    Evaluation Criteria

    • EXAMINATION OF FACILITIES: PRE-BID CONFERENCE

      A pre-bid conference will not be scheduled. If your firm plans to send representatives to visit the site, please notify the Assistant Director of Public Works, Bill Caldwell, to make arrangements.

    • GOVERNING CODES
      1. All References to codes shall be the edition referenced by the Virginia Uniform Statewide Building Code, 2021 editions
      2. All work shall comply with VUS BC and ASME A17.1 (2019) . Electrical work shall conform to NFPA 70 (2023)  . Smoke and heat detector installation shall comply with NFPA- 72. In the performance of the work, all personnel shall comply with all VOSHA safety regulations as well as with all specific safety regulations required by the Town of Farmville. Installations must adhere to all requirements noted in this Appendix, in addition to complying with the governing codes in effect at the time of contract award.

    • EXAMINATION OF FACILITIES: PRE-BID CONFERENCE

      A Mandatory pre-bid conference will be held at 2:00 pm on Thursday, June 18, 2026 at Farmville Town Hall, 116 North Main Street, Farmville, VA 23901

    • PERFORMANCE
      1. The successful bidder shall provide all materials, labor, tools, equipment, and supervision necessary to complete the work described by this specification. The successful bidder shall submit a detailed project schedule prior to beginning work on the project, and the successful bidder shall diligently prosecute the work. BIDDER IS ADVISED, "TIME IS OF THE ESSENCE" FOR COMPLETION OF THE PROJECT.
    • MINORITY BIDDERS

      The Town of Farmville encourages all businesses, including minority and women-owned businesses to respond to all invitations to Bid and Requests for Proposals.

    • AVAILABILITY OF FUNDS

      It is understood and agreed between the parties that the Town of Farmville shall be bound hereunder only to the extent of the funds available, or which may hereafter become available for the purpose of this agreement.

    • CHOICE OF LAW AND VENUE

      Any disputes under a resulting contract, which cannot be resolved between the Town of Farmville and the Offeror, must be resolved in the Circuit Court of the County of Prince Edward, Virginia. Any resulting contract shall be governed by the laws of the Commonwealth of Virginia. The Offeror shall comply with all applicable federal, state, and local laws and regulations.

    • PROPRIETARY EQUIPMENT

      Under no conditions will any manufacturers or supplier's proprietary equipment, systems, or software be accepted for this project.

    • COORDINATION OF THE WORK

      Please see Attachment A entitled "Project Specifications and Manual" and Attachment B "Construction Drawings" for technical specifications for the project.

    • NON-DISCRIMINATION CLAUSE

      In accordance with Section 2.2-4311 of the Code of Virginia, every contract for goods or services over $10,000.00 shall include the following provisions:

      1. The Offeror will not discriminate against any employee or applicant for employment because of disability, race, religion, sex, or national origin except where religion, sex or national origin is a bona fide occupational qualification reasonably necessary to the normal operation of the Offeror. The Offeror agrees to post in conspicuous places, available to employees and applicants for employment, notices setting forth the provisions of this nondiscrimination clause.

      2. The Offeror, in all solicitations or advertisements for employees placed by or on behalf of the Offeror, will state that such Offeror is an equal opportunity employer.

      3. Notices, advertisements, and solicitations placed in accordance with federal law, rule or regulation shall be deemed sufficient for the purpose of meeting the requirements of this section.

      The Offeror shall include the provisions of the foregoing paragraphs A, B and C in every subcontract or purchase order over $10,000.00 so that the provision will be binding upon each subcontractor or vendor.

    • DRUG FREE WORKPLACE

      In accordance with Section 2.2-4312 of the Code of Virginia, during the performance of this contract, the Offeror agrees to:

        1. Provide a drug-free workplace for the Offeror’s employees.

        2. Post in conspicuous places, available to employees and applicants for employment, a statement notifying employees that the unlawful manufacture, sale, distribution, possession, or use of a controlled substance or marijuana is prohibited in the Offeror’s workplace and specifying the actions that will be taken against employees for violations of such prohibition.

        3. State in all solicitations or advertisements for employees placed by or on behalf of the Offeror that the Offeror maintains a drug-free workplace.

        4. Include the provisions of the foregoing clauses in every subcontract or purchase order over $10,000.00, so that the provisions will be binding upon each subcontractor or vendor.

      For the purpose of this section, “drug free workplace” means a site for the performance of work done in connection with a specific contract awarded to an Offeror.

    • SPECIAL CONDITIONS

      Prior to commencing the work, the successful bidder shall schedule a meeting with the Town of Farmville designated representatives. Any special conditions relating to the project execution, including limitations of work hours, designated storage spaces; site lay-down areas, requirements for wall penetrations (and any required permits) shall be reviewed.

    • FAITH BASED ORGANIZATIONS

      In accordance with Code of Virginia, Section 2.2-4343.1, the Town of Farmville does not discriminate against faith-based organization.

    • CLEANING

      During the execution of the work, the successful bidder shall clean the work site daily. Upon completion of the project, the successful bidder shall perform a thorough final cleaning of all work areas, including the car top, interior, sill, pit, machine room, etc. All construction debris shall be removed from the site. The project shall not be accepted until cleaning is completed.

    • PERMITS AND INSPECTIONS

      Vendors shall be responsible for acquiring all the proper permits/licenses required by local and state authorities in conjunction with this bid.  Bid prices shall include any other fees and no additional costs are to be assessed to the Town.

    • ACCEPTANCE, INSPECTIONS, AND TESTING
      1. During the course of the project, the Town of Farmville has the right to secure the services of an independent consultant who shall inspect the project. The independent consultant may, at the owners request, witness the final acceptance tests, and shall conduct a thorough final acceptance inspection. A minimum of 48 hours advance notice shall be required prior to all testing. 
      2. During the inspection, the consultant shall verify that all required work has been performed, including final cleaning. Dust covers, electrical box (or duct) covers, and the like shall be removed as required to verify that equipment has been satisfactorily installed and/or cleaned. The Town of Farmville shall not accept the completed project until all deficiencies noted during the final inspection have been satisfactorily corrected.
      3. Any equipment that receives technical bulletins, software updates, and manufacturer directed engineering etc. must be included and/or shared with the directed engineering modifications, etc. must be included and/or shared with The Town of Farmville as this information becomes available for the lifetime of the equipment.
    • TOOLS TO BE FURNISHED

    • INFORMALITIES, REJECTION AND DEVIATIONS OF BIDS

      The Town of Farmville shall provide the mechanism for the evaluation of all information received, the final determination of responsible offerors and reserves the right to waive informalities and irregularities and to accept or reject any or all bids. Any deviations or alternates must be submitted, in writing, with your bid. Deviations or alternates discovered after bid award or material receipt, not stated in your bid, shall be grounds for disqualification and nullification of order.

    • PROJECT CLOSE OUT

      A. The following are prerequisites to substantial completion. Provide the following:
      1. Punch list.
      2. Supporting documentation.
      3. Warranties, where applicable.
      4. Certifications, where applicable.
      5. Change over of locks, where applicable.


      B. Provide the following prerequisites to final acceptance:
      1. Final payment request with supporting affidavits.
      2. Completed punch list.


      C. Provide a marked-up set of drawings (record documents) including changes which occurred during construction.


      D. Provide the following closeout procedures:
      1. Submission of record documents.
      2. Submission of maintenance manuals, where applicable.
      3. Final cleaning and touch-up.
      4. Removal of temporary facilities or barriers.

    • LICENSING

      Bidders must have a currently active license classified as a building contractor with an unlimited license limitation issued by the Virginia Licensing Board for General Contractors.

    • WARRANTY AND GUARANTEE

      Contractor and Owner agree that if failure of the work occurs within one year of completion of construction, such failure is a result of defective work by the Contractor and the burden shall be on the Contractor to repair such defects

    • AWARD OF CONTRACT

      Owner reserves the right to reject any or all Bids, including without limitation the right to reject any or all non-conforming, non-responsive, unbalanced, or conditional Bids and to reject the Bid of any Bidder if Owner believes that it would not be in the best interest of the Project to make an award to that Bidder, whether because the Bid is not responsive or the Bidder is unqualified or of doubtful financial ability or fails to meet any other pertinent standard or criteria established by Owner.  Owner also reserves the right to waive all informalities not involving price, time or changes in the Work and to negotiate contract terms with the Successful Bidder.  Discrepancies between the indicated sum of figures and the correct sum thereof will be resolved in favor of the correct sum.  Discrepancies between words and figures will be resolved in favor of the words.

      In evaluating Bids, Owner will consider whether or not the Bids comply with the prescribed requirements, such alternates, and other data as may be requested in the Bid Form or prior to the Notice of Award.

      Contract will be awarded based on the base bid, to the lowest responsive and responsible Bidder whose evaluation by Owner indicates to Owner that the award will be in the best interests of that Project.

      In the event the lowest responsible bids are in excess of the funds available for the project or purchase, the Owner shall enter into negotiations with the lowest responsible bidder making reasonable changes in the plans and specifications as may be necessary to bring the contract price within the funds available, and may award a contract to such bidder upon recommendation of the Farmville Town Council, if such bidder will agree to perform the work at the negotiated price within the funds available therefor. If a contract cannot be let under the above conditions, the Town may re-advertise the bids after having made such changes in the plans and specifications as may be necessary to bring the cost of the project or product within the funds available therefor. This procedure may be repeated if necessary in order to secure an acceptable contract within the funds available therefor.

    • BONDS

      A Bid Security is required in the amount of 5% of the Bid. Bid Security must be in the form of an AIA A310 Bid Bond, certified check or cashier’s check made payable to the Owner. Bid Security will be forfeited if a bidder who has been awarded the contract fails to execute the Owner/Contractor Agreement within 10 days of notification by Owner. Bid Security for unsuccessful bidders will be returned no later than thirty (30) days after the contract is first awarded.

      Each Bidder shall submit evidence of bond ability for the entire value of the work in the form of a Performance and Payment Bond. The successful bidder must execute a Performance and
      Payment Bond as part of the construction contract with a surety company licensed to do business in Virginia. Bond Form shall be AIA Document A312 or equal. Performance and Payment
      Bonds must be submitted to Owner with the executed Agreement.

    • INSURANCE

      If awarded this bid, the Contractor shall purchase and maintain in force, at his own expense, such insurance as will protect him and the Town from claims which may arise out of or result from the Contractor’s execution of the work, whether such execution be by himself, his employees, agents, subcontractors or by anyone for whose acts any of them may be liable. The insurance coverage shall be such as to fully protect the Owner, the Engineer (if applicable) and the general public from any and all claims for injury and damage resulting by any actions on the part of the contractor or his/her forces as enumerated above. The Contractor shall furnish an original Certificate of Insurance, naming the Town of Farmville as an additional insured. Should any of the policies be canceled before the expiration date, the issuing company will mail 30 days written notice to the certificate holder.

       

      The Contractor shall furnish insurance in satisfactory limits and on forms and of companies that are acceptable to the Owner’s Attorney and/or Risk Management and shall require and show evidence of insurance coverage on behalf of any subcontractors (if applicable), before entering into any agreement to sublet any part of the work to be done under this contract. The contractor will provide a minimum of liability insurance as follows:

       

      • Workmen’s Compensation – Statutory Limits.
      • Contractor’s liability covering all operations performed by the contractor or any subcontractor with limits of not less than $1,000,000 combined single limit. Subcontractors are subject to the same limits and must submit certificates of insurance to this office. All certificates of insurance must name the Town of Farmville as additionally insured.
      • Automobile liability insurance-all owned, non-owned and hired automobiles with same limits as in bullet point above.

       

      Certification of above insurance requirements will be required before the issuance of an award. Also required to be submitted with the insurance certificate is the complete address, phone number and contact person for the insurance company.  The authorized agent signing on behalf of the insurance company must submit certification that they are a licensed agent to do business for the Company within the Commonwealth of Virginia.

       

      Certificate holder should be listed as the Town of Farmville, 116 North Main Street, Post Office Drawer 368, Farmville, Virginia 23901.

       

      If the Certificate of Insurance Form being furnished is other than the Town Form, the certificate of insurance must be modified by striking the words “endeavor to” in the second line and by striking the clause “but failure to mail such notice shall impose no obligation or liability of any kind upon the company, its agents or representatives”.
