    Notice To Contractors Notice is hereby given that the City of Blackwell/Blackwell Municipal Authority, hereinafter called the “Owner,” will receive sealed bids for a federally assisted project at the office of the City Clerk, 211 W. Blackwell Ave., Blackwell, OK  74631, until 11:00 a.m., May 6, 2026, at which time they will be publicly opened and read aloud for:

    Bids submitted earlier than ninety-six (96) hours before the Bid Opening will be rejected and returned unopened. Upon receipt at the specified time, all bids will be carefully examined to ensure they are complete and accurate. All construction work and materials provided must adhere strictly to the Contract Documents prepared by Cimarron Valley Engineering, LLC.

    BID SECURITY AND BONDING

    Each bidder must submit their bid accompanied by a certified or cashier’s check from a solvent Oklahoma bank or a Bidder’s Bond in an amount equal to five percent (5%) of the bid amount.

    Construction, Maintenance, Statutory, and Payment Bonds, each in the amount of one hundred percent (100%) of the contract price, will be required. Bonds must be issued by a Corporate Surety licensed in the State of Oklahoma and acceptable to the Owner.

    The Owner will retain the bid security of the successful bidder until execution of the contract and receipt of the required bonds. Failure to execute the contract within the time specified may result in forfeiture of the bid security as liquidated damages.

    FEDERAL REQUIREMENTS (CDBG)

    This project is funded in part by the Community Development Block Grant (CDBG) program and is subject to all applicable federal requirements.

    Bids must include assurances that the following provisions will be complied with:

    1. Federal Labor Standards Provisions – U.S. Department of Labor, 29 CFR Part 5; including Davis-Bacon prevailing wage rates and applicable fringe benefits.
    2. HUD Section 3 (24 CFR Part 75) – To the greatest extent feasible, opportunities for training and employment shall be provided to low- and very low-income persons, and contracts shall be awarded to Section 3 business concerns when applicable.
    3. Section 109 of the Housing and Community Development Act of 1974 – No person shall be excluded from participation or subjected to discrimination on the basis of race, color, national origin, sex, religion, age, disability, or familial status.
    4. Non-Segregated Facilities – Certification that the bidder does not maintain or provide segregated facilities.
    5. Executive Order 11246 (Equal Employment Opportunity) – Contractors must comply with EEO requirements and take affirmative action.
    6. Minority Business Enterprise and Women Business Enterprise (MBE/WBE) – Bidders are encouraged to utilize minority-owned and women-owned businesses.
    7. Surety Requirements (Circular 570) – Surety companies executing bonds must appear on the U.S. Treasury Department Circular 570 and be authorized to transact business in Oklahoma.
    8. SAM.gov Registration – Bidders must be registered and active in SAM.gov with no exclusions.
    9. Build America, Buy America Act (BABA) – All iron, steel, manufactured products, and construction materials used in the project must be produced in the United States unless a waiver is granted. Contractor shall provide documentation of compliance.

    Failure to comply with these federal requirements may result in rejection of the bid as nonresponsive.

    BIDDING REQUIREMENTS

    Each bidder must submit a sworn written statement affirming that they have not engaged in any agreements, either direct or indirect, with other bidders regarding bid prices, bid limitations, or subcontracting arrangements.

    Bidders must be registered as plan holders through the designated bidding website:

    The designated website will be updated with addenda, plan holders, and other relevant information. The Owner and Engineer are not responsible for documents obtained from other sources.

    A mandatory pre-bid meeting will be held on April 21, 2026, at 2:00 p.m. at 211 W. Blackwell Ave., Blackwell, OK  74631.

    Bids must remain valid for a period of sixty (60) days following the bid opening date.

    AWARD OF CONTRACT

    The contract will be awarded to the lowest responsive and responsible bidder in accordance with the Oklahoma Public Competitive Bidding Act of 1974.

    The Owner reserves the right to:

    • Reject any or all bids
    • Waive irregularities or technicalities
    • Reject nonresponsive or conditional bids
    • Make the award in the best interest of the Owner

    Unbalanced or unreasonable bid pricing may be cause for rejection.
