    The Borough of Bergenfield is a municipal government entity located in Bergen County, New Jersey, with a population of approximately 28,000 residents within a land area of 2.9 square miles.     • WASHER AND DRYING CABINETS TECHNICAL SPECIFICAIONS

      The Bergenfield Fire Department has identified the need to acquire washer and dryer cabinets for cleaning and drying firefighter turnout gear. The equipment will ensure compliance with NFPA 1851 standards, maintain the protective integrity of personal protective equipment (PPE), enhance firefighter safety, and extend the service life of turnout gear. These specifications describe the requirements for the supply, delivery, and setup of two (2) washers and two (2) drying cabinets for the Borough of Bergenfield Fire Department (FD).  

      The quantities identified in this solicitation are estimates only and are provided for bid evaluation purposes. Bidders shall provide separate unit prices for turnout gear washers and drying cabinets. The Borough reserves the right to increase or decrease the quantities awarded based on operational requirements. Any adjustment shall be based on the unit prices submitted by the successful bidder, and shall not alter the specifications, quality, performance requirements, or the nature of the equipment being procured, and shall be made in accordance with the New Jersey Public Contracts Law, N.J.S.A 40A:11-1 et seq. Unit prices shall remain firm for the duration of the contract. 

      General Requirements Include:

      • The washers and drying cabinets shall be NFPA 1851 Compliant for the cleaning and maintenance of firefighter turnout gear.
      • Delivery and set-up shall be provided within thirty (90) days of contract execution. 
      • Washer and Dryer Cabinets shall meet all minimum specifications provided below.
    • EVALUATION

      The Borough of Bergenfield will evaluate the bid proposals received in response to the notice to bidders. The bid proposals must include responses for items requested in this solicitation.

      Failure of the bidder to provide any information requested under the bid specifications may result in disqualification of the bid.

      The Borough will make the decision to select a Contractor for the purpose of an award by the Borough of Bergenfield. The selected Bidder will be notified via email.

      The Borough of Bergenfield may cancel this bid or reject proposals at any time prior to an award.

      The Borough of Bergenfield reserves the right to reject any or all bids or any part thereof as deemed to be in the best interest of the Borough.

      Any agreement that may result from this proposal shall not be binding on either party until it has been approved by the Borough of Bergenfield.

    • AWARD

      The bid shall be awarded to the lowest responsible and responsive bidder meeting all the specifications listed within.

    • SUBMISSION OF BIDS
      1. Sealed bids shall be received electronically by the Borough of Bergenfield, Bergen County, New Jersey (hereinafter referred to as “OWNER”) via the Borough’s electronic bidding system: https://secure.procurenow.com/portal/bergenfield, in accordance with public advertisement as required by law, using the submittal instructions provided herein.
      2. Sealed bids received in accordance with the submittal instructions before the deadline will be publicly opened and read aloud.
      3. It is the bidder’s responsibility to see that bids are submitted to the OWNER before the time and date fixed using the Borough’s electronic bidding system. Bids that are hand delivered in hard copy format, or received via email, facsimile, or Federal Express or Express Mail Service will be disqualified. No bids will be accepted after the date and time specified above.
      4. Sealed bids submitted to the OWNER before the time of opening of bids may be withdrawn in the Borough’s electronic bidding system by the bidder. Once bids have been opened, they shall remain firm for a period of sixty (60) calendar days.
      5. All prices and amounts must be submitted electronically. Bids containing any conditions, omissions, unexplained erasures or alterations, items not called for in the bid pricing proposal, attachment of additive information not required by the specifications, or irregularities of any kind, may be rejected by the OWNER.
      6. Bidder should be aware of the following statutes that represent “Truth in Contracting” laws:
        • N.J.S.A. 2C:21-34, et seq. governs false claims and representations by bidders. It is a serious crime for the bidder to knowingly submit a false claim and/or knowingly make material misrepresentation.

    • BID SECURITY AND BONDING REQUIREMENTS

      The following provisions shall be applicable to this bid and be made a part of the bidding documents:

      1. BID GUARANTEE
        1. Bidder shall submit with the bid a certified check, cashier’s check or bid bond in the amount of ten percent (10%) of the total price bid, but not in excess of $20,000, payable unconditionally to the OWNER. When submitting a Bid Bond, it shall contain Power of Attorney for full amount of Bid Bond from a surety company authorized to do business in the State of New Jersey and acceptable to the OWNER. The check or bond of the unsuccessful bidder(s) shall be returned pursuant to N.J.S.A. 40A:11-24a. The check or bond of the bidder to whom the contract is awarded shall be retained until a contract is executed and the required performance bond or other security is submitted. The check or bond of the successful bidder shall be forfeited if the bidder fails to enter into a contract pursuant to N.J.S.A. 40A:11-21.
        2. Failure to submit this shall be cause for rejection of the bid.
      2. CONSENT OF SURETY
        1. Bidder shall submit with the bid a Certificate (Consent of Surety) with Power of Attorney for the full amount of the bid price from a Surety Company authorized to do business in the State of New Jersey and acceptable to the OWNER stating that it will provide said bidder with a Performance Bond in the full amount of the bid. This certificate shall be obtained in order to confirm that the bidder to whom the contract is awarded will furnish Performance and Payment Bonds from an acceptable surety company on behalf of said bidder, any or all subcontractors or by each respective subcontractor or by any combination thereof which results in performance security equal to the total amount of the contract, pursuant to N.J.S.A. 40A:11-22.
        2. Failure to submit this shall be cause for rejection of the bid.
      3. BID GUARANTEE RECEIPT
        1. The Bid Guarantee, whether paid by certified check, cashier's check, or bid bond, must be received before Tuesday, June 16, 2026,9:00 am, prevailing time in a sealed envelope bearing the name of the project,Purchase, Delivery, and Set Up of Two (2) Washers and Two (2) Drying Cabinets for the Borough of Bergenfield Fire Department (FD), the bidder's name, and address, and shall be addressed to the attention ofKent Christner,Deputy CFO & QPA , at the Borough of Bergenfield, 198 N. Washington Avenue, Bergenfield, NJ 07621. 
      4. PERFORMANCE BOND
        1. The successful bidder shall, simultaneously with the delivery of the executed contract, submit an executed bond in the amount of one hundred percent (100%) of the acceptable bid as security for the faithful performance of this contract.
          1. Common Standards For All Surety Companies
            1. All surety companies must have the minimum capital and surplus or net cash assets required, pursuant to N.J.S.A. 17:17-6 or N.J.S.A. 17:17-7, whichever is applicable, at the time the invitation to bid is issued.
            2. All surety companies must complete a Surety Disclosure Statement and Certification for all payment and performance bonds, regardless of project cost, pursuant to N.J.S.A. 2A:44-143d.
          2. Additional Standards If The Amount Of The Bond Is At Least $850,000 But Not More Than $3.5 Million
            1. The surety company must hold a current certificate of authority issued by the United States Secretary of the Treasury that is valid in New Jersey as listed annually in the United States Treasury Circular 570.
            2. If the surety company has been operational for a period in excess of five years, the surety company shall also be considered to have satisfied this requirement if it is rated in one of the three highest categories by an independent nationally recognized United States rating company that determines the financial stability of insurance companies. Such rating companies must meet standards promulgated by the Commissioner of Insurance (Appendix C). (N.J.A.C 11:1-41.1 et seq.).
          3. Additional Standards If The Amount Of The Bond Is More Than $3.5 Million
            1. The surety company must hold a current certificate of authority issued by the United States Secretary of the Treasury that is valid in the State of New Jersey and listed annually in U.S. Treasury Circular 570.
            2. If the surety company has been operational for a period in excess of five years, it must be rated in one of the three highest categories by an independent, nationally recognized United States rating company that determines the financial stability of insurance companies. Such ratings must meet standards promulgated in N.J.A.C. 11:1-41.1 et seq.
          4. Multi-Year Contracts
            1. For multi-year contracts, the contractor shall provide a performance bond issued by a surety in an amount equal to no more than 100% of the annual value of the first full year of the contract. The contractor shall provide said performance bond within 5 days of the award of bid to the Borough. The performance bond for each succeeding year shall be delivered to the Borough with proof of full payment of the premium one hundred twenty (120) days prior to the expiration of the current bond.
            2. Failure to deliver a performance bond for any year of a multi-year contract one hundred twenty (120) days prior to the termination of the current bond will constitute a breach of contract and will entitle the Borough to terminate the contract upon the expiration of the current bond. Notwithstanding termination pursuant to these specifications, the contractor is obligated to perform through the date of termination of the contract and damages shall be assessed in an amount equal to the costs incurred by the Borough of Bergenfield in re-bidding the contract.
            3. Failure to deliver this with the executed contract shall be cause for declaring the contract null and void pursuant to N.J.S.A. 40A:11-22.
            4. The performance bond provided shall not be released until final acceptance of the whole work and then only if any liens or claims have been satisfied and any maintenance bonds required have been executed and approved by the OWNER. The surety on such bond or bonds shall be a duly authorized surety company authorized to do business in the State of New Jersey N.J.S.A. 17:31-5.
            5. Failure to submit a performance bond with the executed contract shall be cause for declaring a contract null and void pursuant to N.J.S.A 40A: 11-22.
      5. LABOR AND MATERIAL (PAYMENT) BOND
        1. The successful bidder shall, with the delivery of the performance bond, submit an executed payment bond to guarantee payment to laborers and suppliers for the labor and material used in the work performed under the contract.
        2. Failure to submit a labor and material bond with the performance bond shall be cause for declaring the contract null and void.
      6. MAINTENANCE BOND
        1. Upon acceptance of the work by the Borough, the contractor shall submit a maintenance bond (N.J.S.A. 40A:1-16.3) in an amount not to exceed 100% of the project costs guaranteeing against defective quality of work or materials for the period of 
          1. One (1) Year
          2. Two (2) Years
    • TERMINATION OF CONTRACT
      1. If, through any cause, the successful bidder shall fail to fulfill in a timely and proper manner obligations under this contract or if the contractor shall violate any of the requirements of the contract, the OWNER shall thereupon have the right to terminate this contract by giving written notice to the contractor of such termination and specifying the effective date of termination. Such termination shall relieve the OWNER of any obligation for balances to the contractor of any sum or sums set forth in the contract. OWNER will pay only for goods and services accepted prior to termination.
      2. Notwithstanding the above, the contractor shall not be relieved of liability to the OWNER for damages sustained by the OWNER by virtue of any breach of the contract by the contractor and the OWNER may withhold any payments to the contractor for the purpose of compensation until such time as the exact amount of the damage due the OWNER from the contractor is determined.
      3. The contractor agrees to indemnify and hold the OWNER harmless from any liability to subcontractors/suppliers concerning payment for work performed or goods supplied arising out of the lawful termination of the contract by the OWNER under this provision.
      4. In case of default by the successful bidder, the OWNER may procure the goods and services from other sources and hold the successful bidder responsible for any excess cost.
      5. Continuation of the terms of this contract beyond the fiscal year is contingent on availability of funds in the following year’s budget. In the event of unavailability of such funds, the OWNER reserves the right to cancel this contract.
      6. ACQUISITION, MERGER, SALE AND/OR TRANSFER OF BUSINESS, ETC. It is understood by all parties that if, during the life of the contract, the contractor disposes of his/her business concern by acquisition, merger, sale an/or transfer or by any means convey his/her interest(s) to another party, all obligations are transferred to that new party. In this event, the new owner(s) will be required to submit all documentation/legal instruments that were required in the original bid/contract. Any change shall be approved by the OWNER.
      7. The contractor will not assign any interest in the contract and shall not transfer any interest in the same without the prior written consent of the OWNER.
      8. The OWNER may terminate the contract for convenience by providing 60 calendar days advanced notice to the contractor.
    • INTERPRETATION AND ADDENDA
      1. The bidder understands and agrees that its bid is submitted on the basis of the specifications prepared by the OWNER. The bidder accepts the obligation to become familiar with these specifications.
      2. Bidders are expected to examine the specifications and related bid documents with care and observe all their requirements. Ambiguities, errors, or omissions noted by bidders should be promptly reported electronically via the project's Question and Answer ("Q&A") tab in the Borough’s electronic bidding system: https://secure.procurenow.com/portal/bergenfield, prior to the Question Submission deadline indicated in the Timeline Section.
      3. No oral interpretation and or clarification of the meaning of the specifications for any goods and services will be made to any bidder. Such requests shall be in writing and submitted in the project's Q&A tab. In order to be given consideration, a written request must be received in the Borough's Electronic bidding system no later than the Question Submission deadline.
      4. All interpretations, clarifications, and any supplemental instructions will be in the form of written addenda to the specifications and will be distributed to all prospective bidders in accordance with N.J.S.A. 40A:11-23. All addenda issued shall become part of the specification and bid documents and shall be acknowledged by the bidder in the bid. The OWNER’S interpretations or corrections thereof shall be final.
      5. When issuing addenda, the OWNER shall provide required notice prior to the official receipt of bids to any person who has submitted a bid or who has received a bid package pursuant to N.J.S.A. 40A:11-23c.1.
    • PRE-BID CONFERENCE

      A MANDATORY Pre-Bid Conference will be held at NO VALUE on NO VALUE at NO VALUE. Representatives of Borough, will be present. Proposals will not be accepted from any Proposer who did not attend the mandatory Pre-Proposal Meeting.

    • PAYMENT

      Every effort will be made to pay vendors and contractors within thirty (30) to sixty (60) days, provided the Borough receives the appropriate documentation, including but not limited to:

      • A signed purchase order (PO) 
      • Packing Slips (if applicable)
      • Invoices

      Invoices must clearly indicate the goods received or services rendered and the date(s) they were provided. The invoice shall include the following information. 

      • The invoice must include the full name and address of the company.
      • The invoice must include the purchase order number from the Borough
      • The invoice must have the company’s invoice number, which may be used as a reference.
      • The invoice must list the goods or services rendered.
      • The invoice must be submitted to the Borough
      • Invoices must be submitted within thirty (30) days of service.

      Interest on Invoices—The Borough does not pay interest on late bills (goods and services) unless required by law.

      Payment will be rendered upon completion of services or delivery of the full order to the satisfaction of the Borough, unless otherwise agreed to by written contract. The Borough, at its discretion, may make partial payments.  All payments are subject to approval by the Borough Council at a public meeting. Payment may be delayed occasionally, depending on the Borough meeting schedule.

    • PRE-BID CONFERENCE

      A NON-MANDATORY Pre-Bid meeting will be held at NO VALUE on NO VALUE at NO VALUE. Representatives of Borough, will be present. Attendance is encouraged.

    • CANCELLATION OF CONTRACT

      The Borough of Bergenfield may at any time during the contract period terminate the contract by giving a thirty (30) day notice in writing to the other party of its intentions to do so for noncompliance with the terms and conditions of the agreement. This shall include cancellation of the contract if, in the opinion of the Borough, the Contractor is not performing in a satisfactory and acceptable manner.

      In the event the Borough cancels the contract, the Contractor shall only be entitled to payments for work properly performed or completed.

    • AFFIRMATIVE ACTION REQUIREMENTS

      Each company is required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27, and shall submit to the Borough of Bergenfield, after notification of award, but prior to execution of a goods and services contract, one of the following three documents:

      • Appropriate evidence that the contractor is operating under an existing federally approved or sanctioned affirmative action program; or 
      • A certificate of employee information report approval issued in accordance with N.J.A.C.17:27-4; or
      • The successful respondent (respondent) shall complete an Employee Information Report, Form AA-302, and submit it to the Division of Purchase and Property Contract Compliance and Audit Unit with a check or money order for $150.00 made payable to the Treasurer, State of NJ and should submit a copy of the form and check/money order to the Borough of Bergenfield with the request for proposal submission. Upon submission and review by the Division, the Report shall constitute evidence of compliance with the regulations. The issued certificate must be sent to the Borough of Bergenfield as soon as it is received from the State of NJ.

      If awarded a contract, your company/firm will be required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27 et seq., and the terms and conditions of the Mandatory Equal Employment Opportunity Language

    • PRE-BID CONFERENCE

      There will not be a meeting for this RFB.

    • ANTI-DISCRIMINATION PROVISIONS - N.J.S.A 10:2-1

      N.J.S.A. 10:2-1. Antidiscrimination provisions. Every contract for or on behalf of the State or any county or municipality or other political subdivision of the State, or any agency of or authority created by any of the foregoing, for the construction, alteration or repair of any public building or public work or for the acquisition of materials, equipment, supplies or services shall contain provisions by which the contractor agrees that:

      1. In the hiring of persons for the performance of work under this contract or any subcontract hereunder, or for the procurement, manufacture, assembling or furnishing of any such materials, equipment, supplies or services to be acquired under this contract, no contractor, nor any person acting on behalf of such contractor or subcontractor, shall, by reason of race, creed, color, national origin, ancestry, marital status, gender identity or expression, affectional or sexual orientation or sex, discriminate against any person who is qualified and available to perform the work to which the employment relates;
      2. No contractor, subcontractor, nor any person on his behalf shall, in any manner, discriminate against or intimidate any employee engaged in the performance of work under this contract or any subcontract hereunder, or engaged in the procurement, manufacture, assembling or furnishing of any such materials, equipment, supplies or services to be acquired under such contract, on account of race, creed, color, national origin, ancestry, marital status, gender identity or expression, affectional or sexual orientation or sex;
      3. There may be deducted from the amount payable to the contractor by the contracting public agency, under this contract, a penalty of $50.00 for each person for each calendar day during which such person is discriminated against or intimidated in violation of the provisions of the contract; and
      4. This contract may be canceled or terminated by the contracting public agency and all money due or to become due hereunder may be forfeited, for any violation of this section of the contract occurring after notice to the contractor from the contracting public agency of any prior violation of this section of the contract. No provision in this section shall be construed to prevent the Borough of Bergenfield from designating that a contract, subcontract or other means of procurement of goods, services, equipment or construction shall be awarded to a small business enterprise, minority business enterprise or a women's business enterprise pursuant to P.L.1985, c.490 (C.18A:18A-51 et seq.
    • BRAND NAMES, PATENTS, AND STANDARDS OF QUALITY
      1. Brand names and/or descriptions used in these specifications are to acquaint bidders with the type of goods and services desired and will be used as a standard by which goods and services offered as equivalent will be evaluated.
      2. Variations between the goods and services described and the goods and services offered are to be fully identified and described by the bidder and submitted with the bid proposal. Vendor literature WILL NOT suffice in explaining exceptions to these specifications. In the absence of any changes by the bidder, it will be presumed and required that goods and services as described in the bid specification be provided or performed.
      3. It is the responsibility of the bidder to document and/or demonstrate the equivalency of the goods and services offered. The OWNER reserves the right to evaluate the equivalency of the goods and services.
      4. In submitting its bid, the bidder certifies that the goods and services to be furnished will not infringe upon any valid patent or trademark and that the successful bidder shall, at its own expense, defend any and all actions or suits charging such infringement, and will save the OWNER harmless from any damages resulting from such infringement.
      5. Only manufactured and farm products of the United States, wherever available, shall be used pursuant to N.J.S.A. 40A:11-18.
      6. The contractor shall guarantee any or all goods and services supplied under these specifications. Defective or inferior goods shall be replaced at the expense of the contractor. The contractor will be responsible for return freight or restocking charges.
      7. Wherever practical and economical to the OWNER, it is desired that recycled or recyclable products be provided. Please indicate when recycled products are being offered.
    • INSURANCE AND INDEMNIFICATION
      1.  INSURANCE
        1. If it becomes necessary for the contractor, either as principal or by agent or employee, to enter upon the premises or property of the owner in order to construct, erect, inspect, make delivery or remove property hereunder, the contractor hereby covenants and agrees to take use, provide and make all proper, necessary and sufficient precautions, safeguards, and protection against the occurrence of happenings of any accident, injuries, damages, or hurt to person or property during the course of the work herein covered and be his/her sole responsibility.
        2. The contractor shall maintain sufficient insurance to protect against all claims under Workers Compensation, General Liability, and Automobile and shall be subject to approval for adequacy of protection, and certificates of such insurance shall be provided with the owner named as additional insured.
        3. INSURANCE REQUIREMENTS
            1. Workers' Compensation and Employer’s Liability Insurance
              1. Workers’ Compensation Insurance in the statutory limits, including Employer’s Liability in an amount no less than $500,000.00
            2. General Liability Insurance
              1. General liability insurance in an amount not less than $1,000,000.00 combined single limit including broad form comprehensive general liability endorsement, and shall include provisions for thirty (30) days written notice of cancellation and/or modification of coverage. The Borough of Bergenfield shall be named as an additional insured.
            3. Automobile Liability Insurance
              1. Comprehensive General Automobile Liability insurance in an amount no less than $1,000,000.00 in an amount no less than $1,000,000.00 combined single limit covering owned, hired, and non-owned autos, and shall include provisions for thirty (30)  days written notice to the Borough of cancellation and/or modifications of such policies, except for non-payment which would be ten (10) days, and the contractor/vendor shall provide the Borough Clerk with certificates of insurance evidencing such policies and provisions.
        4.  CERTIFICATES OF THE REQUIRED INSURANCE          
            1. Certificates as listed above shall be submitted along with the contract as evidence covering Comprehensive General Liability, Comprehensive Automobile Liability, and where applicable, necessary Worker’s Compensation and Employer’s Liability Insurance.  Such coverage shall be with acceptable insurance companies operating on an admitted basis in the State of New Jersey and shall name the OWNER as an additional insured.
            2. Self-insured contractors shall submit an affidavit attesting to their self-insured coverage and shall name the OWNER as an additional insured.
        5. All policies maintained shall hereby name the Borough of Bergenfield, 198 N. Washington Avenue, Bergenfield, N.J. 07621 as an additional insured and shall provide for thirty (30) days written notice to the Borough of cancellation and/or modifications of such policies, except for non-payment which would be ten (10) days, and the contractor/vendor shall provide the Borough Clerk with certificates of insurance evidencing such policies and provisions. 
        6.  All insurance coverage must be in effect no later than 12:01 A.M. EST at the start of the day of the contract and remain in effect for the duration of the contract, including any extensions.
        7. Bidders lacking such coverage must have the attached “Consent of Insurance” form fully executed and returned with this bid as proof that such coverage will be in place at the time of signing of the contract. Evidence of actual insurance coverage must be by way of a policy which shall be submitted to the office of Borough Clerk with the return of the signed contract.
      2. INDEMNIFICATION
        1. Successful respondent shall indemnify and hold harmless the OWNER from all claims, suits or actions and damages or costs of every name and description to which the OWNER may be subjected or put by reason of injury to the person or property of another, or the property of the OWNER, resulting from negligent acts or omissions on the part of the bidder, the bidder’s agents, servants or subcontractors in the delivery of goods and services, or in the performance of the work under the contract.
        2. The contractor further covenants and agrees to indemnify and save harmless the owner from the payment of all sums of money or any other consideration(s) by reason of any, or all, such accidents, injuries, damages, or hurt that may happen or occur upon or about such work and all fines, penalties and loss occurred for or by reason of the violation of any owner regulation, ordinance or the laws of the State, or the United States while said work is in progress.
        3. The Borough will not accept Mutual Limitation of Liability terms.

      Certificates of the Required Insurance

        1. Certificates of liability insurance shall be submitted along with the contract as evidence covering Comprehensive General Liability, Comprehensive Automobile Liability, and where applicable, necessary Worker’s Compensation and Employer’s Liability Insurance. Such coverage shall be with acceptable insurance companies operating on an admitted basis in the State of New Jersey and shall name the OWNER as an additional insured.
      • Self-insured contractors shall submit an affidavit attesting to their self-insured coverage and shall name the OWNER as an additional insured.
    • AMERICANS WITH DISABILITES ACT

      The bidder must comply with all provisions of the Americans with Disabilities Act (ADA), P.L 101-336, in accordance with 42 U.S.C. S121 01 et seq.

    • OPEN PUBLIC RECORDS ACT (OPRA) AND PROPRIETARY INFORMAITON

      Although bids will become public information, it is understood that OPRA contains exceptions for “Trade secrets and proprietary commercial or financial information obtained from any source” and “Information which, if disclosed, would give an advantage to competitors or bidders” (pricing is not considered confidential). Therefore prospective bidders shall submit any confidential information that contains legitimate “trade secrets and proprietary commercial or financial information” and/or “information which... would give an advantage to competitors or bidders,” separately in the designated area for "Confidential Information" if necessary. Failure to provide confidential information separately will mean that the bidder agrees that their bid does not contain trade secrets or proprietary information and may be released pursuant to OPRA requests.

    • COMPETENCY AND QUALIFICATIONS OF BIDDERS
      1. COMPETENCY
        1. All bidders must show qualification and knowledge in their ability to provide the goods or services as described in this solicitation. The Bidder shall employ only competent people to do the work. If the Borough notifies the Contractor that any person working, in their opinion, is incompetent, unfaithful, disorderly, or otherwise unsatisfactory, such person shall be replaced and shall not be again employed except with the consent of the Borough.
        2. All bidders will attach a list of all municipalities and agencies for which they have provided service.
      2. QUALIFICATIONS
        1. The Contractor shall be required to employ and maintain a sufficient force of qualified personnel to perform the work, so that calls of any emergency nature can be answered promptly, with the personnel arriving at the job site.
        2. If certification is required for the work explained in these specifications, the Contractor is to submit the personnel qualifications and certifications with the bid and shall become part of the contract.
        3. Personnel qualifications and certifications will be submitted with the bid and shall become a part of the contract. The Borough of Bergenfield shall have the right to investigate such qualifications and references to the extent it deems necessary and the Contractor shall assist as may be needed in the investigation. In the event that the qualifications of the personnel are not acceptable, the Borough of Bergenfield shall have the right to award the contract to the next lowest responsible bidder whose personnel meet the qualifications as determined by the Borough of Bergenfield. The Borough of Bergenfield shall be notified of any personnel changes during the life of this contract.
        4. If applicable, Contractors shall visit work locations prior to submitting prices to become thoroughly familiar with the work sites, conditions, etc.
    • WARRENTY
      • Minimum ten (10) year manufacturer’s warranty on major parts, and five (5) year manufacturer's warranty on minor parts for washer and dryer cabinets.
      • Warranty must cover components, including control systems, motors, pumps, and electrical components.
      • Options for extended warranty coverage should be included.
    • LICENSE REQUIREMENTS

      If applicable, Bidders shall hold the following license requirement(s): TBD

    • STATEMENT OF OWNERSHIP N.J.S.A 52:25-42.2

      No business organization, regardless of form of ownership, shall be awarded any contract for the performance of any work or the furnishing of any goods and services, unless, prior to the receipt of the Bid or accompanying the Bid of said business organization, proposers shall submit a statement setting forth the names and addresses of all persons and entities that own ten percent or more of its stock or interest of any type at all levels of ownership.

      The included Statement of Ownership shall be completed and submitted with the RFB response. This requirement applies to all forms of business organizations, including, but not limited to, corporations and partnerships, publicly owned corporations, limited partnerships, limited liability corporations, limited liability partnerships, sole proprietorships, and Subchapter S corporations.

      Not-for-profit entities should fill in their name, check the not-for-profit box, and certify the form. No other information is required.

      Failure to submit a disclosure document shall result in rejection of the Bid, as it cannot be remedied after Bids have been opened.

    • NON-COLLUSION AFFIDAVIT

      A notarized Non-Collusion Affidavit should be submitted with the request for bid. The bidder has to certify that he has not directly or indirectly, entered into any agreement, participated in any collusion, discussed any or all parts of this bid with any potential bidder, or otherwise taken any action in restraint of free, competitive proposing in connection with the above named RFB, and that all statements contained in said bid and in this affidavit are true and correct, and made with full knowledge that the Borough of Bergenfield relies upon the truth of the statements contained in said BId and in the statements contained in this affidavit in awarding the contract for the said work.

      The respondent has to further warrant that no person or selling agency has been employed or retained to solicit or secure such contract upon an agreement or understanding for a commission, percentage, brokerage or contingent fee, except bona fide employees of bona fide established commercial or selling agencies maintained by the respondent.

      The Borough of Bergenfield has provided a Non-Collusion Affidavit form here within the specifications package. All respondents are to complete, sign, have the signature notarized and submit the form with the bid response.

    • EXPREIENCE REQUIREMENT

      Bids will only be considered from Contractors that have a minimum ofTBD years of successful experience providing the services outlined in the Specifications. This experience must be completed prior to the date established for the receipt of the proposal. The Contractor shall be required to demonstrate that they have successfully completed these types of services for clients of a similar size and magnitude. Failure to demonstrate this experience will be grounds for bid rejection.

      All subcontractors shall be of recognized standing with a record of satisfactory performance. The Contractor shall not employ any subcontractor, which the Borough may reject as incompetent, unfit, or where there is reason to assume the service will not be provided in accordance with the contract documents. Prior to the employment of the named subcontractors, the subcontractor must be approved by the Borough.

    • TRAINING
      • On-site training for Fire Department personnel on operation, maintenance, and safety procedures.
      • Training manuals and operational guides must be provided.
    • PRICING INFORMATION AND PREPERATION OF BIDS
      1. The OWNER is exempt from any local, state or federal sales, use or excise tax.
      2. Estimated Quantities. The OWNER has attempted to identify the item(s) and the estimated amounts of each item bid to cover its requirements; however, past experience shows that the amount ordered may be different than that submitted for bidding. The right is reserved to decrease or increase the quantities specified in the specifications pursuant to N.J.A.C. 5:30-11.2 and11.10. NO MINIMUM PURCHASE IS IMPLIED OR GUARANTEED.
      3. Successful bidder shall be responsible for obtaining any applicable permits or licenses from any government entity that has jurisdiction to require the same. All bids submitted shall include this cost in the bid price.
      4. Bidders shall insert prices for furnishing goods and services required by these specifications. Prices shall be net, including any charges for packing, crating, containers, etc. All transportation charges shall be at the placement of locations specified by the OWNER. As specified, placement may require inside deliveries. No additional charges will be allowed for any transportation costs resulting from partial shipments made for the contractor’s convenience.
    • BUSINESS REGISTRATION CERTIFICATE N.J.S.A 52: 32-44

      Pursuant to N.J.S.A. 52:32-44, the Borough of Bergenfield is prohibited from entering into a contract with an entity unless the bidder and each subcontractor that is required by law to be named in a bid/proposal/contract has a valid Business Registration Certificate on file with the Division of Revenue and Enterprise Services within the Department of the Treasury.

      All bidders or companies responding to this request for bid are requested to submit with their response package a copy of their “New Jersey Business Registration Certificate” as issued by the Department of Treasury of the State of New Jersey.

      N.J.S.A. 52:32-44 imposes the following requirements on contractors and all subcontractors that knowingly provide goods or perform services for a contractor fulfilling this contract:

      1. The contractor shall not enter into a contract with a subcontractor unless the subcontractor first provides the contractor with a valid proof of business registration. The subcontractor shall provide proof of business registration to the respondent, who in turn, shall provide it to the Contracting Agency prior to the time a contract, purchase order, or other contracting document is awarded or authorized.
      1. The contractor shall maintain and submit to the Contracting Agency a list of subcontractors and their addresses that may be updated from time to time.
      2. Prior to receipt of final payment from a contracting agency, a contractor must submit to the contracting agency an accurate list of all subcontractors or attest that none was used.
      3. The contractor and any subcontractor providing goods or performing services under the contract, and each of their affiliates, shall collect and remit to the Director of the Division of Taxation in the Department of the Treasury, the use tax due pursuant to the Sales and Use Tax Act, (N.J.S.A. 54:32B-1 et seq.) on all sales of tangible personal property delivered into the State.       Emergency Purchase of Contracts

      For purchases of an emergent nature, the contractor shall provide its Business Registration Certificate within two weeks from the date of purchase or execution of the contract or prior to payment for goods and services, whichever is earlier.

      N.J.S.A. 54:49-4.1: Violations of Registration Requirements; Penalties.

      A business organization that fails to provide a copy of a business registration as required pursuant to section 1 of P.L.2001, c.134 (C.52:32-44 et al.) or subsection e. or f. of section 92 of P.L.1977, c.110 (C.5:12-92), or that provides false information of business registration under the requirements of either of those sections, shall be liable for a penalty of $25 for each day of violation, not to exceed $50,000 for each business registration copy not properly provided under a contract with a contracting agency.

      SAMPLES OF NEW JERSEY BUSINESS REGISTRATION CERTIFICATES

    • OPTIONAL ACCESSORIES AND SERVICE
      • Pricing for accessories may be included with bidder documentation for additional items such as detergent, replacement filters, or extended monitoring systems.
      • Bidder shall provide a recommended preventative maintenance schedule and service options.
      • Bidders shall provide the standard response time and the nearest location of repair technicians. 
    • DISCLOSURE OF INVESTMENTS IN IRAN N.J.S.A 18A:18A-49.4

      The Borough, pursuant to N.J.S.A. 18A:18A-49.4, shall implement and comply with Public Law 2012, c.25 and P.L. c.4), Disclosure of Investment Activities in Iran—N.J.S.A. 52:32-57 et seq.

      Pursuant to N.J.S.A. 52:32-57, et seq. (P.L. 2012, c.25, P.L. 2021, c.4), any person or entity that is submits a bid or proposal or otherwise proposes to enter into or renew a contract must certify that neither the person or entity, nor any of its parents, subsidiaries, or affiliates, is identified on the Department of Treasury's Chapter 25 list as a person or entity engaging in investment activities Iran.    The Chapter 25 list is found on the Division’s website at the following:

      Respondents must review this list prior to completing the certification.  If the Director of the Division of Purchase and Property finds a person or entity to be in violation of the law, s/he shall take action as may be appropriate and provided by law, rule or contract, including but not limited to, imposing sanctions, seeking compliance, recovering damages, declaring the party in default and seeking debarment or suspension of the party.

      Before a contract for goods or services can be amended or extended, a person or entity must certify that neither the person or entity, nor any parent entity, subsidiary, or affiliate, is identified on the Department of Treasury's Chapter 25 list of entities determined to be engaged in prohibited activities in Iran.

      If unable to certify that  neither the person or entity, nor any parent entity, subsidiary, or affiliate, is identified on the Department of Treasury's Chapter 25 list of entities determined to be engaged in prohibited activities in Iran, then the proposers must provide a detailed, accurate and precise description of the activities of the proposing person/entity, or one of its parents, subsidiaries or affiliates, engaging in Russia or Belarus and/or investment activities in Iran outlined above by completing the boxes on the lower portion of the enclosed form.  The person or entity must cease engaging in any prohibited activities and provide an updated certification before the contract can be entered into. If a vendor or contractor is found to be in violation of law, action may be taken as appropriate and as may be provided by law, rule, or contract, including but not limited to imposing sanctions, seeking compliance, recovering damages, declaring the party in default, and seeking debarment or suspension of the party.

      The Borough has provided within these specifications, a Disclosure of Investment Activities in Iran form for all persons or entities, that plan to submit a request for proposal, respond to a proposal, or renew a contract with the Borough, to complete, sign and submit with the proposal. The Disclosure of Investment Activities in Iran Form is to be completed, certified and submitted prior to the award of contract, preferably with the request for proposal submittal.

    • DELIVERY AND SET UP
      • Delivery of equipment shall be in the Borough of Bergenfield. Specific locations shall be provided upon award notice.
      • Delivery and set-up shall be provided within thirty (90) days of contract execution. 
    • DISCLOSURE OF RUSSIA-BELARUS CERTIFICATION

      Pursuant to N.J.S.A. 52:32-60.1, et seq. (L. 2022, c. 3) any person or entity (hereinafter "Vendori") that seeks to enter into or renew a contract with the Borough of Bergenfield for the provision of goods or services, or the purchase of bonds or other obligations, must complete the certification below indicating whether or not the Vendor is identified on the Office of Foreign Assets Control (OFAC) Specially Designated Nationals and Blocked Persons list, available here:

       https://sanctionssearch.ofac.treas.gov/.

      If the Borough of Bergenfield finds that a Vendor has made a certification in violation of the law, it shall take any action as may be appropriate and provided by law, rule or contract, including but not limited to, imposing sanctions, seeking compliance, recovering damages, declaring the party in default and seeking debarment or suspension of the party.  I, the undersigned, certify that I have read the definition of "Vendor" below, and have reviewed the Office of Foreign Assets Control (OFAC) Specially Designated Nationals and Blocked Persons list, and having done so certify: 

      • That the Vendor is not identified on the OFAC Specially Designated Nationals and Blocked Persons list on account of activity related to Russia and/or Belarus. 
      • That I am unable to certify as to "A" above, because the Vendor is identified on the OFAC Specially Designated Nationals and Blocked Persons list on account of activity related to Russia and/or Belarus. 
      • That I am unable to certify as to "A" above, because the Vendor is identified on the OFAC Specially Designated Nationals and Blocked Persons list. However, the Vendor is engaged in activity related to Russia and/or Belarus consistent with federal law, regulation, license or exemption. A detailed description of how the Vendor's activity related to Russia and/or Belarus is consistent with federal law is set forth below. 

      Vendor means: (1) A natural person, corporation, company, limited partnership, limited liability partnership, limited liability company, business association, sole proprietorship, joint venture, partnership, society, trust, or any other nongovernmental entity, organization, or group; (2) Any governmental entity or instrumentality of a government, including a multilateral development institution, as defined in Section 1701(c)(3) of the International Financial Institutions Act, 22 U.S.C. 262r(c)(3); or (3) Any parent, successor, subunit, direct or indirect subsidiary, or any entity under common ownership or control with, any entity described in paragraph (1) or (2). 

      The Borough has provided within these specifications, a Disclosure of Russia-Belarus Certification form for all persons or entities, that plan to submit a request for proposal, respond to a proposal, or renew a contract with the Borough, to complete, sign and submit with the proposal. The Disclosure of Russia-Belarus Certification Form is to be completed, certified and submitted prior to the award of contract, preferably with the request for proposal submittal. 

    • REJECTION OF BIDS

      Bids may be rejected for any of the following reasons:

      All bids pursuant to N.J.S.A. 40A:11-13.2;

      1. If more than one bid is received from an individual, firm or partnership, corporation or association under the same name;
      2. Multiple bids from an agent representing competing bidders;
      3. The bidder is determined to possess, pursuant to N.J.S.A. 40A:11-4b, Prior Negative Experience; or,
      4. If the successful bidder fails to enter into a contract within 21 days, Sundays and holidays excepted, or as otherwise agreed upon by the parties to the contract. In this case, at its option, the OWNER may accept the bid of the next lowest responsible bidder. (N.J.S.A. 40A:11-24b)
    • JOINT VENDTURES AND SUBCONTRACTORS

      An entity consisting of more than one firm must clearly identify itself in its proposal as a joint venture. Each party to a joint venture shall provide financial data for the individual firms and each shall complete all required proposal forms. Each party to a joint venture shall execute a Statement of Joint Venture stating that each bear, jointly and severally, the entire responsibility for contract performance. Further the joint venture must clearly describe the responsibilities of each firm and the individual who shall serve as the joint venture’s project principal. These joint venture requirements do not apply to a firm submitting a proposal as a prime contractor engaging other firms as subcontractors. Under that circumstance, the prime shall clearly identify the role of subcontractors and the methods that the prime shall use to ensure subcontractor performance.

    • NEW JERSEY DEPARTMENT OF LABOR OF WORKFORCE DEVELOPMENT - WORKPLACE ACCOUNTABLITY IN LABOR LIST (THE WALL)

      Bidder shall not appear on the NJ Department of Labor of Workforce Development The WALL list.

    • AMERICAN GOODS

      In accordance with N.J.S.A. 40A:11-18, only manufactured products of the United States, wherever available, and where possible are to be used with this project.

    • ELECTION LAW ENFORCMENT COMMISSION (ELECT)

      (1)    Any business that has received $50,000 or more in contracts from government entities in a calendar year must file an annual disclosure report with ELEC.
      (2)    Annual Disclosures require submission by March 30th of each year covering contracts and contributions for the prior calendar year.
      (3)    At a minimum, a list of all business entities that file an annual disclosure report will be listed on ELEC’s website at www.elec.state.nj.us.

    • ASSIGNMENT

      It is understood by all parties that if, during the term of the Contract, the contractor disposes of his/her business concern by acquisition, merger, sale and/or transfer or by any means conveys his/her interest(s) to another party, all obligations are transferred to that new party. In this event, the new owner(s) of the business concern will be required to submit all documentation/legal instruments that were required in the original bid/Contract. Any change in the controlling ownership of the successful bidder, or where there is a sale of the Contract rights and obligations, the Borough may terminate the Contract upon ten (10) days’ written notice.

    • LIQUIDATED DAMAGES

      Should the contract/work/service not be completed in accordance with the plans and specifications, liquidated damages shall be assessed against the contractor as follows.

      • One (1) to Fifteen (15) Days - $500 per calendar day
      • Sixteen (16) to Thirty (30) Days - 1,000 per calendar day
      • Greater Than Thirty (30) Days - $2,000 per calendar day

      Excluding Saturdays, Sundays, and legal holidays.

    • PREVAILING WAGE CONFIRMATION (required)

      Pursuant to N.J.S.A. 34:11-56.25 et seq., successful bidders on projects for public work shall adhere to all requirements of the New Jersey Prevailing Wage Act. The contractor shall be required to submit a certified payroll record to the OWNER within ten (10) days of the payment of the wages. The contractor is also responsible for obtaining and submitting all subcontractors’ certified payroll records within the aforementioned time period. The contractor shall submit said certified payrolls in the form set forth in N.J.A.C. 12:60-6.1(c). It is the contractor’s responsibility to obtain any additional copies of the certified payroll form to be submitted by contacting the New Jersey Department of Labor and Workforce Development, Division of Workplace Standards.
