    Description

    SUNY Upstate Medical University intends to purchase hemodynamic medical products from a contract awarded by consortium (GPO) PP-NS-2179 pursuant to its authority under section 163 (3) (vi), which authorizes the purchases of commodities from a consortium or comparable entity in lieu of using a centralized contract and without a formal competitive process when justified by price. Vendors who sell equivalent or functionally equivalent to the medical products listed in the contract title (and attached in the product list) may, if interested, contact the listed representative to discuss the procurement. Equivalency must be demonstrated by meeting the clinical performance and KPI’s of the products. Interested parties must provide a complete cross reference to the attached products containing each item’s pricing, unit of measure, and UOM quantities. Interested parties must either provide proof they are the original manufacturer or certification as an authorized distributor or re-seller of all products from the original manufacturer. If proposing functional equivalent products, the vendor's cross must include clinical KPIs for each item's features, functionality, size, and utility. Failure to properly demonstrate the functional equivalency of each item will result in rejection of proposal. Vendor must be able to furnish products for evaluation, demonstration, and trial. This procurement is subject to NYS Finance Law §139 j&k, AKA the Lobbying Law. Therefore, vendors are cautioned that the only permissible contact for this procurement is the individual listed below. Contacting any other individuals at Upstate in connection with this advertisement may constitute a violation of New York State Finance Law. Failure to comply with this requirement can range from no contract award to debarment from sales to any NYS Agency. The successful contractor will be required to submit applicable documents relating to Vendor Responsibility, NYS Finance Law 139 j&k, and New York State’s Tax Law Section 5-a.
