Through this Request for Qualifications (RFQ) process, the Air District expects to enter into a master services contract with one firm to provide services upon request. The firm qualified under this RFQ and the execution of a contract with the Air District does not guarantee any particular amount of work. The anticipated duration of the contract will be for a period of up to five (5) years. The Air District, at its sole discretion, will determine the initial duration of the contract and any subsequent extensions.
The Air District is the government agency responsible for protecting air quality in the San Francisco Bay Area. The Air District is tasked with regulating stationary sources of air pollution in the nine counties that surround San Francisco Bay: Alameda, Contra Costa, Marin, Napa, San Francisco, San Mateo, Santa Clara, southwestern Solano, and southern Sonoma counties. It is governed by a 24-member Board of Directors composed of locally elected officials from each of the nine counties. The Air District’s mission is to improve air quality to protect public health, reduce historical and current environmental inequities, and mitigate climate change and its impacts.
The Air District aims to achieve its mission through many strategic goals, including: reducing and eliminating health problems caused by air pollution, achieving and maintaining air quality standards, leading the Bay Area’s efforts to fight global climate change, creating high-quality regulatory programs, and applying environmental best practices in all operations. To do so, the Air District regulates air pollution emissions from stationary emission sources such as factories, refineries, and power plants, and from smaller facilities like gas stations and dry cleaners. The Air District ensures that such facilities comply with air pollution laws and regulations, provides incentives to replace older, higher-emitting vehicles and equipment with cleaner alternatives, and gives grants and provides outreach to encourage healthy clean air choices by businesses and consumers. The Air District implements these efforts with an equity focus, aiming to reduce air quality disparities and promote environmental justice by targeting local air pollution in overburdened communities.

Q (Contract Administration): Section 10 of the Sample Master Service Contract sets out requirements for Task Order issuance and appears to indicate that the Air District will specify the services and the cost or estimated cost of services. Would the Air District clarify that when work is requested for a specific task(s), that the Air District will request a task order cost proposal from the qualified Contractor so that the parties may agree on the estimated level of effort and cost required to complete the task(s)?

Q (Task Orders): Will the Air District please confirm whether it intends to issue Task Orders on a Time and Materials (T&M) or Firm Fixed Price (FFP) basis?
A: Task Order(s) costs and its basis (T&M or FFP) will be developed and based on the submitted rates in collaboration with the selected firm. Firms should submit their hourly labor rates and anticipated sample range for reimbursable expenses.
Q (Contract Type): Would the Air District consider using its Professional Services Contract, which provides for detailed guidelines for invoicing, in lieu of the Master Services Contract for the award contemplated by the RFQ?
A: Detailed work and deliverables have not been fully determined. As a result, a Master Services Agreement is preferrable at this time.
Q (Portal Instructions): Section IV Submission Requirements; Section B. Submittal of Statement of Qualifications (pg. 7) instructs in item “5. Signature” that “All statements of qualifications must be signed by an authorized representative of the firm.” A review of the OpenGov Portal shows that there are separate file uploads for each subsection of the “Statement of Qualifications” (e.g., 2.1 Firm History – requires a separate file upload; 2.2 Experience and Qualifications – requires a separate file upload; 2.3 Assigned Personnel – requires bidders enter text, etc.). Would the Air District please confirm that in addition to uploading the individual subsections to the portal, that Bidders should submit one combined proposal with all sections (and with the firm’s authorized signature included) utilizing the portal’s section 3.1 “Additional Information” upload section?
