A. The Work to be performed under Contract No. C211 – FEMA Sandy Power Supply and Plant Wide Project includes, furnishing all labor, materials, equipment and incidentals required to complete the Power Supply, Floodwall and Plantwide Improvements in their entirety as shown on the Contract Documents and as specified herein. C. This project consists of restoration and mitigation of power supply and plantwide systems throughout the Little Ferry Water Pollution Control Facilities. The power supply flood mitigation measures also include elevating, replacing and flood proofing major electrical components and constructing elevated platforms above the 500 year flood elevation at the Main Switchyard, Main Switchgear Building, six critical Substations (No. 1 through 6), replacing existing feeders, existing cables and existing duct banks, constructing a second story on and reinforcing the Main Switchgear building, constructing parallel duct bank, and performing other related activities like installation of fencing, gates, stairs, and concrete pads. D. The proposed plantwide scope of work includes the installation of flood walls and flood barriers, dry flood proofing wall apertures, sealing pipe penetrations, raising and replacing existing electrical equipment, and replacing mechanical equipment with submersible type equipment which are all better suited for future flooding conditions. This Contract or subcontract is expected to be funded in part with funds from the New Jersey Department of Environmental Protection and the New Jersey Infrastructure. Neither the State of New Jersey, the New Jersey Infrastructure Bank nor any of their departments, agencies or employees is, or will be, a party to this contract or subcontract or any lower tier contract or subcontract. This contract or subcontract is subject to the provisions of N.J.A.C. 7:22-3, 4, 5, 9 and 10. The Contractor (subcontractor) shall comply with the provisions of N.J.S.A. 10:5-2.1 et seq., N.J.S.A. 58:11B-26, N.J.A.C. 17:27 et seq., N.J.A.C. 7:22-9.1 et seq. and N.J.A.C. 7:22-3.17(a)24, 4.17(a)24 6.17(a)24 and 7:22A-2.4(a) for the participation of small business enterprises owned and controlled by socially and economically disadvantaged individuals (SED). The project sponsor has identified that the SED utilization goal for this project is thirteen (13) percent. Awards will be made only to socially and economically disadvantaged business concerns that are certified by the New Jersey Commerce, Economic Growth and Tourism Commission, the New Jersey Department of Transportation, the Port Authority of New York and New Jersey, New Jersey Transit or other agencies deemed appropriate by the Office as eligible minority businesses or female businesses. The invitation to bid is on an unrestricted basis whereby the successful bidder must fulfill the SED utilization requirements. In accordance with the provisions of N.J.S.A. 58:11B-26, N.J.A.C. 7:22-3.17(a)24 and 4:17(a)24, the contractor (subcontractor) shall comply with all the provisions of N.J.A.C. 7:22-9. In accordance with N.J.A.C. 7:22-3.17(g), all applicable surety bonds required in connection with the advertisement and award of building contracts or sub-agreements must be written by a surety company listed on the Federal Treasury List (Department Circular 570—Surety Companies Acceptable on Federal Bonds), incorporated herein by reference. Failure to attend the pre-bid meeting does not relieve the bidder of any obligations or requirements. Any individuals visiting the site must bring their own personal protection equipment (“PPE”) which must include, at a minimum, hardhats, safety vest, safety boots, and gloves.
