    Description

    VTA seeks proposals (each a "Proposal") from qualified firms (each a "Proposer") to provide services to act as Construction Manager/General Contractor (“CMGC”) for the project titled below and further described in the Scope of Services, attached as Appendix A (the "Project"):

    Chaboya Yard Zero‑Emission Bus (ZEB) Charging Infrastructure Project

    The purpose of the Proposal is to demonstrate the qualifications, competence and capacity of Proposer to perform preconstruction services and, if a Guaranteed Maximum Price (“GMP”) can be agreed upon, to provide CMGC services for construction of the Project, as further described in this RFP, in conformity with the requirements of this RFP.  The Proposal should demonstrate the qualifications of the Proposer and of the particular staff to be assigned to this Project.  It should also specify a specific approach that will meet the RFP requirements.

    VTA intends to select and award a contract to a qualified, California-licensed General Contractor that is able to provide appropriately licensed contracting and professional  services (“Construction Manager”) to collaborate with VTA’s retained design consultant (“Designer”) and provide Preconstruction Services, as defined below, during development of the Plans, Specifications, and Estimate (“PS&E”) for the Project. The project delivery method for this Project is CMGC in accordance with Public Utilities Code section 100150, et. seq. The successful Proposer will be expected to execute the Construction Manager/General Construction Manager Contract (“CMGC Contract” or “Contract”) attached to this RFP.  VTA intends to award the construction services for the Project to the Successful Proposer after the plans have been sufficiently developed and if a GMP has been successfully negotiated. 

    The Successful Proposer will execute the CMGC Contract  for Preconstruction Services, and complete the Preconstruction Services within 240 calendar days after the date VTA issues the Notice to Proceed with the Preconstruction Phase.  The scope of Preconstruction Services is contained in Appendix A: Scope of Services. If a GMP  is agreed upon, the CMGC contract may be amended to authorize construction services to be completed by the Guaranteed Completion Date(s), as defined in and as shall be established in accordance with the CMGC Contract.  The Successful Proposer awarded the Contract, if any, is referred to as the "Contractor” or “Construction Manager".

    CMGC is being used to manage cost and risk, accelerate delivery, and support features not feasible under traditional Design‑Bid‑Build. Specific Project goals and objectives include:

    • Meet the Project delivery schedule for Stage 1 Construction Services. As part of the PG&E’s EV Fleet Program that this Project is participating in, the medium‑voltage switchgear shall be installed no later than December 31, 2028; overall construction completion and system commissioning are targeted for Summer 2029.  
    • Deliver a high‑quality Project within the established construction budget (currently estimated between $15,000,000 - $20,000,000).
    • Maintain Chaboya Division operations and maintenance throughout construction, including 24/7-yard access.   
    • Foster an effective partnership among VTA, Construction Manager, the Designer, and all stakeholders.

    The Construction Manager will work together with representatives from VTA's Engineering & Program Delivery (“EPD”) Division, VTA Operations Division, and the Designer. This collaborative approach is designed to foster inclusion and generate an efficient progression of the pre-construction services to construction.

    The Construction Manager will provide VTA and the Designer with expertise and experience assisting in decision-making; conducting constructability reviews; presenting and assessing design and construction phasing and schedule recommendations and innovations to meet the Project schedule and budget requirements; supporting and participating in optional, formal value engineering (VE) workshops; providing innovative Project delivery approaches; analyzing innovation or VE proposals and providing potential design and construction-related modifications, if proposed; supporting scope, budget, and schedule control (generally, the “Preconstruction Services”).

    VTA seeks assistance in ensuring that the design allows for economical and efficient methods of construction incorporating the most current and cost-effective technology with minimal disruption to yard operations. VTA intends to select a Construction Manager who can best provide the Preconstruction Services needed to achieve these objectives, and who can best complete the Project in accordance with VTA’s requirements.

    The Project has completed the Basis of Design report and 35% Preliminary Engineering drawing set, with selected components currently advancing to 65% PS&E. The Construction Manager shall collaborate with the Designer during the Preconstruction Services to optimize the design documents to incorporate the Construction Manager's recommended construction means and methods, provide continuous value engineering, continuously assess Project risks and develop mitigation measures, and optimize the construction phasing and schedule. The Preconstruction Services are described in detail in Appendix A: Scope of Services.

    The Preconstruction Services to be provided to VTA by Construction Manager consist of the following:

    •             Task 1 – Project Management and Coordination

    •             Task 2 – Preconstruction Services Designer Collaboration

    Task 3 may be authorized by written amendment, at VTA’s sole discretion, following approval of the applicable design and specifications and acceptance of an agreed upon price for the task.

    •             Task 3 – Procurement of Long-Lead Items If any

    Construction Services required to complete the Project are identified in Task 4 and Task 5. 

    •             Task 4 – Delivery of Construction Phase Stage 1 Construction Services

    •             Task 5 – Delivery of Construction Phase Stage 2 Construction Services

    Early construction packages may be issued to maintain overall schedule, including procurement of long‑lead items (e.g., medium‑voltage switchgear, transformers, charging cabinets, overhead pantograph dispensers).   

    The initial contract award will be limited to Preconstruction Services (Tasks 1 and 2), based on a negotiated lump sum fixed fee.  Authorization of Stage 1 or Stage 2 Construction Services is contingent on negotiation of a GMP, approval by VTA’s Board of Directors, and an amendment to authorize such services under the CMGC Contract is executed by both parties.  Any decision to proceed with construction services will be in VTA’s sole discretion.  Stage 2 Construction Services (Task 5) is further subject to funding availability.

    This RFP neither commits VTA to enter into such Contract nor obligates VTA to pay for costs incurred in preparation or submission of Proposals or in anticipation of entry into a Contract.

    In the event that a GMP  is not negotiated, VTA may award a contract for construction services utilizing any other procurement method authorized by law.

    Evaluation Criteria

    • Qualifications (20 pts)

      The VTA will evaluate the Proposer’s demonstrated qualifications to perform the Scope of Services and its experience in successful delivery and performance of comparable work on comparable projects, including demonstrated capability and experience in:

              1. Technical experience in performing construction work of a closely similar nature to the Project.
                1. Demonstrate knowledge of applicable California and local regulatory requirements governing electrical construction, utility interconnection (PG&E Rule 2 and Rule 21 or equivalent), California Building, Electrical and Fire Codes, and environmental compliance as applicable to the Project scope.  Proposers must demonstrate this knowledge by submitting project profiles that highlight successful utility interconnections, alongside resumes and professional credentials of key personnel possessing relevant regulatory training with California codes. Experience working with local Authorities Having Jurisdiction (AHJs), such as the City of San Jose (CSJ) Building Department, is highly preferred.  
              2. Experience performing construction work on projects using collaborative delivery methods such as CMGC, CMAR, design-build, or progressive design-build with demonstrated involvement in pre-construction services, constructability reviews, open-book estimating, and schedule development.
                1. Demonstrate experience through the firm, its Key Personnel, or subcontractors. At least ten (10) years of such experience is preferred.
              3. Experience working with transit agencies, public utilities, or other public-sector clients on construction projects at active operational facilities, with particular emphasis on projects requiring maintenance of operations throughout construction.
                1. Demonstrate experience providing construction services for projects within or immediately adjacent to active transit, bus, or rail maintenance facilities, where construction activities were required to be planned and sequenced to maintain ongoing operations during the work. Experience should consist of at least two (2) projects completed in the last ten (10) years, one (1) of which may be currently in progress. The Proposer can demonstrate this experience through the entity as a whole, or its key personnel.
                2. Demonstrate experience providing construction services for public agency clients, including transit agencies, municipalities, or other government entities. Experience should consist of at least two (2) projects completed in the last ten (10) years, one (1) of which may be currently in progress.
              4. Demonstrated record of completing work on schedule and within budget on projects of comparable scope and complexity.
              5. Strength and stability of the firm, including years in business, bonding capacity, and financial health as evidenced by financial statements submitted with the Proposal.
              6. Technical experience and stability for specialized scope areas required for Preconstruction Services, including electrical, structural steel, and civil work, demonstrated by the firm, Key Personnel, or subcontractors.
              7. Assessments by client references, including responsiveness, quality of work product, collaborative approach, and ability to manage cost and schedule.

      The VTA will also evaluate the Proposer’s demonstrated qualifications and experience in direct performance, or the direct oversight of the performance, of the following:

              1. Providing construction services for projects involving the installation of medium- or high-voltage electrical distribution systems and associated equipment, including service connections, switchgear, transformers, and power metering equipment. Experience should consist of at least two (2) projects completed in the last ten (10) years, one (1) of which may be currently in progress.
              2. Providing construction services for battery electric bus (BEB) charging infrastructure, including the installation of charging dispensers (overhead pantograph, plug-in, or similar) and associated systems. Experience should consist of at least two (2) projects completed in the last ten (10) years, one (1) of which may be currently in progress.
              3. Providing construction services for projects involving steel canopy or gantry structures, structural steel erection, and structural foundations such as cast-in-drilled-hole (CIDH) piles or equivalent deep foundation systems. Experience must consist of at least one (1) project completed in the last ten (10) years.  
              4. Technical experience and stability for specialized scope areas, including electrical, structural steel, and civil work.

      For each of the categories above (viii through xi), the submitted experience should include a                                           narrative identifying three to five (3–5) critical technical or logistical challenges encountered during execution, along with the specific mitigation strategies, risk management approaches, lessons learned, or engineering solutions used to successfully resolve them.

    • Staffing and Project Organization (20 pts)

      The VTA will evaluate the qualifications, experience, and availability of the proposed project team, with particular emphasis on Key Personnel. The Proposer shall demonstrate the following qualifications and experience of Key Personnel:

              1. Project Manager:
                1. Number of years of experience in a Project or Contract Manager role for projects of similar complexity and scale (a minimum of ten (10) years is preferred); The Project Manager will serve as Construction Manager’s primary point of contact.
                2. Qualifications and relevant experience of the Project Manager, with emphasis on experience managing CMGC or similar collaborative delivery contracts for electrical infrastructure or transit facility projects of comparable scope, budget, and complexity.
              2. Construction Manager:
                1. Number of years of experience managing construction of electrical infrastructure and/or structural projects of comparable scope (a minimum of ten (10) years is preferred); responsible for ensuring the Construction Manager's preferred means and methods are incorporated into the final design and for directing Construction Services from pre-construction through closeout.
                2. Qualifications and relevant experience of the Construction Manager, with emphasis on field supervision of medium-voltage electrical installations, overhead charging systems, structural steel erection, and construction at active transit or operational facilities.
              3. Lead Scheduler:
                1. Number of years of experience in CPM scheduling for construction projects of comparable scope (a minimum of ten (10) years is preferred); responsible for developing and maintaining the project schedule, preparing schedule submittals, and managing schedule performance throughout Preconstruction and Construction Services.
                2. Qualifications and relevant experience of the Lead Scheduler, including demonstrated proficiency in CPM scheduling, phasing plan development, and schedule management on projects with operational constraints. 
              4. Lead Cost Estimator:
                1. Number of years of experience in construction cost estimating for electrical and civil infrastructure projects (a minimum of ten (10) years is preferred); responsible for preparing progressive cost estimates at each design milestone, leading open-book adjudication sessions with owner and the Independent Cost Estimator (ICE), and managing the estimating team.
                2. Qualifications and relevant experience of the Lead Cost Estimator, including demonstrated experience with open-book estimating processes, detailed quantity take-offs, and progressive cost estimating at design milestones for comparable electrical and civil infrastructure projects. 
              5. Safety Manager:
                1. Number of years of experience developing and implementing safety programs for electrical construction projects (a minimum of ten (10) years is preferred), including medium-voltage systems; shall be on-site at the onset of Construction Services; shall not fulfill multiple roles on the Project.
                2. Qualifications and relevant experience of the Safety Manager, with emphasis on high-voltage electrical construction safety programs and construction quality plans for projects at active facilities.
              6. Quality Manager:
                1. Number of years of experience in electrical construction (a minimum of five (5) years is preferred) and number of years of experience in QA/QC activities (a minimum of ten (10) years is preferred), including preparation and implementation of Quality Plans and procedures for construction projects; shall not fulfill multiple roles on the Project.
                2. Qualifications and relevant experience of the Quality Manager, with emphasis on high-voltage electrical construction safety programs and construction quality plans for projects at active facilities.

      The VTA will also evaluate the following:

              1. Depth and adequacy of the proposed supporting staff and subcontractor team to successfully deliver the full Scope of Services, excluding services to be performed during the construction phase(s) by trade subcontractors.
              2. Logic and clarity of the proposed project organization, including reporting structure, chain of command, and proposed interfaces with VTA and the Designer.
              3. Percentage of time Key Personnel will be dedicated to the Project and sufficiency of staffing commitment relative to project schedule and workload demands.
              4. Concurrence with restrictions on changes in Key Personnel, and the Proposer's plan for ensuring continuity of key staff throughout the duration of the Contract.

      The resume or profile for each of the Key Personnel proposed must include a personal "Lessons Learned" narrative derived from a past project of comparable scope or complexity. This narrative must detail a major technical, logistical, or baseline constraint the individual personally managed, the specific decision-making process or mitigation strategy they deployed, and the long-term project outcome or takeaway.

       

      Note: The Successful Proposer shall notify VTA in writing of any proposed changes to approved Key Personnel. This notification shall include a detailed resume summarizing the qualifications set forth above. No Key Personnel shall be replaced without prior written approval by VTA. Proposed changes will only be approved if the replacement Key Personnel are equally or more qualified than the original Key Personnel.

    • Work Plan and Approach/Project Understanding (20 pts)

      The VTA will evaluate the Proposer's demonstrated understanding of the Project requirements, potential challenges, and proposed approach to successfully delivering the Scope of Services. Factors to be considered include, but are not limited to:

              1. Demonstrated understanding of the specific technical and logistical challenges associated with the Chaboya Yard ZEB Charging Infrastructure Project, including the complexity of installing overhead inverted pantograph charging dispensers, charging cabinets, medium-voltage electrical distribution, gantry structures, CIDH pile foundations, and site civil modifications within an active bus maintenance and operations facility.
              2. Clarity and feasibility of the proposed approach to Preconstruction Services, including the Construction Manager's plan for conducting constructability reviews of the Basis of Design report, 35% preliminary construction drawings, collaborating with VTA and the Designer through the development of the 65%, 95%, and 100% PS&E milestones.
              3. Comprehensiveness and practicality of the proposed construction phasing and sequencing plan, with particular emphasis on how the Construction Manager will maintain 24/7 access to all Chaboya Division facilities and minimize disruption to VTA bus operations and maintenance activities throughout construction, including management of trenching across drive aisles.
              4. Identification of top construction, design, and stakeholder risks specific to this Project (e.g., long-lead equipment procurement, PG&E utility coordination and interconnection, phased yard access, systems integration with VTA's existing CAD/AVL, enterprise asset management (EAM), and telematics platforms), and the clarity and feasibility of the proposed approach to risk mitigation.
              5. Demonstrated understanding of the systems integration requirements of the Project, including interoperability of the charging management system (CMS), communications infrastructure with VTA's existing bus dispatch, telematics, and Enterprise Asset Management (EAM) systems.
              6. Quality and innovation of the proposed approach to value engineering and constructability, including any specific ideas to reduce cost, accelerate schedule, or improve quality that are consistent with the Project's goals.
              7. Demonstrated understanding of and commitment to sustainability, including proposed practices to reduce construction waste, minimize carbon emissions during construction, and support the long-term sustainability goals of the ZEB program.
              8. Clarity and completeness of the proposed Quality Assurance/Quality Control program, including inspection and testing protocols, document control procedures, and interfaces with VTA's QA oversight functions.

      Comprehensiveness of the proposed Safety Management Plan, including specific safety measures for high-voltage electrical work, overhead structural steel erection, and construction within an active transit yard with concurrent bus operations.

    • Level of Effort and Proposed Schedule (20 pts)

      The VTA will evaluate the Proposer's proposed level of effort and pre-construction services and construction schedule. Evaluation will be based on the following factors:

              1. Clarity and comprehensiveness of the proposed baseline summary schedule, as reflected in the identification and logical sequencing of major activities, milestones, and deliverables through the Preconstruction Services phase and into Stage 1 of the  Construction Phase.
              2. Reasonableness and adequacy of the proposed staffing level and hours allocated to major tasks during Preconstruction Services, including constructability reviews, cost estimating at each design milestone, risk register development and maintenance, scheduling, and coordination with the Designer and VTA.
              3. Demonstrated understanding of the overall Project delivery schedule and the Construction Manager's proposed approach to meeting VTA's target construction completion date, including identification of critical path activities, long-lead procurement items (e.g., pantograph dispensers, charging cabinets, medium-voltage switchgear), trade subcontractor procurements and potential schedule risks.

      Evidence of the Proposer's cost management and scheduling capabilities, including identification of potential design or construction issues with schedule or cost impacts, proposed contingency strategies, and the Proposer's track record for on-time and on-budget delivery on similar projects.

    • Cost Proposal (20 pts)

      Cost Proposals will be evaluated based on competitiveness and reasonableness of the proposed lump sum fixed fee for the Preconstruction Services, fixed percentage fees for mark-up for the Construction Services, and General Conditions Price, relative to the Scope of Services and the value delivered to VTA.
