    Description

    The Commission, having received less than two responsive responses on FWC 25/26-72 states its intent to withdraw FWC 25/26-72 and its intent to proceed with the purchase of Fisheating Creek WMA Custom Swamp Buggy pursuant to section 287.057(6), Florida Statutes, in lieu of re-soliciting for competitive sealed bids. This is the final posting by the Commission on the Vendor Information Portal (VIP) regarding this ITB. 

    The Commission intends to proceed to negotiate on best terms and conditions for the State of Florida. This is not an award for Solicitation FWC 25/26-72. This is a notice of withdrawal and proceeding as an exceptional purchase after receipt of less than two (2) responsive responses, per section 287.057(6), Florida Statutes. This purchase is excepted by law from the requirements for competitive procurement.

    Failure to file a protest within the time prescribed in section 120.57(3), Florida Statutes, or failure to post the bond or other security required by law within the time allowed for filing a bond shall constitute a waiver of proceedings under chapter 120, Florida Statutes. 

    Any protests must be filed with the Purchasing Office, Fish and Wildlife Conservation Commission, 1875 Orange Avenue East, Tallahassee, Florida 32311-6160 and within the time prescribed in section 120.57(3), Florida Statutes, and Chapter 28-110, Florida Administrative Code.
