    Evaluation Criteria

    • Solicitation of Gratuities

      The Contractor shall ensure that no agent or employee shall solicit or receive gratuities of any kind for any of the work or services provided in connection with the contract. 

    • ASSIGNMENT OF CONTRACT

      All parties understand that if, during the life of the contract, the contractor disposes of his/her business concern by acquisition, merger, sale and or/transfer or by any means convey his/her interest(s) to another party, all obligations are transferred to that new party. In this event, the new owner(s) will be required to submit all documentation/legal instruments that were required in the original Proposal/contract.

      The contractor will not assign any interest in the contract and shall not transfer any interest in the same without the prior written consent of the Township.

    • GENERAL

      A.  The Township of Holmdel shall award the contract or reject all bids within the time specified in the invitation to bid, but in no case more than 60 days, except that the bids of any bidders who consent thereto may, at the request of the contracting unit, be held for such longer period as may be agreed. All bidders will be notified of the Township of Holmdel's decision, in writing.

      B. The contract will be awarded to the bidder whose aggregate bid price for the selected service option is the lowest responsible bid.

      C. The Township of Holmdel reserves the right to reject any bid not prepared and submitted in accordance with the provisions hereof, and to reject any or all bids.

    • Competence of Employees

      The Contractor's employees must be competent in their work, and if any person shall appear incompetent or disorderly, the Township of Holmdel shall notify the Contractor and specify how the employee is incompetent or disorderly and the Contractor shall take steps to correct and remedy the situation, including disciplinary action if necessary. Any employee who drives or will drive a vehicle in the course of the employee's employment pursuant to the Contract must possess a valid New Jersey driver's license for the type of vehicle operated.

    • N.J.S.A. 10:5-31 et seq. (P.L. 1975, C. 127) N.J.A.C. 17:27 GOODS, PROFESSIONAL SERVICE AND GENERAL SERVICE CONTRACTS

      During the performance of this contract, the contractor agrees as follows: 

      The contractor or subcontractor, where applicable, will not discriminate against any employee or applicant for employment because of age, race, creed, color, national origin, ancestry, marital status, affectional or sexual orientation, gender identity or expression, disability, nationality or sex. Except with respect to affectional or sexual orientation and gender identity or expression, the contractor will ensure that equal employment opportunity is afforded to such applicants in recruitment and employment, and that employees are treated during employment, without regard to their age, race, creed, color, national origin, ancestry, marital status, affectional or sexual orientation, gender identity or expression, disability, nationality or sex.       The contractor or subcontractor, where applicable, agrees to comply with any regulations promulgated by the Treasurer pursuant to N.J.S.A. 10:5-31 et seq., as amended and supplemented from time to time and the Americans with Disabilities Act. 

      The contractor or subcontractor agrees to make good faith efforts to meet targeted county employment goals established in accordance with N.J.A.C.

      The contractor or subcontractor agrees to inform in writing its appropriate recruitment agencies including, but not limited to, employment agencies, placement bureaus, colleges, universities, and labor unions, that it does not discriminate on the basis of age, race, creed, color, national origin, ancestry, marital status, affectional or sexual orientation, gender identity or expression, disability, nationality or sex, and that it will discontinue the use of any recruitment agency which engages in direct or indirect discriminatory practices.

      The contractor and its subcontractors shall furnish such reports or other documents to the Division of Public Contracts Equal Employment Opportunity Compliance as may be requested by the office from time to time in order to carry out the purposes of these regulations, and public agencies shall furnish such information as may be requested by the Division of Public Contracts Equal Employment Opportunity Compliance for conducting a compliance investigation pursuant to Subchapter 10 of the Administrative Code at N.J.A.C. 17:27-5.2.

       

    • The Bid

      The Township of Holmdel is soliciting bid proposals from companies interested in responding to 2025 ROAD IMPROVEMENT PROGRAM PROJECT. This bid is for a period of Lump Sum Award commencing on The Contractor is required to begin work within ten (10) calendar days of Contractor’s receipt of written Notice to Proceed issued by the Township. and ending on Substantial Completion must be achieved within sixty (60) calendar days following the Notice to Proceed. with an option of No renewal, fixed term contract or finished upon completion.. The option years may or may not be awarded solely at the Township's discretion accordance with the terms of these bid specifications and N.J.S.A. 40A 11-1 et seq and any amendments thereto.

    • VEHICLES AND EQUIPMENT

      A. Each bidder shall submit with his proposal, a description of all equipment to be used in the performance of the proposed contract. 

      B. All vehicles used in the performance of this contract shall be properly registered and shall comply with all applicable federal, state, and local environmental and safety regulations. In addition, vehicles shall be designed to meet current industry safety standards, including those established by the American National Standards Institute (ANSI) or equivalent governing bodies.

      C. All vehicles shall be maintained in good working order and shall be constructed, used and maintained so as to reduce unnecessary noise, spillage and odor. In addition, all vehicles shall be of a uniform color and shall be in good repair. Finally, all vehicles shall enter the Township of Holmdel devoid of any material from other sources. The NO VALUEDepartment Heads or their designee shall have the right to inspect all vehicles, at any time, during the term of this contract, and the Contractor shall comply with all reasonable requests relative to the maintenance and repair of said vehicles and other equipment used in the execution of this contract. All Vehicles are to be equipped with N/A

      D. The Township may order any of the Contractor's vehicles used in the performance of the contract out of service if the vehicle is not maintained in accordance with the requirements of these Work Specifications. In such event, the Contractor shall replace such vehicle, at its sole cost and expense, with a conforming vehicle satisfactory to the Contract Administrator.

       

    • WORK SPECIFICATIONS - GENERAL

      A. The Contractor shall provide service for the bid awarded by the Township of Holmdel and shall select a successful bidder for the contract period and will award the contract for a period of Lump Sum Award with No renewal, fixed term contract or finished upon completion. renewal options. The Township shall retain the unilateral right to award each option years, if applicable.

      New Jersey law requires all public works contractors and subcontractors to submit weekly certified payroll records online via the New Jersey Wage Hub. These records must be submitted within 10 days of payment, and all contractors must register with the Department of Labor.

      NOTICE IS HEREBY GIVEN that sealed bids entitled: Bid ID: 02-2026 Contract Name: 2025 Road Improvement Program Project, Township of Holmdel, County of Monmouth The project consists of one (1) Base Bid and one (1) Alternate Bid. The Base Bid consists of roadway improvements (HMA milling and paving) and the Alternate Bid shall include the installation of additional concrete and granite curbs within the project limits. Bid will be received by the Township of Holmdel at the Municipal Complex, 4 Crawfords Corner Road until 10:00am prevailing time on Wednesday, April 22, 2026, at which time the submissions received will be publicly opened and read aloud via ZOOM in the presence of one or more of the following: Qualified Purchasing Agent, or designees. No bids will be accepted after said prevailing time and day. Contract documents may be obtained through the Township procurement portal at https://procurement.opengov.com/portal/holmdel.gov. Bids must be submitted through the procurement portal. Hard copies of bids will not be accepted. Any questions regarding the bid documentation shall be directed, in writing, to Rachel Tarantul, rtarantul@holmdel.gov . The Township of Holmdel is only responsible for forwarding addendums or clarifications to those prospective bidders who obtained specifications directly from the Township of Holmdel.     • Scope

       Base Bid Scope:

      • Inlet castings as required by the Tier “A” Municipal Stormwater Regulations, and stormwater management improvements.
      • Edge milling of existing pavement, 7 feet gutter mill 2” to 0’ or full width as directed by the Township.
      • All grass areas disturbed during construction shall be topsoiled, fertilized, and seeded. No additional payment will be made for restoration of grass areas including decretive stone and ornamental plantings.
      • The Contractor shall replace any signs damaged during construction at no cost to the Township.
      • The Contractor shall exercise proper care in the placement of tack coat to prevent curb, sidewalk, or inlet top units from being marked or stained. It shall be the responsibility of the Contractor to remove any tack coat from curb, The paving machine shall be equipped with the proper controlling devices to obtain the required application of materials to the lines and grades as may be directed by the Township and have a paving width of at least fifteen (15) feet.
      • Compaction equipment required shall be of the type necessary for the specified work. There shall be at least two (2) rollers used on each street. Contractors shall supply water for rollers. Use of fire hydrants is prohibited.
      • A tack coat shall be applied to the entire width of the cleaned surface, along curb line and paint all vertical surfaces at joints. The specified bituminous paving material shall be applied to obtain an approximate two-inch (2”) thickness after compaction.
      • The entire roadway is to be resurfaced and all intersections are to be blended and keyed with minor adjustments in accordance with good paving practice, or as specifically directed by the Township.
      • Electric Service and Water Service Coordination for temporary utility service for the Contractor’s use and associated applications with the Utility companies are the Contractor’s responsibility.
      • The Contractor is to ensure that all areas to be paved/poured, roadway and driveway, will have positive drainage so that ponding does not result.
      • The Contractor shall reset the existing water valve boxes, water meters, gas valve boxes, vents, monitoring well etc. flush to the proposed grades and as directed in the field by the Township.
      • The Contractor shall contact the pertinent Utilities Authority to coordinate the utility resetting/relocation as required.
      • The Contractor must not bury existing roof leader drains discharging into the roadway. Any damage to or covering/burying of any of the aforementioned items must be replaced by the Contractor at no additional cost to the Owner.
      • The Contractor is responsible for all sawcutting, trenching, removal and legal disposal of any asphalt and/or concrete to be removed as part of these improvements.

       

      Alternate Bid ‘A’

      MASONRY AND DECORATIVE STONE AND GRAVEL SIDEWALKS, DRIVEWAYS AND ISLANDS

      • Paver/granite block masonry, brick, flagstone, exposed aggregate, patterned (stamped) and similar decorative sidewalks, drives, and islands shall be reset, reconstructed, or extended to required line and grade.  Materials similar to existing shall be provided as required.  The finished driveway shall replicate the pre-existing conditions to the extent the Township determines to be reasonable.  Unusual types of drives may require special skills which must be provided by the Contractor or Subcontractors. Decorative broken stone of gravel drives shall be generally constructed as reasonable.  Where shown on the plans, or directed by the Township, existing masonry driveways sidewalks and islands may be extended.  The extended portion shall replicate the existing to the extent the Township determines reasonable.  The extended portion shall be measured and paid under the reset or reconstructed item.

       

      GRANITE CURB

      • Granite Curb shall be set with the top surface within ¼” of the required grade.  Performed expansion joints ½” wide shall be provided at P.C & P.T. of curb returns and at maximum 50’ intervals elsewhere.
      • The entire concrete foundation for granite curb shall be in one pour or in pours at close intervals when the concrete is still plastic and rodded to create a homogenous foundation.
      • At particular locations such as curb returns, at drives and adjacent to structures or other obstructions, the Township may restrict the size of granite block to be used.  Only 12”-14” long blocks may be used within 10’ of any curb inlet.  Except when permitted by the Township, blocks with a minimum  or maximum dimensions may not normally be placed adjacent to other blocks with similar minimum or maximum dimensions.
      • Removal and re-installation of pavers for driveway aprons as needed.

       

      CURB

      • Where the construction of curbs various kinds require removal of bituminous pavement, the edge of pavement that is to remain shall be cut to a neat vertical line by method and in a manner approved by the Township (see attached).

       

      UNDERLAYER PREPARATION

      • If no clearing site item is scheduled in the proposal, the concrete sidewalk and driveway items shall also include the removal and disposal of existing sidewalks and driveways.
      • When necessary to remove portions of existing HMA or concrete driveway, the driveway shall be saw-cut to provide a neat straight line.

       

      APPURTENANT WORK

      • If a sump pump, roof drain, or similar pipe is encountered in installing pipe, it will be connected with the appropriate fitting, or as directed by the Township.

       

      PROTECTION AND CURING

      • Ensure vehicles and other loads are placed on sidewalks, islands and driveways until the concrete has attained compressive strength of 3000 pounds per square inch, as determined from 2 concrete cylinders field cured.

       

      DETECTABLE WARNING SURFACES

      • Detectable Warning Surfaces shall be provided as directed.  Acceptable Detectable Warning Systems are listed in subsection 919.4 and are classified as Type 1, 2 or3.  Types 1 and 2 are acceptable when new public sidewalk curb ramps are constructed.  Type 3 may only be used as a retrofit on existing curb ramps.
      • The Contractor will submit for the Township’s approval detailed manufacturers specifications and installation instructions for the detectable warning system to be used.  The material submitted will include a manufacturer’s certification that the system complies with the Department of Justices Standards for Accessible Design (2010) requirements.
      • If a Type 1 system is utilized the Contractor’s submission shall include a proposed modification of detail PSW-4 to accommodate paver thickness while maintaining at least a 4” concrete base thickness with wire fabric reinforcement. 
      • After approval, the Contractor will install the system in compliance with the manufacture’s specifications and installation instructions approved by the Township.
      • The color of the detectable warning surface shall be Safety Red.
    • Invoices Payment Procedures & Liquidated Damages

      Please submit all invoices for 2025 ROAD IMPROVEMENT PROGRAM PROJECT in accordance with the requirements outlined below.

      No payment will be made unless duly authorized by the Townships authorized representative and accompanied by proper documentation.

      The bidder may not assign, sell, transfer or otherwise dispose of the Bid or any portion thereof or any right or interest therein. This section is not intended to limit the ability of the successful bidder to assign or otherwise dispose of its duties and obligations under the contract provided that the Township of Holmdel agrees to the assignment or disposition.

      A.  Each document included in the Proposal must be properly completed in accordance with these solicitation specifications and any applicable federal, state, or local regulations. No proposer shall submit the required information on any form other than those provided or explicitly approved as part of this solicitation package.

      B.  Bid Proposals must be submitted through the Township’s eProcurement Portal, as detailed in the Public Advertisement, prior to the official time: 10:00 am on the designated Wednesday, April 22, 2026. Submissions received at or after the stated time will not be accepted.

      C. Submission Authorization

      By submitting a bid through the OpenGov e-procurement platform, the individual submitting the proposal certifies that they are an authorized representative of the firm. The act of submission constitutes an official acknowledgment of all bid terms and conditions on behalf of the bidder. The individual submitting this proposal and the firm they represent affirm the following:

      1. For a corporation, the submission is made by a principal executive officer or a duly authorized representative.

      2. For a partnership or sole proprietorship, the submission is made by a general partner or the proprietor, or a duly authorized representative.

      3. For a duly authorized representative, the person submitting this proposal has been given written authority by one of the individuals described above, with that authorization specifying either the individual or a position responsible for the overall operation of the business.

    • Site Assessment and Compliance

       

      Bidders are strongly advised to thoroughly review all project locations and site conditions prior to submitting a Bid Proposal. Although general requirements apply across the project, some locations may present unique circumstances or specific requirements that must be fully accounted for.

      It is the Bidder's sole responsibility to gain a comprehensive understanding of, and ensure full compliance with, all applicable local regulations and any project-specific rules for each location.

      All prices submitted in the Bid Proposal must reflect this comprehensive understanding and adequately cover the costs associated with all site-specific requirements and conditions.

    • BID GUARANTEE 

      Bidder shall submit with the bid a certified check, cashier's check or bid bond in the amount of ten percent (10%) of the total price bid, but not in excess of $20,000, payable unconditionally to the owner. When submitting a Bid Bond, it shall contain Power of Attorney for full amount of Bid Bond from a surety company authorized to do business in the State of New Jersey and acceptable to owner. The check or bond of the unsuccessful bidder(s) shall be returned pursuant to N.J.S.A. 40A:11-24a. The check or bond of the bidder to whom the contract is awarded shall be retained until a contract is executed and the required performance bond or other security is submitted. The check or bond of the successful bidder shall be forfeited if the bidder fails to enter into a contract pursuant to N.J.S.A. 40A:11-21. Failure to submit a bid guarantee shall result in rejection of the bid.

    • NOTICE OF AWARD AND EXECUTION OF CONTRACT

      A. Within sixty (60) calendar days of the award of the contract, the Township of Holmdel shall notify the successful bidder in writing, at the address set forth in the Bid Proposal and such notice shall specify the place and time for delivery of the executed contract. This notice will specify the location and time for delivery of the executed contract along with the following required documents: Refer to attached checklist.. Mandatory Affirmative Action Language; W-9, NJ Business Registration Certificate, Certificate of Insurance stating Holmdel Township be carried as additional insured, and Performance Bond.

      B. Failure to deliver the aforementioned documents as specified in the notice of award shall be cause for the Township of Holmdel to declare the Contractor nonresponsive and to award the contract to the next lowest bidder. 

       

    • Supervision of Employees

      The Contractor shall employ a Superintendent or Foreman who shall have full authority to act for the Contractor. The Contractor shall notify the Township, in writing, that a Supervisor has been appointed. Such notification shall be given prior to beginning performance on the contract. The Contractor shall promptly notify the Township, in writing, of any changes. The Township may at its discretion meet with the Contractor on a monthly basis or more frequently, if desired.

    • BID GUARANTEES

      A Bid Guarantee in the form of a Bid Bond, Cashier's Check or Certified Check, made payable to the Township of Holmdel in the amount of 10% of the highest aggregate Base Bid, not to exceed twenty thousand dollars ($20,000) must accompany each Bid Proposal. In the event that the bidder to whom the Contract is awarded fails to enter into the Contract in the manner and within the time required, the award to the bidder shall be rescinded and the bid guaranty shall become the property of the Township of Holmdel.

    • LIQUIDATED DAMAGES

      Liquidated Damages

      The successful proposer shall be required to enter into a contract with the Township of Holmdel, New Jersey that includes a liquidated damages clause. This clause will specify that if the proposer fails to meet the agreed-upon obligations and timelines, the Township will be entitled to a pre-determined amount as a reasonable estimation of damages. The amount of liquidated damages per instance of non-compliance shall be $500.00 per day..

    • Information for Bidders

      Method of Award of Contract: If the award is to be made on the basis of a base bid only, it shall be made to that responsible bidder submitting the lowest base bid.

       

      If the award is to be made on the basis of a combination of a base bid with selected options, it shall be made to that responsible bidder submitting the lowest net bid as per the bellow schedule:

      1. the lowest total base bid proposal will determine the basis of award.
      2. should sufficient funds be available for the award of the base bid and the alternate Bid A, the basis of award shall be determined of the base bid + Alternate Bid A.

      Work Hours: To be determined by the Township, Holmdel Police Department and Contractor during Preconstruction meeting.

       

      Photographs of Existing Site Conditions: The Contractor must take photographs of the Project Site prior to the start of work.

       

      Utility Mark-Out: Contractor is responsible for all utility mark-outs necessary on each job site.

       

      Notices to Residents and Businesses: At least 72 hours prior to the start of work, the Contractor must provide written notice to all residents and business within the project site.

       

      Storage of Materials is not permitted within the public right-of-way. Contractor is responsible to secure area of storage materials.

       

      Maintenance and Protection of Traffic: Contractor is responsible for installing traffic control and traffic protection devices as specified and/or directed by the Holmdel Township Police Department. All traffic control devices installed shall be in accordance with the New Jersey Department of Transportation and Manual on Uniform Traffic Control Devices, as currently amended.

       

      Access: The Contractor must maintain vehicular and pedestrian access to all residential and business driveways and walks for duration of the project. In addition, the Contractor must ensure access is maintained for emergency Fire and Ambulance vehicles for the duration of the project.

       

      Site Cleanliness: The Contractor must maintain a safe and clean project site. At the end of each working day, all materials and equipment must be secured within the project site as authorized by the Township. In addition, the Contractor must sweep and clean adjacent walks, driveways and pavement areas and ensure the area is free of dust, silt and debris.

       

      Progress Payments: The Contractor must submit progress payments along with Certified Payroll reports to the Township. Progress payments will not be processed until such time that the Contractor submits Certified Payroll report to the Township.

       

      Retainage: 2% retainage shall be held on projects with a total value greater than $100,000.00, projects less than $100,000 shall have a retainage held in the amount of 10%.

       

      A maintenance bond in the amount of 15% of the final construction costs and valid for a period of two (2) years is required for this project.

       

      Pre-Construction Meeting: Before construction is started, pre-construction conferences are to be held. During the first conference the Township, Holmdel Police Department and Contractor will discuss the procedures to be followed by the Contractor during the construction process. Upon award from The Township, the contracts will be forwarded to the Contractor for their signature. At the pre-construction meeting, the Contractor is required to submit the executed Contract Documents, Performance Bond, Certificate of Liability and Workmen’s Compensation Insurance, and Construction schedule, W-9, and NJ Business Registration Certificate. 

       

      Fuel and Asphalt Price Adjustments: This project is subject to New Jersey Law requirements for Fuel and Asphalt Price Adjustments. Adjustments shall be calculated and paid for in accordance with the New Jersey Department of Transportation Standard Specifications for Road and Bridges, as currently amended.

       

       The Contractor and all sub-contractors must be registered with the NJ Department of Labor & Workforce Development and provide proof of the Public Works Contractor Registration. All Public Works Contractor Registrations must be maintained for the duration of the project.

    • CONSENT OF SURETY

      Bidder shall submit with the bid a Certificate (Consent of Surety) with Power of Attorney for full amount of bid price from a Surety Company authorized to do business in the State of New Jersey and acceptable to the owner stating that it will provide said bidder with a Performance Bond in the full amount of the bid. This certificate shall be obtained in order to confirm that the bidder to whom the contract is awarded will furnish Performance and payment Bonds from an acceptable surety company on behalf of said bidder, any or all subcontractors or by each respective subcontractor or by any combination thereof which results in performance security equal to the total amount of the contract, pursuant to N.J.S.A. 40A:11-22. 

      The Certificate (Consent of Surety) shall also provide that if the contract for which the bid is awarded has one or more option terms, Surety hereby specifically consents that, in the event the Owner exercises the option(s) to extend the contract for an additional term(s), the performance guarantee shall automatically be deemed to extend to cover such additional period and the amount of the performance guarantee shall automatically increase to cover any increase in the contract for the option term(s). Failure to submit a consent of surety form consistent with the above terms shall result in rejection of the bid.

    • EXCEPTIONS TO THE BID SPECIFICATIONS

      Any conditions, limitations, provisions, amendments, or other changes attached to or added by the bidder to any of the provisions of these Bid Specifications or any changes made by the bidder on the Proposal Forms shall result in the rejection of the Bid Proposal by the Township of Holmdel.

    • RESPONSIBLE BIDDER

      The Township of Holmdel shall determine whether a bidder is "responsible" in accordance with N.J.S.A. 40A: 11-6.1. The Bid Proposal of any bidder that is deemed not to be "responsible" shall be rejected.

    • Changes to Bid Specifications

      Notices of revisions or addenda to the bid documents will be issued no later than five business days before the Wednesday, April 22, 2026

    • Radios/Cell Phones

      All vehicles shall be equipped with two-way radios or cellular telephones and shall be able to communicate with the Contractor's garage.

    • PERFORMANCE BOND

      A. For the one-year contract, the successful bidder shall provide a performance bond issued by a Surety in an amount equal to no more than 100% of the annual value of the contract. The successful bidder shall provide said performance bond to Holmdel's Purchasing Agent.

      B. Failure to submit the required performance bond at the specified time and place may result in assessment of damages and/or forfeiture of award. The contracting entity reserves the right to award the contract to the next lowest responsible proposer or to terminate the procurement process and reissue the solicitation.

      C. For a multi-year contract the successful bidder shall provide a performance bond issued by a Surety in an amount equal to no more than 100% of the annual value of the contract. The successful bidder shall provide said performance bond to the Purchasing Agent. The performance bond for each succeeding year shall be delivered to the Township of Holmdel with proof of full payment of the premium one hundred twenty (120) days prior to the expiration of the current bond.

      D. Failure to deliver a performance bond for any year of a multi-year, contract one hundred twenty (120) days prior to the termination of the current bond will constitute a breach of contract and will entitle the Township to terminate the contract upon the expiration of the current bond. Notwithstanding termination pursuant to this section, the contractor is obligated to fully perform through the date of termination of the contract and damages shall be assessed in an amount to the costs incurred by the Township of Holmdel in re-bidding the contract.

    • BID OPENING

      All bid proposals will be publicly opened and read by the Purchasing Agent or their designee at 10:00 am Prevailing Local time via the Township's eProcurement Portal on Wednesday, April 22, 2026 at 10:00 am. Bids must be delivered via the Township’s eProcurement Portal to the Office of Administration, before 10:00 am on Wednesday, April 22, 2026.  

      Bidder is solely responsible for the timely delivery of the Bid Proposal and no bids shall be considered which are presented after the public call for receiving bids. Any Bid Proposal received after the date and time specified will not be accepted. The Township is not responsible for any late, lost, or misdirected bids.

    • PERFORMANCE BOND

      A. For the duration of the contract award, the successful bidder shall provide a performance bond issued by a Surety in an amount equal to no more than 100% of the annual value of the contract. The successful bidder shall provide said performance bond concurrent with the delivery of the executed contract at the address indicated in the advertisement. The performance bond for each succeeding year shall be delivered to the Township of Holmdel with proof of full payment of the premium one hundred twenty (120) days prior to the expiration of the current bond. 

      B. Failure to deliver a performance bond for any year of a multiyear, contract one hundred twenty (120) days prior to the termination of the current bond will constitute a breach of contract and will entitle the Township of Holmdel to terminate the contract upon the expiration of the current bond. Notwithstanding termination pursuant to this section, the Contractor is obligated to fully perform through the date of termination of the contract and damages shall be assessed in an amount to the costs incurred by the Township of Holmdel in rebidding the contract including any increase in the contract amount. 

      C. Failure to deliver the performance bond at the time and place specified by the Township of Holmdel shall be cause for the assessment of damages in an amount equal to the amount of the bid guarantee.

       

    • "OR EQUAL" SUBSTITUTIONS 

      Whenever the Work Specifications identify a brand name, trade name or a manufacturer's name, this designation is used for classification or descriptive purposes only, and the bidder may substitute an equal product, subject to the approval of the Township of Holmdel.

      A. Brand names and/or descriptions used in these specifications are to acquaint bidders with the types of goods and services or materials and items desired and will be used as a standard by which goods and services or materials and items offered as equivalent will be evaluated. B. Variations between the goods and services or materials and items described and the goods and services or materials and items offered are to be fully identified and described by the bidder on a separate sheet and submitted with the bid proposal form. Vendor literature WILL NOT suffice in explaining exceptions to these specifications. In the absence of any exceptions by the bidder, it will be presumed and required that the goods and services or materials and items as described in the bid specification be provided or performed. C. When a specification uses "brand name or equivalent," the listed brand name shall serve as a reference or point of comparison for the functional or operational characteristic desired for the material being requested. Where a bidder submits an equivalent, it is the responsibility of the bidder to document and/or demonstrate the equivalency of the goods and services offered. Failure to submit such documentation shall be grounds for rejection of the claim of equivalence. The Owner reserves the right to evaluate the equivalency of the goods and services. D. In submitting its bid, the bidder certifies that the goods and services or materials and items to be furnished will not infringe upon any valid patent or trademark and that the successful bidder shall, at its own expense, defend any and all actions or suits charging such infringement, and will save the Owner harmless from any damages resulting from such infringement. E. Only manufactured and farm products of the United States, wherever available, shall be used pursuant to N.J.S.A. 40A:11-18. F. The contractor shall guarantee any or all goods and services or materials and items supplied under these specifications. Defective or inferior goods, materials, or items shall be replaced at the expense of the contractor. The contractor will be responsible for return freight or restocking charges.

    • AFFIRMATIVE ACTION REQUIREMENTS

      If awarded a contract; the successful Respondent will be required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27 et seq. 

      Within seven days after receipt of notification by the Township's intent to award the Contract the successful Respondent must submit to the Township of Holmdel, one of the following three (3) documents: 

      1. A photocopy of a valid letter identifying that the contractor is operating under an existing 

      federally approved or sanctioned affirmative action program, OR 

      2. A photocopy of a Certificate of Employment Information Report approval 

      issued in accordance with N.J.A.C. 17:27-4, OR 

      3. A photocopy of an Employee Information Report (Form AA302) provided by the Division of Contract Compliance and Equal Opportunity in Public Contracts and distributed to the public agency to be completed by the contractor in accordance with N.J.A.C. 17:27-4. 

      Failure to submit the affirmative action document by the fourteenth day shall be cause for the Township to declare the Contractor to be nonresponsive and to award the contract to the next lowest Respondent.

    • COMPLIANCE

      The bidder shall be familiar with and comply with all applicable local, state and federal laws and regulations in the submission of the Bid Proposal and, if the bidder is awarded the contract in the performance of the contract.

    • DEFINITIONS

      "Bid guarantee," means the bid bond, cashier's check or certified check submitted as part of the bid proposal, payable to the contracting unit, ensuring that the successful bidder will enter into a  contract. 

      "Bid proposal" means all documents, proposal forms, affidavits, certificates, statements required to be submitted by the bidder at the time of bid opening.

      "Bid specifications" means all the documents requesting bid proposals for municipal recycling collection and marketing services as described herein.

      "Certificate of insurance" means a document showing that an insurance policy has been written and includes a statement of the coverage of the policy.

      "Consent of Surety" means a contract or certificate, submitted by the bidder (contractor) with their bid proposal, that guarantees the surety company will provide the successful bidder with the required performance and payment bonds if the contract is awarded to them.

      "Contract" means the written agreement executed by and between the successful bidder and the governing body and shall include the bid proposal, and the bid specifications.

      "Contract Administrator" is the person authorized by the contracting unit to procure and administer contracts for 2025 ROAD IMPROVEMENT PROGRAM PROJECT.

      "Contracting unit" means a municipality or any board, commission, committee, authority or agency, and which has administrative jurisdiction over any district other than a school district, project, or facility, included or operating in whole or in part, within the territorial boundaries of any county to municipality which exercise actions which are appropriate for the exercise by one or more units of local government, and which has statutory power to make purchases and enter into contracts or agreements for the performance of any work of the furnishing or hiring of any materials or supplies usually required, the costs or contract price of which is to be paid with or out of public funds. 

      "Contractor" means the lowest responsible bidder to whom award of the contract shall be made.

      "Contractor" or "subcontractor" means a contractor or subcontractor who employs less than 1,000 employees in the State of New Jersey for the purposes of P.L.2009, Chapter 88, N.J.S.A. 34:11-68 as it applies herein.

      "Governing Body" means the governing body of the Township of Holmdel, New Jersey, when the contract or agreement is to be entered into by, or on behalf of a, municipality as further defined at N.J.A.C. 40A:11-2.

      "Guarantor" means, if applicable, the parent corporation or other third party, its successors or assigns, which has in each case guaranteed the performance by the successful bidder of each of the bidders' obligations under the terms of this bid. Such guarantee shall be evidenced by an agreement executed by the Guarantor, a form of which is set forth in these specifications.

      "Proposal forms" mean those forms that must be used by all bidders to set forth the prices for services to be provided under the contract.

      "Surety" means a company that is duly certified to do business in the State of New Jersey and that is qualified to issue bonds in the amount and of the type and character required by these specifications.

      End of Definitons Section

    • MAINTENANCE BOND 

      Upon acceptance of the work by the owner, the contractor shall submit a maintenance bond (N.J.S.A. 40A:11-16.3) in an amount not to exceed 100% of the project costs guaranteeing against defective quality of work or materials for the period of 2 years.

    • INSURANCE CERTIFICATE: Certificate of Insurance to be provided following award of contract.

      1. Worker's Compensation insurance 

      Workers Compensation insurance shall be maintained in full force during the life of the contract, covering all employees engaged in performance of the contract pursuant to N.J.S.A. 34:15-12(a) and N.J.A.C. 12:235-1.6. 

      2. General Liability Insurance 

      The Contractor shall obtain General Liability Insurance on an "occurrence" form with a one million dollar ($1,000,000.00) combined single limit of inability per occurrence and a two million dollar ($2,000,000.00) annual aggregate. The owner and all other parties required by the Owner, shall be named as additional insureds on the general liability using Additional Insured-Owners, Lessees or Contractors CG2010, Additional Insured - Owners, Lessees or Contractors - Completed Operations CG2037, or endorsements providing equivalent coverage to the additional insureds. Coverage for the additional insureds shall be as broad as the coverage provided for the named insured Contractor. It shall apply as primary and non- contributory insurance before any other insurance or self-insurance, including any deductible, maintained by, or provided to, the additional insured.

      3. Automotive Liability Insurance 

      The Contractor shall obtain Automobile Liability Insurance with a minimum combined limit of liability of one million dollars ($1,000,000.00) per accident. Said policy must include coverage for owned, non-owned and hired autos. Automobile liability must include as additional insureds all entities that are additional insureds on the General Liability.

      4. Owner and Contractor Protective Liability Insurance

      Owner and contractor protective liability insurance shall be maintained with a combined single limit amount of no less than $1,000,000.00 and shall be maintained in full force during the life of the contract.

      5. Employer's Liability Insurance

      Employer's liability insurance in the full statutory amount required by New Jersey law shall be maintained in full force during the life of the contract.

      6. Products and Completed Operations Liability Insurance

      Products and completed operations liability insurance in the amount of $1,000,000.00 shall be maintained in full force during the life of the contract. 

      7. Pollution Liability Insurance

      Comprehensive automotive liability insurance shall be maintained with a combined single limit of no less than $100,000.00 shall be maintained in full force during the life of the contract.

      8. Other Forms of Insurance Required

      The Township of Holmdel shall be named as additional insured on all insurance certificates issued for the project.

       

      Certificates of insurance for these policies required above shall be submitted with the contract. Such coverage shall be with an insurance company authorized to do business in the State of New Jersey and shall name the owner as an additional insured. 

       

       

       

       

    • VEHICLE DEDICATION AFFIDAVIT

      The Contractor must submit a Vehicle Dedication Affidavit that attests to one of the following:

      • The successful bidder will dedicate a fixed number of vehicles, which have been reasonably calculated to meet the requirements of these specifications.

      • If dedicating a fixed number of vehicles is not feasible, the Contractor must agree that the Township of Holmdel will receive credit for its proportional share of any materials in the collection vehicle, and this credit will be based on its share of materials at the time they are marketed.

    • CONFLICT OF INTEREST AND NON-COLLUSION

      Each bidder must execute and submit as part of the Bid Proposal a "Non - Collusion Affidavit" which at a minimum shall attest that:

      A. The bidder has not entered into any agreement or participated in any collusion with any person, corporate entity or government entity, or competitive bidding either alone or with any person, corporate entity or government entity in connection with the above named project;

      B. All statements made in the bid proposal are true and correct and made with the full knowledge that the contracting unit relies upon the truth of those statements in awarding the contract; and 

      C. No person or business is employed to solicit or secure the contract in exchange for commission, percentage brokerage agreement or contingency fee unless such person has been disclosed to the Township of Holmdel.

    • ERRORS IN PRICE CALCULATION

      All pricing must be submitted electronically through the designated Proposal Page via the Township's eProcurement Platform. The software automatically calculates and verifies all totals. The Township of Holmdel will consider the prices submitted via the electronic pricing tables as the official and binding bid prices for evaluation and award purposes. Mathematical errors are automatically corrected upon entry, ensuring all bids are complete and accurate. While the electronic platform automatically corrects mathematical errors, bidders remain solely responsible for any and all errors in judgment, including but not limited to, underestimating costs, misinterpreting the scope of work, or submitting an unprofitably low bid. Such errors are not subject to correction and will not be considered a basis for contract relief or modification after the bid submission deadline.

    • CERTIFICATES OF THE REQUIRED INSURANCE

      The Contractor shall use an Insurance Company (ies) that has (have) an A.M. Best Rating of at least AX. The Township, at is sole judgment and discretion, if it considers it appropriate to do so, may allow the Contractor to utilize and insure with a rating less than AX. All such requests must be forwarded to the Township for its review and approval. The Contractor shall use an insurance company(ies) that is (that are) authorized to underwrite insurance risks for the specific line(s) of coverage by the Department of Banking and Insurance of the State of New Jersey. 

    • EMPLOYEE WAGE REPORTING

      The contractor and any subcontractors engaged under this contract shall comply with all applicable federal, state, and local labor laws and regulations concerning the documentation and recordkeeping of individuals employed in the performance of this contract. This includes, but is not limited to, maintaining accurate records of hours worked, wages paid, and classifications of labor, as required by governing authorities.

      1) The contractor shall keep an accurate record showing the name, the actual hourly rate of wages paid to, and the actual daily, overtime and weekly hours worked by, each individual engaged in the collection and transportation work done under the contract, and any other records deemed necessary by the commissioner for the enforcement of wage payments. In addition, the records shall be preserved for two years from the date of payment. The record shall be open at all reasonable hours to the inspection of the Borough of Florham Park awarding the contract, any other party to the contract, and the commissioner. 

      2) By entering into a contract, the contractor acknowledges the provisions of N.J.S.A. 34:11-68 with regard to the authority of the Commissioner of the Department of Labor and Workforce Development to investigate the contractor or subcontractor's wages and any penalties that may result from failure to comply.

    • INDENMIFICATION

      Contractual Liability Insurance: The Contractor shall indemnify, defend, and hold harmless the Township, its consultants, its officers, agents, contractors, subcontractors, servants and employees, from and against any and all claims, demands, suits, proceedings, liabilities, judgments, awards, losses, damages, costs and expenses, including attorney's fees, because of bodily injury, sickness, disease or death, sustained by an person or persons or injury or damages to, or destruction of, any property directly or indirectly arising out of, relating to, or in connection with the work, whether or not due or claimed to be due, in whole or in part, to the active, passive or concurrent negligence or fault of the contractor, its officers, agents, servants, or employees and/or any other person or persons and whether or not such claims, demands, suits or proceedings are just, unjust, groundless, false, or fraudulent. The Contractor shall furnish evidence to the Township that with respect to accomplishing the work in the Agreement, it carries said contractual Liability Insurance in the amounts specified above.

      The contractor or subcontractor agrees to inform in writing its appropriate recruitment agencies including, but not limited to, employment agencies, placement bureaus, colleges, universities, and labor unions, that it does not discriminate on the basis of age, race, creed, color, national origin, ancestry, marital status, affectional or sexual orientation, gender identity or expression, disability, nationality or sex, and that it will discontinue the use of any recruitment agency which engages in direct or indirect discriminatory practices. 

      The contractor or subcontractor agrees to revise any of its testing procedures, if necessary, to assure that all personnel testing conforms with the principles of job-related testing, as established by the statutes and court decisions of the State of New Jersey and as established by applicable Federal law and applicable Federal court decisions. 

      In conforming with the targeted employment goals, the contractor or subcontractor agrees to review all procedures relating to transfer, upgrading, downgrading and layoff to ensure that all such actions are taken without regard to age, race, creed, color, national origin, ancestry, marital status, affectional or sexual orientation, gender identity or expression, disability, nationality or sex, consistent with the statutes and court decisions of the State of New Jersey, and applicable Federal law and applicable Federal court decisions. 

      The contractor shall submit to the public agency, after notification of award but prior to execution of a goods and services contract, one of the following three documents:

      The contractor and its subcontractors shall furnish such reports or other documents to the Division of Public Contracts Equal Employment Opportunity Compliance as may be requested by the office from time to time in order to carry out the purposes of these regulations, and public agencies shall furnish such information as may be requested by the Division of Public Contracts Equal Employment Opportunity Compliance for conducting a compliance investigation pursuant to Subchapter 10 of the Administrative Code at N.J.A.C. 17:27-5.2.

      During the performance of this contract, the contractor agrees as follows:

      The contractor or subcontractor, where applicable, will not     discriminate against any employee or applicant for employment     because of age, race, creed, color, national origin, ancestry, marital status, affectional or sexual orientation, gender identity or expression, disability, nationality or sex.       When hiring or scheduling workers in each construction trade, the contractor or subcontractor agrees to make good faith efforts to employ     minority and women workers in each construction trade consistent with the targeted employment goal prescribed by N.J.A.C. l7:27 7.2; provided, however, that the Division may, in its discretion, exempt a contractor or subcontractor from compliance with the good faith procedures prescribed by the following provisions, A, B and C, as long as the Division is satisfied that the contractor or subcontractor is employing workers provided by a union which provides evidence, in accordance with standards prescribed by the Division, that its percentage of active "card carrying" members who are minority and women workers is equal to or greater than the targeted employment goal established in accordance with N.J.A.C. l7:27 7.2.  The contractor or subcontractor agrees that a good faith effort shall include compliance with the following procedures:

       

       

          (A)    If the contractor or subcontractor has a referral agreement or arrangement with a union for a construction trade, the     contractor or subcontractor shall, within three business days of the     contract award, seek assurances from the union that it will cooperate with the contractor or subcontractor as it     fulfills its affirmative action obligations under this contract and in accordance with the rules promulgated by the Treasurer pursuant to N.J.S.A. 10:5-31 et. seq., as supplemented and amended from time to time and the Americans with Disabilities Act.  If the contractor or subcontractor is unable to obtain said assurances from the construction trade union at least five business days prior to the commencement of construction work, the contractor or subcontractor agrees to afford equal employment opportunities minority and women workers directly, consistent with this chapter.  If the contractor's or subcontractor's prior experience with a construction trade union, regardless of whether the union has provided said assurances, indicates a significant possibility that the trade union will not refer sufficient minority and women workers consistent with affording equal employment opportunities as specified in this chapter, the contractor or subcontractor agrees to be prepared to provide such opportunities to minority and women workers directly, consistent with this chapter, by complying with the hiring or scheduling procedures prescribed under (B) below; and the contractor or subcontractor further agrees to take said action immediately if it determines that the union is not referring minority and women workers consistent with the equal employment opportunity goals set forth in this chapter.

               (B)    If good faith efforts to meet targeted employment goals have not or cannot be met for each construction trade by adhering to the procedures of (A) above, or if the contractor does not have a referral agreement or arrangement with a union for a construction trade, the contractor or subcontractor agrees to take the following actions:

      (l) To notify the public agency compliance officer, the Division, and minority and women referral organizations listed by the Division pursuant to N.J.A.C. 17:27-5.3, of its workforce needs, and request referral of minority and women workers;
              
      (2) To notify any minority and women workers who have been listed with it as awaiting available vacancies;

      (3) Prior to commencement of work, to request that the local construction     trade union refer minority and women workers to fill job openings, provided the contractor or subcontractor has a referral agreement or arrangement with a union for the construction trade;

      (4) To leave standing requests for additional referral to minority and     women workers with the local construction trade union, provided the contractor or subcontractor has a referral agreement or arrangement with a union for the construction trade, the State Training and Employment Service and other approved referral sources in the area;

      (5) If it is necessary to lay off some of the workers in a given trade on the construction site, layoffs shall be conducted in compliance with the equal employment opportunity and non-discrimination standards set forth in this regulation, as well as with applicable Federal and State court decisions;

      (6) To adhere to the following procedure when minority and women workers apply or are referred to the contractor or subcontractor:

      (i) The contactor or subcontractor shall interview the referred minority or women worker.

      (ii) If said individuals have never previously received any document or certification signifying a level of qualification lower than that required in order to perform the work of the construction trade, the contractor or subcontractor shall in good faith determine the qualifications of such individuals. The contractor or subcontractor shall hire or schedule those individuals who satisfy appropriate qualification standards in conformity with the equal employment opportunity and non-discrimination principles set forth in this chapter. However, a contractor or subcontractor shall determine that the individual at least possesses the requisite skills, and experience recognized by a union, apprentice program or a referral agency, provided the referral agency is acceptable to the Division. If necessary, the contractor or subcontractor shall hire or schedule minority and women workers who qualify as trainees pursuant to these rules. All of the requirements, however, are limited by the provisions of (C) below.

      (iii) The name of any interested women or minority individual shall be maintained on a waiting list, and shall be considered for employment as described in (i) above, whenever vacancies occur. At the request of the Division, the contractor or subcontractor shall provide evidence of its good faith efforts to employ women and minorities from the list to fill vacancies.

      (iv) If, for any reason, said contractor or subcontractor     determines that a minority individual or a woman is not qualified or if the individual qualifies as an advanced trainee or apprentice, the contractor or subcontractor     shall inform the individual in writing of the reasons for the determination, maintain a copy of the determination in its files, and send a copy to the public agency compliance officer and     to the Division.

      (7) To keep a complete and accurate record of all requests made for the referral of workers in any trade covered by the contract,     on forms made available by the Division and submitted promptly to the Division upon request.

               (C) The contractor or subcontractor agrees that nothing contained     in (B) above shall preclude the contractor or     subcontractor from complying with the union hiring hall or apprenticeship policies in any applicable collective bargaining agreement or union hiring hall arrangement, and, where required by custom or agreement, it shall send journeymen and trainees to the union for referral, or to the apprenticeship program for admission, pursuant to such agreement or arrangement. However, where the practices of a     union or apprenticeship program will result in the exclusion of minorities and women or the failure to refer minorities and women consistent with the targeted county employment goal, the contractor or subcontractor shall consider for employment persons referred pursuant to (B) above without regard to such agreement or    arrangement; provided further, however, that the contractor or subcontractor shall not be required to     employ women and minority advanced trainees and trainees in numbers which result in the employment of advanced trainees and trainees as a percentage of the total workforce for the     construction trade, which percentage significantly exceeds the     apprentice to journey worker ratio specified in the applicable collective bargaining agreement, or in the absence of a collective bargaining agreement, exceeds the ratio established     by practice in the area for said construction trade.  Also, the contractor or subcontractor agrees that, in implementing the procedures of (B) above, it shall, where applicable, employ minority and women workers residing within the geographical jurisdiction of the union.

       

       

       

      After notification of award, but prior to signing a construction contract,
      the contractor shall submit to the public agency compliance officer and the
      Division an initial project workforce report (Form AA 201) electronically provided to the public agency by the Division, through its website, for distribution to and completion by the contractor, in accordance with N.J.A.C. 17:27-7. The contractor also agrees to submit a copy of the Monthly Project Workforce Report once a month thereafter for the duration of this contract to the Division and to the public agency compliance officer.

      The contractor agrees to cooperate with the public agency in the payment of
      budgeted funds, as is necessary, for on the job and/or off the job programs 
      for outreach and training of minorities and women.

              (D)  The contractor and its subcontractors shall furnish such     reports or 
      other documents to the Division of Public Contracts Equal Employment Opportunity Compliance as may be requested by the Division from time to time in order to carry out the purposes of these regulations, and public agencies shall furnish such information as may be requested by the Division of Public Contracts Equal Employment Opportunity Compliance for conducting a compliance investigation pursuant to Subchapter l0 of the Administrative Code (NJAC 17:27). 

    • APPENDIX A AMERICANS WITH DISABILITIES ACT OF 1990 Equal Opportunity for Individuals with Disability (required)

      The contractor and the Township of Holmdel, (hereafter "owner") do hereby agree that the provisions of Title 11 of the Americans With Disabilities Act of 1990 (the "Act") (42 U.S.C. S121 01 et seq.), which prohibits discrimination on the basis of disability by public entities in all services, programs, and activities provided or made available by public entities, and the rules and regulations promulgated pursuant there unto, are made a part of this contract. In providing any aid, benefit, or service on behalf of the owner pursuant to this contract, the contractor agrees that the performance shall be in strict compliance with the Act. In the event that the contractor, its agents, servants, employees, or subcontractors violate or are alleged to have violated the Act during the performance of this contract, the contractor shall defend the owner in any action or administrative proceeding commenced pursuant to this Act. The contractor shall indemnify, protect, and save harmless the owner, its agents, servants, and employees from and against any and all suits, claims, losses, demands, or damages, of whatever kind or nature arising out of or claimed to arise out of the alleged violation. The contractor shall, at its own expense, appear, defend, and pay any and all charges for legal services and any and all costs and other expenses arising from such action or administrative proceeding or incurred in connection therewith. In any and all complaints brought pursuant to the owner's grievance procedure, the contractor agrees to abide by any decision of the owner which is rendered pursuant to said grievance procedure. If any action or administrative proceeding results in an award of damages against the owner, or if the owner incurs any expense to cure a violation of the ADA which has been brought pursuant to its grievance procedure, the contractor shall satisfy and discharge the same at its own expense. 

      The owner shall, as soon as practicable after a claim has been made against it, give written notice thereof to the contractor along with full and complete particulars of the claim, If any action or administrative proceeding is brought against the owner or any of its agents, servants, and employees, the owner shall expeditiously forward or have forwarded to the contractor every demand, complaint, notice, summons, pleading, or other process received by the owner or its representatives. 

      It is expressly agreed and understood that any approval by the owner of the services provided by the contractor pursuant to this contract will not relieve the contractor of the obligation to comply with the Act and to defend, indemnify, protect, and save harmless the owner pursuant to this paragraph. 

      It is further agreed and understood that the owner assumes no obligation to indemnify or save harmless the contractor, its agents, servants, employees and subcontractors for any claim which may arise out of their performance of this Agreement. Furthermore, the contractor expressly understands and agrees that the provisions of this indemnification clause shall in no way limit the contractor's obligations assumed in this Agreement, nor shall they be construed to relieve the contractor from any liability, nor preclude the owner from taking any other actions available to it under any other provisions of the Agreement or otherwise at law.

      INSTRUCTIONS TO BIDDERS **

      "Bid guarantee," means the bid bond, cashier's check or certified check submitted as part of the bid proposal, payable to the contracting unit, ensuring that the successful bidder will enter into a

      "Guarantor" means, if applicable, the parent corporation or other third party, its successors or assigns, which has in each case guaranteed the performance by the successful bidder of each of the bidders' obligations under the terms of this bid.       "Legal newspaper" means the Asbury Park Press and Star Ledger.

      "Proposal forms" mean those forms that must be used by all bidders to set forth the prices for services to be provided under the contract.

    Q (No subject): We are currently reviewing the bid documents for Bid #02-2026 – 2025 Road Improvement Program and have downloaded all materials available on the procurement portal. We do see the proposal pages listing quantities; however, we were unable to locate any construction drawings, plan sets, or project detail sheets associated with this program. At this time, we only have the scope of work and specification documents. Please confirm whether there are construction drawings, plan sheets, or street/location maps available for this project? If so, kindly advise where those documents can be accessed or provide them directly. If no formal plan set exists for this program, please confirm that as well so we can proceed accordingly. Thank you for your assistance, and we appreciate your clarification on this matter.

For reference, the highlighted street map of the 2025 Road Improvement Program Project can be found under question #19 in the Vendor Questionnaire section of the bid documents. Additionally, all project streets are listed in the Overview Summary portion of the bid.
