    Description

    The Naval Air Warfare Center Aircraft Division (NAWCAD) Contracts Department, Patuxent River, MD, in support of the NAWCAD Security Department, intends to negotiate and award a new Indefinite Delivery Indefinite Quantity (IDIQ) contract on a sole source basis under the authority of FAR 6.103-1 to Johnson Controls Building Automation Systems (JCBAS), 2101 Gaither Rd, STE 400 Rockville, MD 20850-4039.

    This contract will provide maintenance and installation services for Intrusion Detection, Fire Alarm Communication, Card Access, and Closed Circuit Television (CCTV) systems essential to the Department of Public Safety at Naval Air Station Patuxent River, Webster Field Annex, St. Inigoes, MD, and Naval Recreation Center Solomons Annex, Solomons, MD. The contract will cover approximately 300 locations across the Patuxent River Complex, Webster Field, and Solomons Annexes.

    JCBAS is the sole developer, manufacturer, and authorized service provider of the existing Electronic Security System (ESS) infrastructure at NAWCAD. The proprietary nature of this system, including the computerized monitoring equipment and data encryption program, makes JCBAS the only vendor capable of performing all required maintenance, sustainment, and upgrade efforts. The Government does not possess the technical data package, design specifications, or rights to the system components; therefore, no third party can replicate, modify, or maintain the system without direct authorization from JCBAS.

    JCBAS has confirmed that: 1) they are not willing to offer the data rights to the Government for purchase, 2) they maintain exclusive ownership of all proprietary data and intellectual property rights associated with its Building Automation Systems, 3) no other vendor, subcontractor, or prime contractor currently holds any rights to Johnson Controls’ proprietary data or intellectual property, and 4) Johnson Controls does not intend to share, assign, or transfer such rights to any other vendor or contractor in the future without prior written agreement and appropriate authorization from all relevant parties. Any attempt by a third party to access, maintain, or modify the system would void all warranties and violate existing warranty agreements. The manufacturer will not provide technical support or assistance to any entity other than JCBAS, and unauthorized intervention would result in loss of warranty coverage and significantly increase future maintenance costs to the Government.

    To preserve the required form, fit, and function of the ESS, only JCBAS can install updates or new components. The system architecture—both hardware and software—was designed and developed by JCBAS and has been accredited through the Department of Defense Risk Management Framework (RMF) process in support of the Command’s Authority to Operate (ATO). No alternative vendor can meet these accreditation requirements without extensive reengineering and reauthorization efforts. Transitioning to another vendor would result in substantial duplication of cost, and an unacceptable delay reflecting the time and expense required to replace the existing infrastructure and complete necessary certification and accreditation processes. Such a delay would leave multiple classified facilities unsecured, creating unacceptable operational and security risks.

    THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS; however, responsible interested parties may submit information in which they can identify interest and capability to respond to this requirement.  Responses must be received by the response date in this posting.  The applicable NAICS code for this requirement is: 561621 Security Systems Services.  The Government reserves the right to process the procurement on a sole source basis based upon the responses received.  The Government will not pay for any information received.  The point of contact is Ashley Graves, ashley.d.graves4.civ@us.navy.mil.
