor will provide the types of scopes and quantities requested by VAPAHCS and their maintenance, which will include, but not be limited to, replacement and prioritized repair of scopes, 24-hour technical support, product training for VAPAHCS staff members, provide loaner equipment as needed, and next day shipping of equipment. The items shall be completely new, and shall not be used, refurbished, or in any other form, including substitutions. The contractor shall not add or substitute any component(s) without prior approval from the Contracting Officer. Endoscopy equipment is also subject to maintenance, calibration, and compliance directives with safety standards. Using an unfamiliar machine may lead to inadvertent violations of these standards, potentially compromising patient safety and exposing the provider and VA to liability. Olympus endoscopy systems are already installed and in routine use in the operating rooms and surgical clinics at VAPAHCS. VA s Gray Market Items terms and conditions apply pursuant to VAAR 852.212-71 Gray Market Items and VAAR 852.212-72 Gray Market and Counterfeit Items. As a result, vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the items identified to be eligible for participation with this acquisition. Vendor must be able to provide the documentation that demonstrates such aforementioned authority. The associated North America Classification Systems (NAICS) Code is 334510 (Electromedical and Electrotherapeutic Apparatus Manufacturing) and the Business Size Standard is 1,250 employees. The solicitation for this action will be posted to beta.sam.gov and all responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. After consideration, the Government will determine whether to proceed with the sole source acquisition. Please keep in mind that patient care and choice in the decision is the highest priority to the VA.
