    Description

    Seminole County BCC (County) is soliciting the services of qualified Proposers to provide mechanical treatment services in the form of mechanical reduction and/or firebreak creation and maintenance for properties that are managed by the Parks and Recreation Department. The County reserves the right to make multiple awards in the best interest of the County.

    The Parks and Recreation Department intends to utilize the awarded Contractors to perform projects when needed to permit the Department’s limited staff to be more efficient with the use of their time, and to meet multiple annual objectives.

        • The contact person(s) listed as a reference must be an owner or an owner's representative with direct personal knowledge of your performance on the project.

      A. LETTER OF INTEREST

      Bids and Proposals are considered “public records” and shall be subject to the public disclosure regulations consistent with Chapter 119, Florida Statutes. If Bidder or Proposer considers any portion of its Bid or Proposal to contain material that is confidential or exempt from public inspection or disclosure under Chapter 119, Florida Statues, or other applicable state or federal law, then Bidder or Proposer must, simultaneously with its unredacted Bid or Proposal, provide the County with a complete separate copy of the Bid or Proposal which has redacted the portions the Bidder or Proposer asserts to be confidential and exempt from disclosure.  Only the portions of the Bid or Proposal the Bidder or Proposer claims are confidential or exempt from disclosure should be redacted and no Bid or Proposal may be redacted in its entirety.

      In submitting the redacted copy of the Bid or Proposal, at the same time as the unredacted Bid or Proposal, the Bidder or Proposer must upload it separately under Section 4.15 of this solicitation, “Confidential Files”.  The Bidder or Proposer shall also submit an index under Section 4.15 of the solicitation that specifically lists the confidential portions of the Bid or Proposal along with a thorough written description identifying each reason and statutory basis under which the Bidder or Proposer has claimed such exemption(s). 

      If the Bidder or Proposer fails to properly upload the redacted copy of the Bid or Proposal under Section 4.15 of this solicitation, “Confidential Files”, its claim of confidentiality will be considered waived upon submission of the Bid or Proposal.  If the Bidder or Proposer fails to properly identify the confidential portions of the Bid or Proposal or fails to include the statutory basis for which the claim of exemption is based, such claim of confidentiality will be waived upon submission of the Bid or Proposal.   

      If the County receives a public records request to which materials identified as confidential are responsive, the County will provide the redacted copy to the requestor.  If the public records requestor asserts a right to the redacted portions of the material, the County will notify the Bidder or Proposer that such an assertion has been made.  It is then the Bidder or Proposer’s responsibility to take the appropriate legal action to assert that the portion of the records in question are protected from disclosure under the public records law.   If the Bidder or Proposer fails to take appropriate and timely legal action to defend its claim of confidentiality, the County will release the materials that are responsive, without redaction, to the public records requestor.   

      If the County becomes subject to a demand for discovery or disclosure of materials the Bidder or Proposer claims are confidential, the County will notify the Bidder of Proposer of the demand, and thereafter it will be the responsibility of the Bidder or Proposer to take appropriate legal action to defend its claim of confidentiality.  If the Bidder or Proposer fails to take appropriate and timely legal action to defend its claim of confidentiality, the County will release the materials that are responsive, without redaction, to the public records requestor. 

      By submitting a response to this solicitation, the company agrees to defend the County in the event it is forced to litigate the public records status of the company’s documents.

    • Confidential Files

      In compliance with Chapter 119, Florida Statutes, any Bidder or Proposer that believes any portion of its Bid or Proposal is exempt from public records disclosure shall upload its redacted copy here.  In addition to the redacted copy, the Bidder or Proposer shall also upload an index that specifically lists the confidential portions of the Bid or Proposal, along with a thorough written description identifying each reason and statutory basis under which the Bidder or Proposer has claimed each exemption.

      The undersigned vendor in accordance with Section 287.087, Florida Statutes, hereby certifies that their Company (entity submitting this response) does:

      1. Publish a statement notifying employees that the unlawful manufacture, distribution, dispensing, possession, or use of a controlled substance is prohibited in the workplace and specifying the actions that will be taken against employees for violations of such prohibition.
      2. Inform employees about the dangers of drug abuse in the workplace, the business’s policy of maintaining a drug-free workplace, any available drug counseling, rehabilitation, and employee assistance programs, and the penalties that may be imposed upon employees for drug abuse violations.

      5. Impose a sanction on, or require the satisfactory participation in a drug abuse assistance or rehabilitation program if such is available in the employee’s community, by any employee who is so convicted.
      6. Make a good faith effort to continue to maintain a drug-free workplace through implementation of this section.

      2. The term “coercion” as used in subsection A above includes using or threatening to use physical force against any person; restraining or isolating any person without lawful authority and against their will; using or lending credit methods to establish a debt with labor or services as security, without applying the value of such labor or services towards the debt; destroying, concealing, or withholding identification or immigration documents; causing financial harm or threatening to do so; enticing or luring any person through fraud; and providing controlled substances for the purposes of exploitations.
