By entering into a contract with the Aviation Authority, the Contractor/Contractor becomes obligated to comply with the provisions of Section 2. Section 2. Section 448.095, Florida Statutes, "Employment Eligibility," as amended from time to time. This includes, but is not limited to, utilization of the E-Verify System to verify the work authorization status of all newly hired employees, and requiring all subcontractors to provide an affidavit attesting that the subcontractor does not employ, contract with, or subcontract with, an unauthorized alien.
The contractor shall maintain a copy of such affidavit for the duration of the contract. Failure to comply will lead to termination of resulting contract, or if a subcontractor knowingly violates the statute, the subcontract must be terminated immediately. Any challenge to termination under this provision must be filed in the Circuit Court of Orange County, Florida no later than 20 calendar days after the date of termination. If the resulting contract is terminated for a violation of the statute by the Contractor, the Contractor may not be awarded a public contract for a period of one year after the date of termination.

Each Respondent and its proposed Project Manager for Construction has prior experience as the prime contractor for a government entity, with preferred experience in Florida, on a minimum of two similar projects within the last ten years, each with a minimum construction value of not less than $5,000,000. Respondent shall provide references for such experience with the Response.
The Aviation Authority will verify the Minimum Experience by evaluating the information submitted in Form 3A and 3B.
References shall be able to validate the Respondent’s capabilities and experience.
Respondent and the proposed Project Manager for Construction must provide at least two references from Clients for similar projects completed, within five years from the date of the Response.
It is the Respondent’s responsibility to provide references and information that most closely demonstrates their experience with organizations (airports, counties, municipalities, or universities) of similar size, complexity, and risk exposure as the Aviation Authority.
The Respondent authorizes the Aviation Authority, its staff or consultants to contact any of the references provided in the response and specifically authorizes such references to release either orally or in writing, any appropriate data with respect to the Respondent and its Engagement Team members.

A: The intent is to proceed with the project. However, GOAA reserves the right to reject any and all Responses, and to re-advertise or elect not to proceed with the services for any reason.
Q (No subject): The preliminary scope of work in Section 6.6 of the Request for Statement of Qualifications includes Low Voltage CCTV at each Lot; however, the Rough Order of Magnitude (ROM) Costs that were provided with the documents do not include an allowance for this work. Will the Authority quantify the number of CCTV cameras for each lot and provide revised ROMs?
A: The DB team shall be responsible for designing the camera system to provide full coverage for each lot.
Q (RFSQ Evaluation and Selection Criteria): We request that the RFSQ be updated to utilize the shortlist phase as presented, then phase 2 and final selection will be a low bid design build process that is 100% price and schedule. This process allows GOAA the opportunity to ensure minimum qualifications to whatever standard they feel is sufficient while giving the design build firms an assurance, in the face of the vague and subjective phase 2 scoring scheme in the RFP, that the time invested in the proposal will not be wasted and will be fairly and objectively evaluated. We make this suggestion for a change to the selection process because it will increase competition while also allowing GOAA to screen for qualifications on the front end. We note in the history of this project (and in some other contexts) that there is perhaps a general concern about increasing competitiveness and the number of responses to advertisements at GOAA. On this particular project we suggest evaluating schedule and price only for the second phase because the solicitation includes add alternates and that traditionally indicates concern over budget, or maximizing scope. The current final selection process has only 20% weighting for price. The other 80% of scoring is highly subjective and potentially leaves substantial value on the table for GOAA to maximize project deliverables. We have competed in previous GOAA solicitations utilizing similar selection process where substantial value was sacrificed due to the subjective nature of the selection process. Without changes to the final selection criteria, there is little incentive for the design build firms to invest in a proposal, cost reduction and value engineering when it doesn’t impact the selection scoring in any meaningful way. We apologize for the length of the question and explanation, there was an attempt to bring this issue up at the pre-proposal meeting, but there was no interest in the subject matter from the GOAA staff. While it is true that pre-proposal meetings are not an appropriate forum to resolve these types of issues, they are a great place to openly discuss them, narrowing them down to something that can be addressed efficiently in writing, especially if an owner is interested in increasing competition.
A: GOAA will not be updating the solicitation process at this time. The evaluation scoring reflects the importance of each evaluation criterion for this contract.
