    Description

    The intent of this RFP is to contract with a General (Prime) Contractor who will manage the cleanout, transport, land application, sampling and analyzing biosolids/soil, documentation, and reporting of Class B biosolids (stabilized wastewater treatment sludge) from lagoon cells on an as needed basis. All responses and questions must be submitted electronically utilizing the electronic bidding system --- Q&A --- Q1: Will the County agree that in advance that if the County exercises its discretionary right to terminate the agreement at no fault of the Contractor, or for the convenience of the County, the County will pay Contractor for expenses incurred because of early termination. These expenses include, but are not limited to, recovery of capital costs, demobilization, employee severance payments and costs to terminate subcontractors and equipment leases? A1: The County/JCW will not negotiate specific terms with a potential contractor until that contractor has been selected; however, the contractor shall include with their RFP submittal any requested exceptions from the County’s terms for possible negotiation should the requesting contractor be selected. Definitive Payment Terms Language: Contractor shall submit to Customer an invoice setting forth the amounts due and any additional information with respect to the computation of said amount. Any invoice amount not paid in full within thirty (net30) days after the date of said invoice shall bear interest at the rate of one and one half percent (1.5%) per month on the unpaid balance thereof computed from the date of the invoice. If there are disputes regarding the contract, Customer agrees to promptly pay any undisputed amounts.
