      Summary

      The City of White House, TN is seeking proposals from qualified contractors to design, construct, and deliver a Live Burn Facility. This facility will be used for firefighter training purposes, including live fire training exercises.       A. It is the intent of these specifications to describe the minimum requirements in sufficient detail to secure bids for the aforementioned.
      B. The City recommends electronic submission of bids and proposals but will accept mail-in and drop-off responses. You can submit electronic responses via the City eProcurement Portal: https://procurement.opengov.com/portal/whitehousetn. By way of the eProcurement Portal, responses will be locked and digitally encrypted until the submission deadline passes.
      C. Mail-in or drop off responses will be accepted and must be placed in a sealed envelope. Please include Bidders Name, Project Name, License number, expiration date, license classification and limits on front of envelope.
      D. All Quotations must be signed with the firm’s name and by a responsible officer or employee. Obligations assumed by such signature must be fulfilled. Bid documents that are unsigned will be classed as irresponsible offers and will not receive any consideration.
      E. State brand or make on each item: if quoting on other than make, model or brand specified, the manufacturer’s name and catalog number must be given, or descriptive cut and complete technical data covering the item attached to the quotation.
      F. The CITY OF WHITE HOUSE reserves the right to reject any or all bids or accept any presented which meet or exceed these specifications, and/or which would be in the best interest of the City and will not necessarily be bound to accept the lowest bid.
      G. The bidder must be properly licensed in the State of Tennessee at the time of bid submission.
      H. The contractor’s monetary limit must be sufficient to cover the total bid amount.
      I. The Contractor shall maintain insurance coverage as required by Tennessee law.

      The City of White House in its sole discretion reserves the right to terminate this RFB process, elect not to award a contract, or modify the terms of this RFB at any time. In no event will the City or any of its officers, officials, or employees be liable for or otherwise obligated to reimburse Proposer for any costs incurred in preparation of a submittal. All submittals received become the property of the City of White House. The City reserves the rik clarification from any or all Bidders. By responding, the Bidder has read, understands, and agrees that they are able to competently perform the work in accordance with the scope.

    • Completion Time

      Each bidder is required to list in the BID SUBMISSION REQUIREMENTS or on the PRICE PROPOSAL section the number of calendar days they expect the project to be completed at the destination in terms of time interval following notice to proceed.  If time varies on different items, the bidder shall so state the delivery time for each item.

      Failure to include a specific number of calendar days may be sufficient grounds for rejection of proposals

    • Selection of Vendor(s)

      In comparing the bids and proposals and making awards, the City may consider such factors as quality and adaptability of services, the bidder’s record of experience and integrity and performance assurance in addition to that of the bid price.  The City reserves the right to cancel this order, or any part thereof without penalty.

    • Payments

      Vendor is to submit properly completed invoice(s) to the address specified on the purchase order or email to AP@whitehousetn.gov. To ensure prompt payment each invoice should cite the purchase order number and include the vendor’s name and return remittance address.

      The City of White House is exempt from Tennessee State Sales Tax. An exemption certificate will be furnished at the request of the successful vendor.

       

    • City of White House Retainage Policy

      Policy Statement

      The City of White House shall utilize retainage on construction contracts in accordance with Tennessee Code Annotated § 66-34-104 and the terms of the applicable contract.

      Applicability

      This policy applies to all contracts for the improvement of real property entered into by the City of White House.

      Contracts of $500,000 or Greater

      1. Retainage shall be withheld on all construction contracts with a total contract value of $500,000 or greater.
      2. The retainage amount shall be specified in the solicitation documents and contract.
      3. All retained funds shall be deposited into a separate interest-bearing escrow account with a third-party financial institution as required by Tennessee law.
      4. The Finance Department shall maintain records of all escrow accounts and retained funds.

      Retainage Amount

      The City of White House shall withhold retainage in the amount of five percent (5%) of each progress payment on construction contracts where retainage is required or utilized.

      Under no circumstances shall retainage exceed the maximum amount permitted by Tennessee law.

      Escrow Account Requirements

      When retainage is withheld:

      1. Funds shall be deposited into a separate interest-bearing escrow account within the timeframe required by law.
      2. The contractor shall  provide written notice identifying:
        • The financial institution holding the escrow account;
        • The account number or other identifying information as permitted by law; and
        • The amount of retainage deposited.

      Release of Retainage

      1. Upon satisfactory completion of the project and acceptance by the City, retainage and any accrued interest shall be released in accordance with Tennessee law and the contract requirements.
      2. Prior to release, the City may require:
        • Final inspection and acceptance;
        • Submission of all closeout documents;
        • Receipt of final lien waivers; and
        • Resolution of any outstanding claims or deficiencies.

      Concerning the Iran Divestment Act (TCA 12-12-101 et seq.), by submission of this bid/quote/proposal, each supplier and each person signing on behalf of any supplier certifies, and in the case of a joint bid/quote/proposal, each party thereto certifies as to its own organization, under penalty of perjury, that to the best of its knowledge and belief that each supplier is not on the list created pursuant to 12-12-106.

      Tenn. Code Ann. § 12-12-106 requires the chief procurement officer to publish, using credible information freely available to the public, a list of persons it determines engage in investment activities in Iran, as described in § 12-12-105.

      While inclusion on this list would make a person ineligible to contract with the state of Tennessee, if a person ceases its engagement in investment activities in Iran, it may be removed from the list.

      Neither the said supplier nor any of its officers, partners, owners, agents, representatives, employees or parties interest, including the affiant, has in any way colluded conspired, connived or agreed, directly or indirectly, with any other responder, supplier, or person to submit a collusive or sham proposal in connection with the contract or agreement for which the attached offer has been submitted or to refrain from making a proposal in connection with such contract or agreement, or collusion or communication or conference with any other suppler, or to secure through any collusion, conspiracy, connivance or unlawful agreement any advantage against the City of White House or any person interested in the proposed contract or agreement.

      The proposal of service outlined in the proposal is fair and proper and is not tainted by collusion, conspiracy, connivance, or unlawful agreement on the part of the firm or any of its agents, representatives, owners, employees or parties including this affiant.

    • Non-Boycott of Israel Affidavit (required)

      Concerning the Non-Boycott of Israel Act (TCA 12-4-1 et. Seq.), by submission of this bid/quote/proposal, each supplier and each person signing on behalf of any supplier certifies, and in the case of a joint bid/quote/proposal, each party thereto certifies as to its own organization, under penalty of perjury, that to the best of its knowledge and belief that each supplier is not boycotting Israel pursuant to 12-4-1 and will not during the term of any award.
