    A. INVITATIONThe City of Sunnyvale (City) is seeking proposals from consultant firms for a ComprehensiveDevelopment User Fee Study utilizing industry standards to ensure compliance with all applicablelaws and statutory requirements. including preparation of a legally defensible fee model consistentwith California constitutional and statutory requirements (including Proposition 26 and applicablecase law). The Comprehensive Development User Fee Study will calculate the full cost recoveryrequired for certain City development services and provide a recommended fee to be charged foreach applicable service.It is the City’s goal to have a well-documented and justifiable cost of service plan that identifies rates that will be used to recover billable costs for services and develop user fees that comply with applicable statutory requirements.The results of this Study will provide a tool for understanding current service levels, the cost anddemand for those services, and what fees for service can and should be chargedB. PROJECT DESCRIPTION AND BACKGROUNDThe City established the Development Enterprise Fund in Fiscal Year (FY) 14/15 to better aligndevelopment-related revenues and expenses. Prior to the creation of this fund, development relatedactivities and associated revenues were included in the General Fund across a range ofoperating activities, focused primarily within the Building and Planning Divisions of the CommunityDevelopment Department and including, but not limited to, the Department of Public Works (DPW),Environmental Services Department (ESD) and the Fire Prevention Division.Development-related revenues include major fees for permits, licenses, plan check services andengineering fees. These revenue sources tend to increase and decrease with development cycles.FY 24/25 total enterprise development-related revenues are approximately $28.4M.Due to the complex nature and interdependencies of departments needed to issue permits, anobjective evaluation is required.The selected firm (“Consultant”) will recommend cost recovery strategies and identify best practicesin establishing development user fees. These strategies should take into consideration thecomplexities and demands of each program within development activity. The selected firm willprovide thorough analysis, development of fee models, and recommendations for existing fees,proposed new fees, and revenue sources.Consultant services shall include, the following defined tasks and deliverables informationgathering, analysis, reporting and recommendations, as further detailed below.
