This contract is being issued pursuant to a fair and open process in accordance with N.J.S.A 19:44A-20.5 et seq.
A. The successful bidder shall provide front-load type containers in the quantities provided below and in sizes so as to provide sufficient capacity for the schedule for use during the term of this contract. When determined to be necessary by the Township, the contractor must equip the containers with a gravity locking mechanism and bear-proof lids. Containers shall be provided and maintained by the Contractor.
B. In such cases where the Township has specified front-load container service, only front-load container service shall be used for the collection of solid waste. At no time shall locations specified by the Township for front-load container service be collected by rear-load type trucks with other residential solid waste.
C. Front-load container service shall be provided once per week at the locations listed below. All containers are of the front-load type with a maximum capacity of 8 eight cubic yards. The recycling material will be taken to the township's designated recycling facility, and the township will pay the recycling facility directly for all recycling material. All containers/dumpsters shall be clearly marked with the size of the container.

D. The contractor shall provide a lump sum bid per month for container service. Lump sum bid shall include all disposal costs for Municipal Solid Waste (MSW). The recycling disposal cost will be paid by Winslow Township.
The Township reserves the right to increase or decrease the number and location of sites, the number of containers at each site, and the frequency of collection to meet its needs.
E. Roll-Off container service shall be provided on an as-needed basis.

The contractor shall provide a per pull price for Roll Containers. The Township will cover the disposal costs for MSW in the roll-off containers. All weight slips are to be submitted with the monthly bill.
The Township reserves the right to increase or decrease the number of roll-off containers at each site, the number of locations, and the frequency of collection to meet its needs.
F. Contractor shall provide a cost per collection per month for each of 2, 4, 6 and 8 yard container service. In the event that the township needs to add or remvoe a container the per collection cost will be used to adjust the monthly lump sum bid. The amount bid shall include supplying the container.
Example #1: The contractor bids $20 per collection per month for a 4-yard container. The Township requests an additional pickup location and requests that a 4-yard container be picked up one time per week. The contractor shall bill the Township an additional $20.00 per month above the lump sum bid for container service.
Example #2: As above, the contractor bids $20 per collection per month for a 4-yard container. The Township requests an additional pickup location and requests a 4-yard container be picked up 2 times per week. In this example, the contractor would bill the Township an additional $40.00 per month above the lump sum bid for container service.
Example #3: As above, the contractor bids $20 per collection per month for a 4-yard container. The Township informs the contractor that a 4-yard container for pickup 2 times per week is no longer needed. In this example, the contractor would bill the Township the lump sum bid for container service, less $40.00.
G. All solid waste under this section shall be disposed of at the facilities designated by the Township and the Camden County Solid Waste Management Plan.
The amount bid (lump sum) shall include disposal costs for all solid waste container services. Toters shall be sent to the Winslow Township designated recycling facility and shall be included in the flat rate for commingled recycling collection. Winslow Township will pay the disposal fee to the designated recycling facility for all recycling disposed of at that facility.
The Contractor shall be responsible for disposing of single-stream recyclables at Omni Recycling LLC in Pitman, NJ. If the selected facility closes or is no longer an option for the Township, a new facility will be negotiated and mutually agreed upon by both parties. The Contractor shall submit, with each monthly invoice or voucher to the Township, weight slips for all single-stream recyclable material to facilitate tonnage grant reimbursement from the New Jersey Department of Environmental Protection. All solid waste, except recyclables, will be transported to the Camden County Resource Recovery Facility or Camden County Pollution Control in Pennsauken.
All vehicles shall be registered with, and conform to the requirements of the New Jersey Department of Environmental Protection, in accordance with N.J.A.C. 7:26-3.1 et seq.
The name, address and service phone number of the Contractor shall be placed clearly and distinctly on both sides of all vehicles used in connection with the collection services.

During the performance of this contract, the contractor agrees as follows:

Pursuant to N.J.S.A. 10:2-1, if awarded a contract, the contractor agrees that:
a. The contractor and the owner do hereby agree that the provisions of Title 11 of the Americans with
Disabilities Act of 1990 (the "Act") (42 U.S.C. S121 01 et seq.), which prohibits discrimination on the basis of disability by public entities in all services, programs, and activities provided or made available by public entities, and the rules and regulations promulgated pursuant there unto, are made a part of this contract. In providing any aid, benefit, or service on behalf of the owner pursuant to this contract, the contractor agrees that the performance shall be in strict compliance with the Act. In the event that the contractor, its agents, servants, employees, or subcontractors violate or are alleged to have violated the Act during the performance of this contract, the contractor shall defend the owner in any action or administrative proceeding commenced pursuant to this Act. The contractor shall indemnify, protect, and save harmless the owner, its agents, servants, and employees from and against any and all suits, claims, losses, demands, or damages, of whatever kind or nature arising out of or claimed to arise out of the alleged violation. The contractor shall, at its own expense, appear, defend, and pay any and all charges for legal services and any and all costs and other expenses arising from such action or administrative proceeding or incurred in connection therewith. In any and all complaints brought pursuant to the owner’s grievance procedure, the contractor agrees to abide by any decision of the owner which is rendered pursuant to said grievance procedure. If any action or administrative proceeding results in an award of damages against the owner, or if the owner incurs any expense to cure a violation of the ADA which has been brought pursuant to its grievance procedure, the contractor shall satisfy and discharge the same at its own expense.
The owner shall, as soon as practicable after a claim has been made against it, give written notice thereof to the contractor along with full and complete particulars of the claim, if any action or administrative proceeding is brought against the owner or any of its agents, servants, and employees, the owner shall expeditiously forward or have forwarded to the contractor every demand, complaint, notice, summons, pleading, or other process received by the owner or its representatives.
It is expressly agreed and understood that any approval by the owner of the services provided by the contractor pursuant to this contract will not relieve the contractor of the obligation to comply with the Act and to defend, indemnify, protect, and save harmless the owner pursuant to this paragraph.
It is further agreed and understood that the owner assumes no obligation to indemnify or save harmless the contractor, its agents, servants, employees and subcontractors for any claim which may arise out of their performance of this Agreement. Furthermore, the contractor expressly understands and agrees that the provisions of this indemnification clause shall in no way limit the contractor’s obligations assumed in this Agreement, nor shall they be construed to relieve the contractor from any liability, nor preclude the owner from taking any other actions available to it under any other provisions of the Agreement or otherwise at law.
