    Questions & Answers

    Q (MWDBE, VOSB and LGBTQIA+ Requirement): Hello, my firm is able to complete the entire scope of work without the need to sub-contract how can we confirm we still make a good faith effort per the requirements?

    A: Please make every effort to secure participation as part of your submission. If participation cannot be obtained, please reach out to certified companies and request written responses(emails) explaining why they are unable to participate in this project.


    Q (MWDBE, VOSB and LGBTQIA+ Requirement): We are a working on obtaining our certification as a MWDBE and can complete the entire scope of work without subcontracting. Will the City take into consideration if the prime is in the process of being certified as a MWDEB or is a MWDEB

    A: We encourage the Prime to identify work for sub-consultants.We would take the fact that you trying get certified if the paperwork has been submitted into consideration.


    Q (commitment letter): Does MWDBE commitment letter responses suffice for explanation if sub-contractors are unable to participate? Can we add language to the commitment letter that will provide reasoning for such?

    A: The commitment letter is required when there is participation on the project.


    Q (MWDBE, VOSB and LGBTQIA+ Requirement): Our firm is a veteran-owned small business currently seeking certification. We can complete the full scope of work without subcontractors. If our firm meets the VOSB qualification independently, are we still obligated to solicit subcontractors?

    A: We would like you to explore other categories for participation on the contract


    Q (MWDBE, VOSB and LGBTQIA+ Requirement): Will the requirements be satisfied if we subcontract with a single company that is certified MBE and LGBTQIA+, (offering 21% of the contract - 18% for MBE plus 3% for LGBTQIA+), along with WBE and veteran-owned businesses or must we subcontract with four separate partners to satisfy the requirement?

    A: You may only select one category for participation. Participation cannot be split between categories—please choose either the MBE or the LGBTQ+ percentage.


    Q ("Authorized signatory"): Hello - the last item in the RFP document indicates that who the "Authorized signatory" can be is defined in the terms & conditions. However, three people internally have reviewed the entire document and cannot find that information anywhere. Who is acceptable as an "authorized signatory"? Thank you.

    A: Its basically a company officer, who has the power to sign the contract.


    Q (Code of Ethics and Terms and Conditions ): Could you please provide the Code of Ethics, as the hyperlink does not appear to be working, along with the Terms and Conditions?

    A: The ethics handbook is out of date and does not contain current law, which is why the link does not work. The Terms and Conditions are laid out in the RFP such as General T&Cs.


    Q (MWDBE, VOSB and LGBTQIA+ Requirement): We are following up for clarity regarding the original question about firms that will not need to use subcontractors if selected for this engagement. Could you please provide detailed guidance on how you would like us to confirm that we can make a good faith effort when we are completing the entire scope of work ourselves and as such statements of assurance by subcontractors are not necessary?

    A: The participation are goals. Please reach out to subcontractors and get their reply via email on why they can/can't join you on the project.
