    Evaluation Criteria

    • Invitation to Submit Qualifications

      The San Joaquin Delta Community College District (“District”) intends to improve the Stockton campus’ (“Campus”) by updating network cabling for legacy buildings at the District’s Stockton Campus using the Design-Build Delivery (“DB”) method authorized by the California Education Code sections 81700 et. seq., and other applicable laws, to design and construct the following project at the Stockton Campus: Technology Cabling Project (hereinafter referred to as the “Project”). 

      The term Project as used in this Request for Qualifications (“RFQ”) means all structures, site work, on-site work, off-site work, or other improvements to real property of every kind and nature provided for or reasonably inferable from the Construction Documents approved by the District and any applicable agencies having jurisdiction over the Project (“AHJs”) at the end of the “Design through Agency Approval Phase Services” for the Project involved in this procurement. 

      The RFQ currently anticipates that one Design-Build Contract will be awarded to one Design-Build Entity ("DBE") for the Project under the Request for Proposal (“RFP”) portion of the procurement process which will follow the instant RFQ process outlined herein.   

      A sample of the Design-Build Contract, and associated exhibits, are attached hereto as "Attachment J – All Exhibits."  The Design-Build Contract is anticipated to contain three (3) distinct scopes of services/work generally described as a “phase” (i.e., the “Collaboration Phase Services;” “Design through Agency Approval Phase Services; and “Construction Phase Services”.  The District reserves the right to terminate the Design-Build Contract during or at the end of each Phase of Services.  For more details, see the Exhibits for each phase.  A sample of the General Conditions for the Project is also contained in "Attachment J – All Exhibits."  All of these are included as “SAMPLES” and are for reference only at this time.  The District is implementing an Owner Controlled Insurance Program (“OCIP”), as referenced in and part of Referenced in and also part of "Attachment J – All Exhibits." The Statewide Educational Wrap-Up Program Manual referenced in and is also part of "Attachment J – All Exhibits." This project will require the inclusion of a Project Labor Agreement (Attachment J -- All Exhibits). The selected DBE will be contractually required to comply and cooperate with the District in the implementation of the PLA and OCIP for the Project.

      This procurement process will take place in two steps 

      Step 1 is the instant Request for Qualifications process (“RFQ”). 

      Step 2 will be a Request for Proposal process open only to those firms pre-qualified pursuant to this instant RFQ (“RFP”).  

      Upon receipt and evaluation of the Statements of Qualifications (“SOQ’s”) submitted in response to this RFQ, the SOQ’s will be scored, evaluated and ranked with the District selecting approximately three (3) to five (5) pre-qualified Applicant firms, designated as “Finalists”, to receive the RFP.  The District reserves the right to hold interviews before selection of the Finalist group.  The District reserves the right to increase or decrease the number of firms in the Finalist group as it determines to be in its own best interests, at any time during the RFQ/RFP process.   

      The Finalists’ proposals submitted in response to the RFP will then be scored and evaluated.  Interviews and/or negotiations may take place at the District’s discretion.  The successful Design-Build Entity (“DBE”) will then be identified for award of the Design-Build Contract using a “Best Value” (qualitative) method of selection.   

      The District has determined that before receiving proposals for the design and construction of the Project, as described below, all DBE’s must be pre-qualified.  A “DBE” means a corporation, partnership, sole proprietorship, or joint-venture, properly licensed to design and construct improvements under the laws of the State of California and to provide the services described in this RFQ.   

      By this Request for Qualifications (“RFQ”), the District hereby extends an invitation to submit Statements of Qualifications, in accordance with this RFQ, in order to qualify DBE’s for the Project and for possible participation in the RFP portion of this procurement as stated.  DBE’s are also sometimes hereinafter referred to as an “Applicant” and/or the “Applicants”. 

      All information submitted to the District shall become property of the District and will be returned to the Applicant at the District’s option. 

      There are no expressed or implied obligations for the District to reimburse responding firms for any expense incurred in preparing an Application/Statement of Qualifications (collectively “SOQ’s”) in response to this RFQ. 

      The District reserves the right to reject any or all of the submitted SOQ’s at any time if it deems doing so to be in its own best interests. 

    • Request for Qualifications Document

      This Request for Qualifications is comprised of:  

      3.1.1 This Request for Qualifications document (and Attachments and Appendices):  

      1. Qualification Questionnaire (Attachment A); 

      1. Acknowledgment of Addenda (Attachment B); 

      1. Applicant Declaration (Attachment C); 

      1. Non-Collusion Declaration (Attachment D);

      The RFQ may be subsequently, altered, modified, changed and/or amended only by way of Addenda as described below.  

      This Request for Qualifications document itself describes the process an Applicant seeking qualification status must follow. 

      The Qualification Questionnaire (Attachment A) sets forth the criteria for qualification.  It must be filled out and turned in with an Applicant’s Statement of Qualifications (“SOQ”), together with Attachments B through H attached hereto.

      The District intends to qualify DBE’s under this instant RFQ process and then subsequently select a DBE through a Request for Proposal process to design and construct the Project using the Design-Build Delivery method authorized by California Education Code sections 81700 et.  seq., and other applicable laws. 

    • Generally

      The District expressly reserves the unqualified right to undertake any of the following if advantageous to the District:

      6.1.1. Accept or reject any or all of the submitted SOQs;

      6.1.2 Waive or decline to waive any and all defects as to form, content, informalities, minor technical inconsistencies and/or irregularities in any SOQ or the RFQ/SOQ process;

      6.1.3. Terminate the RFQ/SOQ process at any time;

      6.1.4. Modify and/or suspend any and all aspects of the RFQ/SOQ;

      6.1.5. Re-issue the RFQ;

      6.1.6. Extend the time frame for submission of the SOQs to the parties known to District to have received a copy of the RFQ.  Any deadlines, if extended, will be done by the issuing of Addenda.  It is solely an Applicant’s obligation to check for any and all Addenda and the contents thereof;

      6.1.7. Accept amendments (if requested by the District) to SOQs after expiration of the deadline for receipt of SOQs;

      6.1.8. Request clarification of information submitted, or to request additional information, from any or all submitting Applicants;

      6.1.9 Hold all SOQs for a period of ninety (90) days after the deadline for receipt of SOQs;

      6.1.10. Decline to enter into a contract with any Applicant after the RFP process following the RFQ process; and

      6.1.11. Conduct personal interviews of any or all Applicants during the RFQ/SOQ process before making selection or recasting of the Finalists in this RFQ/SOQ process.

       

       

    • Statement of Qualifications Deadline

      Applicants interested in qualifying are to submit their Statement of Qualifications (SOQ) as described herein below:

      5.1.1 Electronic SOQs Submittal. All SOQs shall be submitted electronically and before the date/time set forth in the Notice to Applicants via the District’s procurement management system, OpenGov. To access, Applicants shall create a FREE account with OpenGov Procurement by signing up at https://procurement.opengov.com/signup. Once Applicant has completed account registration, Applicant should browse back to this page, click on “Submit Response”, and follow the instructions to submit its SOQ.  

      SOQs which are not submitted through the District’s procurement management system are non-responsive and will be rejected. The District is not responsible for or liable to Applicants for: (i) inaccessibility of the District’s procurement management system; or (ii) untimely, incomplete or inaccurate data submitted through the District’s procurement management system. Applicants experiencing any technical difficulties with the SOQ submission process may contact OpenGov Support.       5.1.2  Electronic Submission Requirements. Applicants must attach a pdf file(s) to the electronic SOQ submission containing all the completed and signed SOQ Documents.   

      5.1.3  SOQ Documents. The SOQ Documents are available only through the District’s procurement management system, OpenGov. OpenGov may be accessed through the District’s Purchasing webpage:

      Applicants must be registered to view and download the documents. There is no charge to sign up. Any and all RFQ Addenda will be posted on OpenGov. It shall be Applicant’s sole responsibility to conduct periodic checks of this webpage to identify and download any RFQ Addenda and to be completely familiar with the contents thereof.

      5.1.4 Date and Time of SOQ Submittal. The OpenGov clock is controlling and determinative as to the time of the Applicant’s submittal of the SOQ. The foregoing notwithstanding, whether or not SOQs are opened exactly at the time fixed in the Notice to Applicants for SOQs, no SOQ shall be received or considered by the District after. SOQs submitted after such time are nonresponsive. SOQ results after the deadline for submitting SOQs posted on OpenGov are unofficial and require further review prior to Finalists being identified. 

      All SOQ’s must be received no later than July 1, 2026, at 2:00PM  

      Any SOQ received after this deadline may not be considered.   District and CM and possibly other District staff and/or consultants will evaluate the Statement of Qualifications in accordance with the selection criteria specified in the RFQ and the Qualification Questionnaire. Deadlines may be extended by Addenda.   

      Qualification is Mandatory to Proposing on the Project 

      It is mandatory that any DBE intending to ultimately submit a proposal to design and construct the Project must submit a Statement of Qualifications and receive “Finalist” status.  No proposal to design and construct the Project will be accepted except from those Applicants that have been designated as “Finalists” by the District for the Project pursuant to this RFQ. 

       

    • Specifically

       

      6.2.1 The SOQs submitted in response to this RFQ will become the property of the District and may be used by the District in any way it deems appropriate;

      6.2.2. While the information submitted in your SOQ will become a public record after award of a DBE contract, the reviewed and audited financial information submitted by an Applicant will remain confidential and not disclosed in response to any Public Record Act Request or similar request for information.  District will use these documents as part of the basis of rating Applicants for the Project.  District reserves the right to verify and check information submitted from all other sources available to District.  District’s decision will be based on objective evaluation criteria as set forth in the Qualification Questionnaire that accompanies this RFQ (Attachment A);

      6.2.3. Acceptance of any SOQ will take into consideration the reliability of the Applicant, past documented performance of the Applicant, and all of its proposed team members and sub-consultants, and the appropriateness of the information provided.  The District will, in the exercise of its discretion, be the sole judge in the determination of the quality and appropriateness of the SOQ.  The District's decision will be final.  Even though an Applicant receives prequalification and/or Finalist status, nothing shall restrict or prevent the District from reconsidering an Applicant’s and/or Proposer’s status regarding “responsibility” should the District learn facts bearing thereon;

      6.2.4. All costs for preparation, submission and/or delivery of the SOQ incurred by the Applicant are the sole responsibility of the Applicant and will not be paid by the District.  The District will not be liable for any costs incurred in the preparation of SOQs or incidental to the preparation and presentation of qualifications either orally or in writing. Any costs incurred in the preparation of the SOQ, in the submission of additional information, and/or in any other aspect of the SOQ before the award of a contract will be borne by the Applicant;

      6.2.5. SOQs that are submitted with conditional clauses, alterations, items not called for in the RFQ, or irregularities of any kind, are subject to rejection by the District, at its option;

      6.2.6. By submitting a SOQ, the Applicant acknowledges that he has investigated and satisfied himself/herself/itself as to the conditions affecting the work.  The District shall not be responsible for any conclusions or interpretations made by an Applicant of the information made available by the District;

      6.2.7. The submission of a SOQ shall be prima facie evidence that the Applicant has full knowledge of the scope and nature of the work and services to be performed.  The receipt by the District of a SOQ will indicate that the submitting Applicant understands the requirements and shall supply the work and services required;

      6.2.8. The District reserves the right to require that the Applicant demonstrate that it has the skills, equipment, and other resources necessary to satisfactorily perform the nature and magnitude of work and services necessary to complete the Project within the proposed contract’s schedule;

      6.2.9. The Applicant shall furnish the District with such additional information as the District may reasonably require and request;

      6.2.10. The District will require the selected DBE to have a valid California Design Professional’s License and a valid Contractor's B or C-7 License issued by the state of California, appropriate valid professional licenses, and to provide evidence of appropriate insurance and bonding coverage/capacity;

      6.2.11. At the end of the RFP process, the District will require the selected DBE to enter into a contract prepared by the District, a sample of which will be included in this RFQ and the RFP;

      6.2.12. Unless and except requested to do so in writing either in response to a written request for clarification from District or as otherwise permitted by the RFQ or RFP Documents, Applicants/Proposers and their Design Team Members, Sub-consultants and Subcontractors shall not communicate, either verbally or in writing, with: (1) any member of the RFQ/RFP Selection Committee; (2) any consultant or professional retained by the District for the purpose of providing the District or Campus advice or professional services in respect to the Project, the Request for Proposal process or the Award of the Design-Build contract; or (3) any trustee, officer, employee or representative of the District or Campus with respect to any matter relating to the Project;

      6.2.13. Statements of Qualifications and/or Financial Statements received after the time and date specified may not be considered and may be returned to the Applicant unopened, at the sole discretion of the District.  It is the sole responsibility of each Applicant to ensure that their Statement of Qualifications and Financial Statements arrive at the required locations before or at the time and date specified;

      6.2.14. No individual or firm responding to this RFQ shall obtain any claim or cause of action against the District by reason of any aspect of the RFQ, defects or abnormalities contained herein, defects or abnormalities in the selection process, the rejection of any SOQ, the acceptance of any SOQ, any statements, representation, acts or omissions of the District, the exercise of any discretion by the District in connection with any of the foregoing, or any and all other matters arising out of all or any of the foregoing;

      6.2.15. No contract will be awarded in response to this RFQ.  A Contract may be awarded to one of the Finalists selected through the RFQ process, but only after a subsequent Request for Proposal process takes place involving the Finalists.  The District reserves the right to increase the number of Finalists at any time before the award of a contract if the District determines it is in its best interest to do so;

      6.2.16. All references in this RFQ to the Design-Build Team, DBE, Applicant, Vendor, contractor, designer, engineer, and other person or persons, are made relative to the singular person, male gender (i.e., "he'', "him", "his", etc.).  These are intended only as generic terms and shall be interpreted to apply to any number and any gender, as applicable.  The singular male reference used in the documents is employed solely to simplify text and to conform to commonly used construction specification language.

      6.2.17. The District will provide during the Request for Proposal portion of this procurement (i.e., “Step 2”) a list of specified items that the District’s Board of Trustees has determined to be an exception to Public Contract Code section 3400.  No substitutions will be permitted for such items for the project.

    • Mandatory Pre-SOQ Meeting and Job Walk

      Attendance at the Pre-SOQ Meeting and Job Walk is mandatory; thus, all Design-Build Entities interested in pre-qualifying to provide Design-Build Entity Services for Project must attend. The Mandatory Pre-SOQ Meeting and Job Walk will be held at 10:00AM, on June 16, 2026, at 5151 Pacific Avenue, Stockton, CA 95207 in the Purchasing Conference Room in Danner Hall Basement (B4), Purchasing Office.

    • Measure K Bond Program

      Measure K is a $598 million facilities improvement bond measure the District’s Board of Trustees voted to place on the November 2024 ballot which was approved by the voters.  Proceeds from Measure K will provide local controlled funding to fix old plumbing and continue to provide clean drinking water; repair leaky roofs and remove asbestos, lead paint and mold; improve student safety on campus; upgrade classrooms and labs for career technical education programs to prepare students to enter the workforce; and prepare students to transfer to four-year colleges and universities.   

    • Statement of Qualifications Requirements

      This section describes how you should package your Statement of Qualifications for submittal. SOQ’s should be prepared simply and economically, providing a straightforward, concise description of how the Applicant can meet the requirements of the RFQ and the Project.  Emphasis shall be on the quality, completeness, clarity of content, responsiveness to the requirements, and an understanding of the District’s needs.

      Applicants shall carefully read the information contained in this RFQ and Attachment “A” hereto.  Applicants shall submit a complete response to all requirements thereof.  An incomplete SOQ will be considered non-responsive and subject to rejection.

      To prepare a SOQ, fill out the Qualification Questionnaire (Attachment A) and follow the instructions below.  Additional instructions are set forth in Attachment “A” itself.  It is very important that an Applicant follow the instructions set forth in this RFQ and the instructions set forth in Attachment “A”.

      The SOQ shall be limited to only the pages specifically required below.  Any page limit referenced in the RFQ documents does not include the audited/reviewed financial statements required by Paragraph 5.3 of this RFQ and Question 1 in Section IV of the Qualification Questionnaire (Attachment A) pertaining to three (3) years of most recent audited and/or reviewed financial statements including balance sheets and income statements.  One (1) page is equal to one side of one sheet of paper.

      Following the Cover Page, create a Table of Contents that indicates all of the parts in the Statement of Qualifications being submitted, including page numbers.

      Following the Cover Page and Table of Contents, the SOQ should be formatted as follows:

      5.2.1 Cover Letter/Letter of Interest

      Following the Cover Page and Table of Contents, the DBE shall prepare and insert a Cover Letter/Letter of Interest.  The letter must be no more than three (3) pages and addressed as follows:

      The Cover Letter must contain the following:

       

      5.2.1.1 Cover Letter must be signed by a representative(s) of the Applicant with authorization to bind the DBE to the terms of the RFQ, and to negotiate contract terms and make binding decisions in all matters relating to the RFQ and RFP (e.g. contractor and any joint venture partner(s));

      5.2.1.2 Cover Letter must include the name, title, address, telephone number and email address of the contact person on behalf of the Applicant for the duration of the RFQ process;

      5.2.1.3 Cover Letter should include the name(s), address(es), and telephone number(s) of each team member’s main office; and

      5.2.1.4 Cover Letter should include a brief statement of why the Applicant should be pre-qualified to participate in the RFP portion of this procurement for the Project.

      5.2.2. Completed Qualification Questionnaire

      The Qualification Questionnaire is affixed to this RFQ as Attachment “A.”  Attachment “A” must be filled out and submitted as a part of the SOQ by the DBE.  The additional documents and information requested by the Qualification Questionnaire (except for the Financial Statements) should be inserted and arranged in your SOQ immediately following the filled-out Qualification Questionnaire form.  Additionally, the additional documents and/or information you provide (in response to the Qualification Questionnaire form) should be labeled and identified using the same Section and Question Number that corresponds with the Qualification Questionnaire Section and Question Number.

      5.2.3. The following eight (8) documents must ALL be signed and submitted as part of your SOQ.  Signature of the Applicant is the only signature required:

          • Qualification Questionnaire (Attachment A);
          • Acknowledgment of Addenda (Attachment B);
          • Applicant Declaration (Attachment C);
          • Non-Collusion Declaration (Attachment D);
          • Non-Discrimination Declaration (Attachment E);
          • Conflict of Interest Certification (Attachment F);
          • Authority to Release Information Form (Attachment G); and
          • Project Labor Agreement – Agreement to be Bound (Attachment H)

      5.2.4. Additional Documents and Information Required in your SOQ:

      The Qualification Questionnaire itself requires other information and/or documents to be submitted as part of your SOQ.  Ensure all such documents are included in your SOQ.

    • Step 1

      Through the instant RFQ process, qualify DBE’s that meet the Uniform System of Rating Applicants’ criteria set forth in the Qualification Questionnaire (Attachment “A” to the RFQ).  No pricing proposals are submitted at this time. From the pool of Applicants, the District will select approximately three (3) to five (5) of the highest ranked and qualified teams to be de signated as “Finalists”.  The District, however, reserves the right to designate as “Finalists” as many Qualified Applicants that it determines to be in its own best interests, at any time.  The District may decide to conduct interviews during the RFQ process.  The RFQ process will end when the District issues a notice identifying the pre-qualified Finalists.  The ranking and point totals from the RFQ process do not carry over to the RFP portion of this procurement.

       

    • Program and Project Management

      The Measure K Bond Program, sometimes also referred to as the “Building Program” will be managed by a District designated construction management representative (“Construction Manager”/”CM”) who will oversee all construction activities and professional services in relation to the Projects on behalf of the District.   

      The CM is the District’s Authorized Representative for administering and enforcing the contract awarded, if any, by the District’s Board of Trustees pursuant to this RFQ. 

      The CM reports directly to the District’s Associate Vice President, Bond Programs. 

    • Purpose of the Request for Qualifications Process

      The purpose of this RFQ is for the District to obtain sufficient information to determine if a DBE can meet the qualification criteria established by the District for the Project and to rank Applicants for an invitation to participate in the RFP portion of this procurement.

      As part of the qualification evaluation and ranking, the District’s Qualification Questionnaire (Attachment A) will assess many factors to determine if an Applicant meets the necessary qualifications to satisfactorily perform the proposed work for the Project.  Such factors include, without limitation, the characteristics of: trustworthiness; quality; fitness; capacity; experience; and financial ability; of the DBE to satisfactorily perform the work for the Project, as generally described herein.

      Any DBE proposing to provide the design-build services described herein shall provide in its Statement of Qualifications evidence that the DBE, its personnel, and team members, have expertise and experience in design and related engineering services, construction project design review and evaluation, construction mobilization and supervision, bid evaluation, project scheduling, cost-benefit analysis, claims review and negotiation, construction, and general management and administration of all design and construction components for the type of Project that is the subject of this procurement.

    • Step 2

      A Notice for Request for Proposals (“RFP”) will then be issued to the Finalists.  However, generally speaking, Step 2 will proceed as follows:

      4.2.1 Based upon the RFP requirements, each Finalist will submit separate pricing on the following price components for the Project that is the subject of this RFP: (1) a Lump Sum amount for Collaboration Phase Services; (2) a Lump Sum amount for the Design through Agency Approvals Phase Services (3) a Percentage (stated to two (2) decimal places) of the cost of direct/hard construction costs during Construction Phase Services for: (i) Total General Conditions costs; and (ii) the DBE’s Fee (i.e., Overhead and Profit); (4) Payment and Performance Bond premium costs stated as a percentage (based upon the projected Construction Budget); and (5) a Lump Sum amount for costs of required insurance for the Project. The District may add additional requirements and/or revise pricing components at the RFP step of the procurement.

      4.2.2 Meetings, Interviews and/or Negotiations may take place; and

      4.2.3   Finalists may or may not be asked to submit a “Best and Final Offer” to the District.  The award of a contract will be made on a “Best Value” determination based on established criteria which will be set forth in the RFP.

      4.2.4   The District does not anticipate that a “formal” design-competition will be part of the RFP phase of the procurement.  However, the RFP will provide further information in this regard.

      4.2.5   The District will not provide any Applicant with reimbursement for any costs in connection with the RFQ stage of this procurement, and the Applicant is solely responsible for all costs and expenses, of any nature, associated with responding to the RFQ, including attending briefing(s) and providing supplemental information.  At the conclusion of the RFP stage of this procurement, the District intends to provide a competitive stipend consistent with market practice to each Finalist that submits a complete and responsive Proposal but is not selected to be awarded the Design-Build Agreement.  The amount and terms of the Stipend will be established in the RFP.

    • Reviewed/Audited Financial Statements

      In addition to all of the foregoing, the Qualification Questionnaire requires an Applicant to submit three (3) years of the most recent audited and/or reviewed financial statements including balance sheets and income statements.  These are also due before and/or at the same time as the SOQ deadline.

      The Audited/Reviewed Financial Statements (including balance sheets and income statements) are to be submitted electronically as part of and with the SOQ.

    • Ongoing Obligation to Update the District Regarding Information

      If at any time during this RFQ Process, or subsequently during the RFP Process, any information submitted by a DBE becomes inaccurate, incomplete, misleading, and/or untrue, the DBE must immediately notify the District representatives identified herein and immediately provide updated accurate information in writing, under penalty of perjury.

    • Project Description - Generally

      This project is addressing the network cabling, distributed antenna systems wiring and audio and video surveillance wiring for the legacy buildings at the District’s Stockton campus that includes those structures built as part of the original Stockton campus construction in the 1970’s, and accounts for all but the following five (5) buildings on the District’s Stockton campus: Horton Library; Science and Mathematics Building; District Data Center; De Ricco Student Services Building; and the Center for Microscopy & Allied Science. Due to the age of the original facilities, data and other audio visual and camera system cables were placed in surface conduits throughout the buildings.  It is the District’s intent to bury the cables in the walls and above ceilings, or limit wire mold to achieve both a visually appealing and robust infrastructure system.

      Project: Technology Cabling Project

      The Technology Cabling Project is to modernize the Stockton campus and integrate new cabling systems within existing infrastructure.

      Expected Outcomes: Upgraded technology cabling and low-voltage infrastructure systems for those aging facilities originally built around the 1970s. 

      Estimated Construction Cost:          $35,000,000

    • Applicant Request for Clarification Process and Deadline

      All Requests for Clarification regarding the RFQ and SOQ processes, requirements, criteria, and/or information, must be submitted in writing via OpenGov.

      The District will only communicate with one person per Applicant.  It is the responsibility of the Applicant to ensure that the District has the correct name and address of the contact person, phone number, and e-mail address. 

      All changes to this RFQ will be done only through written addendum issued via posting to OpenGov.  Prospective Applicants will be required to complete a vendor registration on OpenGov to access Addenda posted by District.

      No other changes are authorized.

      Questions received after the deadline will not be responded to.  All questions must be submitted as instructed above and no questions will be received after:

      June 22, 2026, 2:00PM

      No questions submitted through any other means will be answered.

      It is the responsibility of each applicant to check OpenGov for any and all addenda and to be fully familiar with all the contents thereof.

    • General Scope of Work and Services Required

      The selected DBE and its members will be integral members of the overall Project team, along with representatives from the District and AHJs, as required.

      The DBE will be required to work closely with the District, the Construction Manager (hereinafter referred to as “CM”) Owner’s other representatives, and other consultants (hereinafter also sometimes collectively referred to as the “District”), in order to develop design and construction documents that best serve the District’s needs. It is anticipated that multiple meetings will be required to achieve these goals.

      It will be the responsibility of the DBE to design and construct the Project, utilizing its skills and knowledge regarding sustainable design, lifecycle costs and considerations, long-term maintenance, construction and overall project delivery.

      A Scope of Work document, sometimes also referred to as the Programming and Project Criteria document, for the Project will be provided in the Request for Proposals (“RFP”) document to be issued to the Finalists subsequent to this RFQ. The anticipated services shall likely consist of, but shall not be limited to, the following tasks:

      2.6.1 Environmental

      1. California Environmental Quality Act (CEQA) compliance;
      2. Ensure compliance with the approved environmental document for the Project; and, without limitation
      3. Secure District approvals as requested.

      2.6.2 Planning & Entitlement

      1. Secure District, DSA, and all other governmental and AHJ approvals as required.

      2.6.3 Design & Construction

      The DBE shall be responsible for all “turnkey” design and construction services required for the completion of the Project including but not limited to:

      1. Design and Engineering (“A&E”) services including Cost Estimating, and the development of overall and final Programming and Project design documents will be the responsibility of the DBE;
      2. Design and construction of the Project in compliance with any and all applicable codes, rules/regulations, applicable laws, and District standards, as applicable; and, without limitation
      3. Start-up and validation of the performance and functionality of new and/or upgraded and/or modified systems.

      2.6.4 Permitting

      1. Identify and obtain all required permits, inspections, and approvals for the Project;
      2. The District will pay the costs of all required permits and approval fees to third party agencies having jurisdiction over the Project;
      3. Develop and prepare plans and specifications, Construction Documents (“CD’s”), and submit to the District for review and approval before submitting to AHJ’s and DSA, as required;
      4. Facilitate and manage the permitting process, secure any and all required permits and approvals, including but not limited to, AHJ, City, DSA, if required, California Department of Education (CDE), and all other AHJ permits required to construct the Project; and, without limitation 
      5. Coordinate, apply and secure all applicable rebates on behalf of District as available for the Project, if any.

      2.6.5 Post-Construction

      1. Train District employees in the use, operation, and maintenance of systems and equipment;
      2. Provide all operation manuals and documents;
      3. Warranty maintenance services and provide warranties from all subcontractors; and, without limitation
      4. Provide all required “as-built” and record documentation.
    • District Reservation of Rights, Etcetera

      District reserves the right to waive minor irregularities and omissions in the information contained in the SOQ submitted (which is treated as a qualification application), to make all final determinations, and to determine at any time that the qualification procedure for the Project should be abandoned.

      Each Applicant assumes all risks and/or consequences of an incorrect delivery or an untimely delivery of a SOQ.

      Each Applicant assumes any and all financial risk of loss in participating in this RFQ process and the District shall not, under any circumstance, be liable for any cost, expense, loss, or damage sustained by an Applicant participating in this RFQ process.

    • Bonding and Insurance Requirements

      5.7.1. Required Bonding

      5.7.1.1. Proposal Bond

      During the RFP portion of this procurement, Finalists will be required to submit a Proposal Bond for the Project, a form of which will be included in the RFP.  The cost of which is Proposer’s sole responsibility, and which will not be reimbursed by the District.

      5.7.1.2. Payment Bond

      Before the performance of any services during the Construction Phase, the DBE will be required to submit a Payment Bond for the Project, a form of which will be included in the RFP.

      5.7.1.3 Performance Bond

      Before the performance of any services during the Construction Phase, the DBE will be required to submit a Performance Bond for the Project, a form of which will be included in the RFP.

      5.7.2. Required Insurance

      Insurance requirements will be set forth in the RFP (General Conditions Article 11 Insurance and Bonds) when issued to the shortlisted Finalists.  However, please see Attachment J, Exhibit 9 for general insurance requirements.

      Certain insurance, such as, but without limitation, professional errors and omissions insurance must be submitted before the start of Design through Agency Approvals Phase Services for the Project.

    • Sample Design Build Contract Documents

      Included in this RFQ are sample Design-Build Contract Documents, compiled into a single consolidated document, containing all exhibits, identified as “Attachment J – All Exhibits.” Attachment J and All Exhibits include Design-Build Contract; Collaboration Phase Services; Design through Agency Approvals Phase Services; Construction Phase Services; and General Conditions.

      These sample documents are included for review by the Applicants and any comments or questions are encouraged.  The final Design-Build Contract Documents will be issued during Step 2, the RFP portion of this procurement process.  The District reserves the right to remove, add, edit or alter these sample Design-Build Contract Documents at its sole discretion.

    • Owner's Representative

      Once the DBE is selected through the RFP process, the selected DBE’s primary channel of communication to the District will be through the District’s Construction Manager(s).

      The District and/or the Construction Manager may also designate other representatives responsible for certain defined aspects of the Project and may replace or designate any or all representatives at the District’s sole discretion.  Nevertheless, the District’s Construction Manager is the primary channel of communication and point person “day to day” on behalf of the District for the Project.

      The District, the Construction Manager, the DBE, and other sub-consultants have and/or will have varying duties with respect to communication and decisions required in the delivery of the Project and for contracting purposes.  It is the DBE’s sole responsibility to determine, based on the contract documents, which representatives can bind the District to any decisions made.  Absent express authority in writing signed by the District’s Superintendent/President or Designee, only the District’s Superintendent/President or Designee can make a decision, if it is in writing, and bind the District.  Anyone else affiliated with the District, a Campus and/or facility, are not authorized to make a change to the contract documents and/or the Project unless expressly stated in the contract documents that they may do so.  Should the DBE rely on any of these other representatives or their conduct, the DBE does so solely at its own risk and expense.  Information from the DBE required or requested in aid of these decisions, and to the DBE with respect to all such decisions, shall be communicated either through or with the knowledge of the District’s Representative who is the CM.  In the event of any disagreement or dispute between members of the Project team regarding the Project, the District’s Superintendent/President or Designee will be the final decision-making authority for the Project.
