The Department of Energy (DOE) Oak Ridge Office of Environmental Management intends to award a sole source modification to Contract Number 89303322DEM000067 with United Cleanup of Oak Ridge, LLC (UCOR) for additional transuranic waste processing and treatment services using the statutory authority 41 USC 3304(a)(1), as implemented by Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The award is intended to provide the availability of additional transuranic waste processing and treatment services, including packaging, transportation, and shipping to and from other sites, that are not already provided under the Contract. UCOR is already responsible for the operation of the Transuranic Waste Processing Center, which provides exclusive mixed transuranic waste processing and treatment capabilities that are necessary for multiple sites as a remedy for the disposition of transuranic waste that has no path to final disposition. The services include the safe, compliant, and cost-effective operations and maintenance of the Melton Valley Solid Waste Storage Facilities for processing and storage of solid contact-handled and remote-handled transuranic waste in Resource Conservation Recovery Act (RCRA)-permitted storage facilities located at the Oak Ridge National Laboratory and Transuranic Waste Processing Center. UCOR is the only known company that has approved programs and plans in place to operate the Transuranic Waste Processing Center and process the additional transuranic waste with no interruption to services. This notice serves as notice of intent to award a contract action and is not a request for proposals and no solicitation is forthcoming. However, responsible sources that believe they can perform these services in their entirety must submit a written notification of interest and capability statement by 4:00pm Eastern Daylight Time (EDT) within 15 days of issuance of this announcement, which will be considered by the agency. DOE will not be responsible for any costs incurred in response to this notice. Capability statements shall be submitted via email to karen.shears@orem.doe.gov. A determination by the Government not to compete this proposed action based upon responses to this notice is solely within the discretion of the Government. This notice in no way obligates the Government to award any contract or carry out any contract action.
