Sole Source Notice The Bureau of Reclamation intends to award a sole source contract to Siskiyou County, the only entity legally authorized under California Food and Agricultural Code §11501.5 to perform pesticide monitoring, inspections, and enforcement on lands within Siskiyou County, including the Tule Lake National Wildlife Refuge (TLNWR) and Lower Klamath National Wildlife Refuge (LKNWR). A full description of the requirement is provided in the attached combined synopsis/solicitation. California Food and Agricultural Code §11501.5 grants exclusive jurisdiction to County Agricultural Commissioners for pesticide enforcement within county boundaries. No private or federal entity may legally perform these functions within Siskiyou County. The Siskiyou County Agricultural Commissioner (CAC) employs certified Agricultural Inspectors trained and authorized to conduct pesticide monitoring, enforce pesticide laws, issue violations, and perform compliance inspections. Public Law 107 69 further authorizes DOI to reimburse state and local governments for enforcement activities on Federal lands. An Intent to Sole Source notice was previously posted, and no responses were received. No other qualified sources are known. Therefore, competition is not possible, and this acquisition is restricted to the only responsible source. This notice is not a request for competitive quotes. However, all responsible sources may submit a capability statement which will be considered by the Government. Responses must clearly demonstrate statutory authority and capability to perform pesticide regulatory enforcement within Siskiyou County. The Government will not consider responses that do not demonstrate legal authority under California Food and Agricultural Code §11501.5.
