Dallas County is issuing this Request for Proposals (RFP) to establish contracts with qualified entities to provide Guardianship Services for incapacitated persons residing in Dallas County, Texas. The purpose of this procurement is to ensure the consistent and lawful delivery of guardianship services for individuals who have been determined by a court of competent jurisdiction to be incapacitated and in need of a guardian. Guardianship is a legal relationship created by court order in which a guardian is appointed to make personal and/or financial decisions on behalf of an incapacitated person. The Texas Estates Code defines an incapacitated person in Section 1002.017 as an individual who, due to a physical or mental condition, is substantially unable to provide for their basic needs or manage their financial affairs. Guardianship is a significant legal intervention because it may limit certain rights of the incapacitated person. For this reason, the Texas Estates Code requires that guardianships be used only when less restrictive alternatives are not feasible and when supports and services cannot adequately protect the individual. Guardians must act in the best interest of the incapacitated person and comply with all statutory requirements and court orders governing guardianship. Individuals requiring guardianship services are often vulnerable and may be at risk of neglect, exploitation, or harm. Accordingly, guardianship providers must demonstrate the knowledge, experience, and integrity necessary to protect the welfare, rights, and property of incapacitated persons. Through this RFP, Dallas County seeks qualified providers capable of serving as guardian of the person, guardian of the estate, or both, as appointed by the court. Services will be provided from the date of court appointment through termination of the guardianship.
