    Description

    The City of Portsmouth, NH is requesting sealed responses for 2026 Sidewalk Repairs. Responses are to be submitted electronically via the eProcurement Portal at https://procurement.opengov.com/portal/cityofportsmouth before 2:00 pm on Wednesday, April 8, 2026. Late responses will not be accepted.

    This project consists of Sidewalk improvements at multiple locations within the City limits.

    The following list of locations have sidewalks of various materials that are in disrepair. These sidewalks may be heaved, cracked, spalling, disintegrated and have broken or missing ADA tactile panels. The purpose of this project is to bring these areas of concern up to the City's standard for sidewalks and meet all ADA regulations while matching the construction type and material of the adjacent sidewalk network.

     

    This project will be bid as multiple individual locations in need of repair. Bidders are to express a total price for each location, including removal of existing conditions, subgrade work, sidewalk construction, restoration of existing conditions, traffic control, mobilization and any additional scope necessary to complete the location. Bidders are encouraged to visit each location listed in this bid to determine the extent of work necessary; any areas/quantities listed in this bid are approximate and may not accurately reflect work necessary. This project shall be awarded based upon pricing for the lump sum section of the pricing proposal. Should any quantities be more than 10% greater than the City's estimate, shown in the attached document, the City shall compensate the difference based on the unit cost table. Traffic control plans will be required for each location at the engineer's discretion.

    The schedule of values in the bid tab shall be utilized should the City determine additional locations that sidewalk repairs are necessary during the duration of this contract. It is possible that the City shall identify additional locations for repair throughout the summer construction season.

    Work may begin on or after: April 15, 2026.  All sections of the work shall be completed by July 30th, 2026.  Liquidated damages shall be assessed at $100.00 per day.

    Evaluation Criteria

    • Submission of Bids

      Bidders shall respond to 2026 Sidewalk Repairs by submitting a price proposal ( bid) via the City of Portsmouth's (Owner's) e-Procurement Portal via https://procurement.opengov.com/portal/cityofportsmouth. Bids will be accepted until 2:00 pm on Wednesday, April 8, 2026.

      Bid results will be published within two business days of the bid submission deadline.

      Bidder agrees that if its bid is accepted it will enter into an Agreement with the Owner in the form included in the solicitation and to perform the work described in the Contract Documents for the prices and within the timelines indicated in this solicitation.

    • Investigation

      The City reserves the right to undertake any investigation it deems necessary to evaluate the qualifications of any vendor and any to verify any representations made by the vendor.  A vendor may be requested to execute a release for information. Failure to provide a release upon request will result in disqualification.

    • Questions

      All questions shall be submitted through the e-Procurement Portal. No statements made by the Owner or the Owner's consultants or representatives made during any pre-bid meeting or other contact shall be deemed to amend this Solicitation or the Contract Documents unless the statement has been incorporated into an Addendum and issued through the e-Procurement Portal.

    • Pre-Proposal Meeting

      If a pre-proposal meeting is mandatory, failure to attend the meeting will result in disqualification of bidder.

    • Concepts and Ideas

      The City reserves the right to use, without payment, any concepts, ideas, information or other product submitted as part of this solicitation. 

    • Withdrawal of Bids

      Bidder is permitted to un-submit or withdraw a price proposal prior to the submission deadline through the e-Procurement portal.

    • Rejection and Acceptance

      The City of Portsmouth reserves the right to reject any or all bids, to waive technical or legal deficiencies of any bid, and to accept any bid that may be in the best interest of the City.

    • Review all Parts of the Solicitation

      Bidder should carefully review all parts of this solicitation, including any and all attachments, prior to submitting a price proposal.

    • Familiarity with Laws

      Bidder is assumed to be familiar with all local ordinances and State and federal regulations and laws that may be applicable to the Scope of Work/Specifications and prepared to work in conformity with such requirements. If the Bidder discovers that any portion of the Scope of Work/Specifications are or may be in conflict with any legal requirements, Bidder shall submit a question to the City seeking correction or clarification.

    • Unit Pricing and Quantities

      Each Unit Price in the Price Proposal table should include an amount considered by Bidder to be adequate to cover Contractor's overhead and profit for each separately identified item.

      The quantities appearing in the bid/price proposal form are approximate only and are prepared for the comparison of bids. Payment to the contractor will be made only for actual work performed and accepted in accordance with the contract.  Any scheduled item of work to be done and materials to be furnished may be increased, decreased or omitted and no claim for loss, anticipated profits or costs incurred in anticipation of work not ultimately performed will be allowed due to such increase or decrease.

    • Disqualification

      The City may, in its sole discretion, disqualify a bidder and reject the submitted bid or proposal for any of the following reasons:

      • Failure to meet the qualifications required for the work;
      • Failure to submit all required information requested in the solicitation;
      • Failure to attend any mandatory pre-proposal meeting;
      • Lack of competency or of adequate machinery, plant or other equipment, as revealed by any submitted information or otherwise;
      • Uncompleted work which, in the judgment of the City, might hinder or prevent the prompt completion of work if awarded;
      • Failure to promptly supply materials or items under prior contracts;
      • Failure to pay, or satisfactorily settle, all bills due for labor and materials on former contracts;
      • Default or unsatisfactory performance on previous contracts;
      • More than one bid or proposal l for the same work from an individual, firm, or corporation under the same or different name;
      • Evidence of collusion among bidders;
      • Such disqualification would be in the best interests of the City.
    • Representations of Bidders

      By submitting a bid, Bidder represents that:

      • Bidder has carefully reviewed the specifications, plans, schedule and all contract documents described in this Solicitation;
      • Bidder is authorized to do business in the State of New Hampshire;
      • Bidder meets all licensing, certifications, or other qualifications described;
      • Bidder has the necessary financial, labor and skills to meet the requirements of the work; and
      • Bidder has not engaged in collusion with other Bidders
      • No officer, agent or employee of the Owner is directly or indirectly interested in this Bid; and
      • The bid is not made jointly, or in conjunction, cooperation or collusion with any other person, firm, corporation, or other legal entity.

    • Bid Acceptance Period

      By submitting a bid, Bidder agrees the price(s) will remain firm and subject to acceptance for thirty (30) days after the Bid Submission Deadline or for such longer period of time that Bidder may agree to in writing upon request of Owner.

    • Award

      If an award is to be made, it will be made to the lowest, responsible and qualified bidder. Determination of the lowest bidder will be based on the Base bid, or the Base Bid with any combination of Add Alternates the Owner deems to be in its best interest, for the work described on the bid proposal form. A responsible and qualified bidder is a bidder that:

      • has the ability, capacity and/or skill to perform timely and with quality workmanship;
      • has the supplies and materials of a quality and quantity to meet the specifications; and
      • can meet any other applicable factors as the City reasonably determines necessary or appropriate to the scope of the solicitation and is not otherwise disqualified as described in this solicitation.

      Verbal notification of award is not considered official. Any action by the bidder to assume otherwise is done so bidder's own risk and the Owner will not be held liable for any expense incurred by a bidder that has not received an official award in writing through the e-Procurement Portal.

    • Execution of Contract

      Within fifteen (15 days) of receipt of Notice of Award, successful bidder shall execute all contract documents and provide such proof of insurance and bonds as may be required by the solicitation and the contract documents. Failure to execute and provide all required documents may result in disqualification and the City proceeding to the next lowest bidder. Owner will execute all contractual documents within fifteen (15) days after receipt of all of bidders satisfactory required documentation.
