    Description

    The County of Volusia, Department of Community Services, Division of Community Assistance, is soliciting proposals for a Local Government Area of Opportunity (LGAO) loan to support the development of one affordable, multi-family rental housing construction or rehabilitation project. The project must be located in the County of Volusia, excluding the incorporated limits of the cities of Daytona Beach and Deltona. The County has $460,000 in State Housing Initiatives Partnership Program (SHIP) funds available for this loan, which will be adjusted if the developer has been awarded other local government contributions toward the required $460,000. The award shall be structured in the form of a 50-year deferred, forgivable loan with 0% interest. The loan award will be contingent upon the applicant’s project being approved for Housing Credits (HC) financing by FHFC through Request For Applications (RFA) 2026-201.

    The awarded project shall provide ten (10) SHIP-assisted units. The units must serve very low-income households at 50% or less of Area Median Income adjusted for family size at rents not to exceed the SHIP or Low-Income Housing Tax Credits rents published annually by the Florida Housing Finance Corporation (FHFC), whichever is more restrictive. The units will be restricted to occupancy by very low-income residents for a period of not less than fifty (50) years. Conditional awards will be void if no Volusia County projects are selected through RFA 2026-201. These funds will be reallocated to other affordable housing activities.

    The approval of the eligible development project and authorization to execute a FHFC Local Government Verification of Contribution - Loan Form committing funds shall be approved by the Volusia County Council. A written rental development agreement and related loan documents ("Contract") will be negotiated and approved for any project ultimately selected for funding through FHFC. Important Note:  Any funds expended by the applicant prior to executing the written rental developer agreement and related loan documents will NOT be eligible for reimbursement. 

    At the time of this solicitation, RFA 2026-201 has not been published by FHFC. The RFA is anticipated to be released in June or July, and due in July or August.

    Volusia County, in its sole discretion, may choose to award funds to one applicant, award no funds, or request additional information or documentation prior to making an award.

      Overall capacity of the respondent. Demonstrated ability to provide services with the same scope and magnitude as described within this RFP.

      Experience: The overall qualifications of the business to provide the services requested. Provide information on a minimum of three (3) similar projects (HC projects preferred) completed in the past three (3) years in which the firm has been involved, including specific information on the firm’s experience implementing projects involving SHIP or HOME funds.       1. That the proposal will be competitive in the FHFC’s RFA process, with preference given to proposals that can demonstrate the ability to meet RFA priorities and preferences.

        1. The application to FHFC for RFA 2026-201 will designate the proposal as a Priority 1 project. To meet this preference the proposal submitted to the county must indicate that it will be submitted to FHFC as a Priority 1 project, understanding that FHFC limits the number of Priority 1 applications an applicant can submit as indicated in their RFA and the published list of 2026/27 Priority 1 application limitations by principal name. 
        2. Continuous LGAO support since RFA 2024-201. Preference requires that a Priority 1 LGAO eligible application was submitted for both RFA 2024-201 and RFA 2025-201 and was not invited to credit underwriting for the same demographic commitment, location, and Principal. To meet this preference, proposal must include documentation that the proposed project is on the eligible list published by FHFC.
        3. Continuous LGAO support since RFA 2025-201. Preference requires that a Priority 1 LGAO eligible application was submitted for RFA 2025-201 and was not invited to credit underwriting for the same demographic commitment, location, and Principal. To meet this preference, proposal must include documentation that the proposed project is on the eligible list published by FHFC.
        4. Ability to receive the development category funding preference by indicating that the project will be new construction or will be rehabilitation that does not meet the definition of "Preservation" as defined in Rule Chapter 67-48.002.
        5. Qualification as Tier 1 permit ready status in the application to FHFC for RFA 2026-201.
        6. Ability to meet the Florida job creation funding preference in the application to FHFC for RFA 2026-201.

    • Bid Bond

      A Bid Bond in the amount of five percent (5%) of the total bid price, payable to the County of Volusia, is required for this Solicitation. The Submittal bond can be in the form of a bond, cashier’s check or irrevocable letter of credit (ILOC). The bond shall be issued by an agency authorized to do business in the State of Florida and with a rating of "A" or higher as listed in the A.M. Best & Company latest published rating guide. The County provided form shall be used if the bond is issued. The bond, cashier’s check or ILOC shall not expire until the Agreement is awarded and shall guarantee that

      • (1) a Proposer shall not withdraw its Response after the closing time and date of this Solicitation, or
      • (2) the awarded Proposer shall promptly execute an Agreement and deliver any required specifications required by the County prior to start-up of the Agreement.

      The bond, cashier’s check or ILOC will be invoked by the County to ensure payment of the Proposer of damages incurred by withdrawal of a Response, or failure to enter into an Agreement after award. Bid bonds, without interest, will be returned upon receipt of appropriate insurance documents and/or a Performance Bond, if applicable.

      Contractor shall furnish Payment and Performance Bonds, prior to performing any Work under the Agreement in an amount equal to the total value of the project including any amendments or Modification Orders made thereto pursuant to the Order or other documentation executed by the parties, in strict accordance with Fla. Stat. §255.05. Failing to do so, shall constitute a material breach of this Agreement. The Bonds shall be secured from or countersigned by an agency or Surety company recognized in good standing and authorized to do business in the State of Florida.

      Simultaneously with the delivery of the executed Agreement to the County, a Proposer to whom an Agreement has been awarded must deliver to the County, executed, separate Payment and Performance Bonds on the prescribed forms, each in an amount of one hundred percent (100%) of the Agreement price of the accepted Proposal as security for the faithful performance of this Agreement and for the payment of all persons performing labor or furnishing materials in connection therewith. The Payment and Performance Bonds shall have as the Surety thereon only such Surety company or companies as are authorized to write bonds of such character and amount under the laws of the State of Florida and with a resident agent in Florida. The Attorney-in-Fact or other officer who signs Payment and Performance Bonds for a Surety company must record with such bonds a certified copy of his Power-of Attorney authorizing him/her to do so.
