      Please note that this project is contingent on funding approval from the School Facilities Board and If not approved, this project may not be awarded. However, if the School Facilities Board elects not to fund this project, the District reserves the option to fund any or all with alternative funding.

    • Pre-Offer Inquiries

      Any inquiry related to a Solicitation, including any requests for or inquiries regarding standards referenced in the Solicitation shall be directed solely to the Solicitation Contact Person. The Offeror shall not contact or direct inquiries concerning the Solicitation to any other employee unless the Solicitation specifically identifies a person other than the Solicitation Contact Person as a contact.
      Any inquiry that results in changes to the Solicitation shall be answered solely through a written Solicitation Addendum. An Offeror may not rely on verbal responses from the Solicitation Contact Person to inquiries.

    • Scope of Work

      The Mesa Unified School District #4 is seeking reputable and qualified vendor(s) to provide line item pricing to furnish two 2026 Big Tex dump trailers, model 10LX-12C2A-BK, 10K capacity, 7 x 12 configuration and two compatible spare tire and wheel assemblies, item/model 9400407 in new, unused condition for the district Grounds Department. Equipment shall meet manufacturer specifications and be suitable for normal school district operations, including hauling aggregate, debris, soil, landscaping materials, and related materials. This is an estimated amount only and no quantity is implied or guaranteed.

      Dump Trailers are shipped or delivered to the District Grounds Department located at 555 South Lewis Street, Mesa, Arizona 85210 or optional pick up by District Grounds Department if local. Product delivery is requested as soon as possible upon receipt of purchase order.

      The vendor shall provide:

      Two 2026 Big Tex dump trailers, model 10LX-12C2A-BK, 10K capacity, 7 x 12 configuration.
      Two compatible spare tire and wheel assemblies, item/model 9400407.
      All standard manufacturer components, safety equipment, lighting, electrical connections, and required documentation.
      Any applicable manufacturer warranties.
      Delivery to the purchaser’s designated location or available for pick up if local.

      Minimum Requirements
      Each trailer shall include, at minimum:

      Manufacturer: Big Tex or approved equivalent.
      Model: 10LX-12C2A-BK.
      Capacity: 10K. GVWR: 9,990 Capacity: 6,760 Empty Wgt.: 3,230
      Size: 7 ft. x 12 ft.
      Dump trailer configuration.
      Road-ready condition upon delivery.
      Working lights, brakes, coupler, safety chains, jack, hydraulic dump system, and all standard manufacturer features.
      Compliance with applicable federal, state, and local transportation and safety requirements.
      Spare tire and wheel assemblies shall be compatible with the trailers being provided.

      Delivery Requirements
      The vendor shall coordinate delivery or pick up with the purchaser prior to shipment. Delivery shall include unloading or placement at the designated delivery location, if applicable.

      All equipment shall be supplied or delivered fully assembled, operational, and ready for use.

      Inspection and Acceptance
      The purchaser reserves the right to inspect all equipment upon pick up or delivery. Final acceptance shall be based on confirmation that the delivered items:

      Match the requested models and quantities.
      Are new and free from defects or damage.
      Include all required components and documentation.
      Are operational and road-ready.
      Any damaged, defective, or nonconforming items shall be corrected or replaced by the vendor at no additional cost.

      Warranty
      The vendor shall provide all applicable manufacturer warranties and warranty documentation at the time of pick up or delivery. Warranty coverage shall begin no earlier than the date of acceptance by the purchaser.

      Quote Requirements
      Vendor quotes should include:

      Unit price for each trailer.
      Unit price for each spare tire and wheel assembly.
      Delivery/freight charges, if any.
      Estimated delivery timeline.
      Warranty information.

    • Offer Preparation

      An Electronic Offer shall be submitted on the forms provided in the Solicitation. No Facsimile or Physical Mail (USPS, FEDEX, UPS, etc.) offers will be accepted.
      Modifications shall not be permitted after Offers have been opened except as otherwise provided under applicable law.
      The Offeror acknowledges that submittal of a proposal is an acceptance of all Terms and Conditions of the Solicitation.
      District will not reimburse an Offeror for the cost of responding to a Solicitation.
      Prices stated in a Solicitation shall not include applicable state and local taxes. District is exempt from paying federal excise tax and state property taxes. District is not exempt from state and local transaction privilege (sales) taxes. The amount of any applicable transaction privilege or use tax of a political subdivision of the State is not a factor in determining the lowest Offeror.

    • Submission of Offer

      Each Offer shall be submitted electronically through OpenGov.
      Offer Amendment or Withdrawal. The Offeror may withdraw an Offer any time prior to the Offer Deadline. The Offer may not be amended or withdrawn after the Offer Deadline, except as otherwise provided under applicable law.

    • Additional Offer Information

      An Offer submitted after the Offer Deadline shall not be accepted.
      In the case of discrepancy between the unit price or rate and the extension of that unit price or rate, the unit price or rate shall govern.
      The Offeror shall hold its Offer open for sixty (60) days from the date the solicitation is due. An Offer may be rejected if the District is unable to issue an order within such timeframe.

    • Insurance

      The Contractor shall be responsible to the District for the acts and omissions of any and all persons whether directly or indirectly employed by them. They shall maintain such insurance as will protect them and the Mesa Unified School District from claims under Workers Compensation Acts, and from any other claims or damage for personal injury, including death, which may arise from operations under the contract.

      The offeror must provide Statutory Worker's Compensation Insurance or show evidence of comparable insurance by private carrier as well as public liability and property damage coverage with limits no less than $500,000-$1,000,000 bodily injury and $500,000 property damage (or $1,000,000 combined single limit). These documents must be furnished before work begins.

      While performing this project, the offeror guarantees to carry adequate insurance to protect the District in case of accident, fire and theft.

      Workers employed by the Contractor who use their own private vehicles as a service vehicle for their employer, must carry the same insurance requirements listed in this proposal. These documents must be furnished upon request.

    • Insurance Requirement
      1. Insurance: Contractor and subcontractors shall procure and maintain until all of their obligations have been discharged, including any warranty periods are satisfied, insurance against claims for injury to persons or damage to property which may arise from or in connection with the performance of the work by the Contractor, his agents, representatives, employees or subcontractors. The insurance requirements herein are minimum requirements and in no way limit the indemnity covenants contained in this quotation. Contractor shall provide coverage with limits of liability not less than those stated below.
        1. Commercial General Liability - Occurrence Form
          Policy shall include bodily injury, property damage and broad form contractual liability coverage.
          1. General Aggregate $2,000,000
          2. Products - Completed Operations Aggregate $1,000,000
          3. Personal and Advertising Injury $1,000,000
          4. Each Occurrence $1,000,000
          5. The policy shall be endorsed to include the following additional insured language: "Mesa Unified School District #4 is named as an additional insured with respect to liability arising out of the activities performed by, or on behalf of the Contractor".
        2. Automobile Liability Bodily Injury and Property Damage for any owned, hired, and non-owned vehicles used in the performance of this

            1. The Contractor's insurance coverage shall be primary insurance and noncontributory with respect to all other available sources.
            2. Coverage provided by the Contractor shall not be limited to the liability assumed under the indemnification provisions of this Contract.
    • Federal Requirements

      Federal Procurement of Food 7 CFR 210.21 & 7 CFR 220.16 (d) “Buy American”
      The Contractor shall purchase, to the maximum extent practicable, domestic agricultural commodities or products “SUBSTANTIALLY” (over 51%) processed in the United States. Exceptions to the Buy American provision should be used as a last resort, an Alternative or exception may be approved upon written request before item is delivered and documentation kept.
      Rights to Invention Made Under a Contract or Agreement (All Purchases)
      If the Federal award meets the definition of” funding agreement” under 37 CFR §401.2 (a) and the recipient or subrecipient wishes to enter into a contract with a small business firm or nonprofit organization regarding the substitution of parties, assignment or performance of experimental, developmental, or research work under that ”funding agreement,” the recipient or subrecipient must comply with the requirements of 37 CFR Part 401, “Rights to Inventions Made by Nonprofit Organizations and Small Business Firms Under Government Grants, Contracts and Cooperative Agreements,” and any implementing regulations issued by the awarding agency.
      Debarment, Suspension, Ineligibility and Voluntary Exclusion:
      By signing the Offer & Acceptance form, the Offeror shall certify that they have not been debarred, suspended, or otherwise excluded from or ineligible for participation in federal assistance programs under executive order 12549 and 12689. The Offeror shall comply with regulations implementing Office of Management and Budget Guidance in Non-procurement Debarment and Suspension codified at 2 CFR Part 180 and 2 CFR Part 417. These regulations restrict transactions with certain parties that are debarred, suspended or otherwise excluded from, or ineligible for, participation in Federal assistance programs or activities. (Only applies to contracts over $25,000)
      Equal Employment Opportunity (All Purchases)
      Except as otherwise provided under 41 CFR Part 60, all contracts that meet the definition of “federally assisted construction contract” in 41 CFR Part 60-1.3 must include the equal opportunity clause provided under 41 CFR 60-1.4(b), in accordance with Executive Order 11246, ”Equal Employment Opportunity” (30 FR 12319, 12935, 3

      Termination Clause:
      The district may terminate for cause and for convenience the contract. Appendix II to 2 CFR Part 200. (Only applies to contracts over $10,000)
      Procurement of recovered materials (Expenditures for item over $10,000)
      A non-Federal entity that is a state agency or agency of a political subdivision of a state and its contractors must comply with section 6002 of the Solid Waste Disposal Act, as amended by the Resource Conservation and Recovery Act. The requirements of Section 6002 include procuring only items designated in guidelines of the Environmental Protection Agency (EPA) at 40 CFR part 247 that contain the highest percentage of recovered materials practicable, consistent with maintaining a satisfactory level of competition, where the purchase price of the item exceeds $10,000 or the value of the quantity acquired during the preceding fiscal year exceeded $10,000; procuring solid waste management services in a manner that maximizes energy and resource recovery; and establishing an affirmative procurement program for procurement of recovered materials identified in the EPA guidelines.
      For Building Projects:
      A. Copeland “Anti-Kickback” Act - All contracts and sub grants in excess of $2000 for construction or repair awarded by recipients and sub recipients shall include a provision for compliance with the Copeland “Anti-Kickback” Act
      B. Davis-Bacon Act - The OFFEROR shall comply with the Davis-Bacon Act (40 U.S.C. 276a to 276a-7) as supplemented by Department of Labor regulations (29 CFR Part 5).

    • Multiple Award

      The District reserves the right to make a multiple award to more than one offeror, and may award a single contract or multiple contracts from the Solicitation.

      The award will be limited to the least number of offerors that the District determines is necessary to meet the needs of the District. A multiple Award shall be made only if the District Representative determines that a multiple Award is necessary and is advantageous to District to ensure the availability of services that fully conform to District’s requirements at the time, place and manner needed by District. If District determines that multiple contracts are necessary and advantageous, District will determine the least number of Contractors that are needed and award Contracts to the Offeror(s) who submitted the lowest responsible and responsive proposals.

      The decision to award a single contract, award multiple contracts, or make no award rests solely with District.

    • Insurance - SFB Requirement

       

      1. Insurance. Contractor shall procure and maintain until all of its obligations under the Contract have been fully discharged, comprehensive insurance against claims for injury to persons or damage to property which may arise from or in connection with the work performed and material delivered by Contractor or subcontractors. Contractor must have workers compensation insurance unless except by Arizona law. The insurance requirements are minimum requirements and in no way limit the indemnity covenants contained in the Solicitation.
      2. Insurance Coverage. Unless other coverage’s or amounts are specified in the Special Requirements of Solicitation, Contractor shall provide coverage’s with limits of liability not less than the following:
        1. Commercial General Liability – Liability arising out of activities performed by or on behalf of Contractor
          1. General Aggregate $5,000,000
          2. Products – Completed Operations Aggregate $1,000,000
          3. Personal and Advertising Injury $1,000,000
          4. Each Occurrence $2,000,000
          5. Umbrella Liability (Each Occurrence) $5,000,000
        2. The policy shall be endorsed to include the following specific language: "Mesa Unified School District #4 is named as additional insured with respect to liability arising out of the activities performed by, or on behalf of Contractor."
      3. Automobile Liability – Bodily injury and property damage for any owned, hired, and non-owned vehicles used in the performance of the Contract
