Sealed bids are hereby invited and will be received: At or prior to 5:00 p.m. (Mountain Daylight Time) Wednesday, April 13, 2022 At the Office of the Clerk and Recorder City–County of Butte-Silver Bow Second Floor, Room 208 Courthouse Building 155 West Granite Street Butte, Montana 59701 Said Bids will be opened and read aloud at a meeting of the Butte-Silver Bow Council of Commissioners in the Council Chambers, at 7:30 p.m. on Wednesday, April 13, 2022. Project generally includes, but is not limited to the following: A new, duplex, submersible pump lift station with 450 gpm, 60 HP pumps, 96-inch diameter concrete wet well, above grade valve and electrical enclosure, associated gravity sewer mains and manholes, two, precast concrete, below grade flow meter and control valve vaults, air release manhole assemblies, approximately 800 lineal feet of new 8-inch PVC sewer force main, connections to existing 8-inch and 14-inch sewer force mains, a natural gas fired generator, associated electrical, controls and telemetry, sitework, grading, excavation, dewatering and general restoration. The bidding documents consisting of Plans Specifications for the above bid will be held on file at the Clerk and Recorder’s Office. Complete bidding documents for this project are available in electronic form. Printed copies of the bid documents are not available from the Engineer or the Owner. Bid documents may be viewed online at www.questcdn.com by inputting the Quest project/request number 8147965 and downloaded for $15 are also available at your local plan rooms and reprographers. Printed copies may be ordered from reprographic companies. Plan holders are responsible for their own reproduction costs. Addenda to the project will be posted on the website and registered plan holders will be provided e-mail notification of addenda when posted. BIDDERs must register through the web site to be notified of addenda. The BIDDER is responsible for periodically checking the site. The CONTRACTOR that is awarded the project will be responsible for printing all documents necessary for performing the work. All Bids must be accompanied by an amount of not less than ten percent (10%) of the aggregate of the Bid Proposed in the form of (a) lawful monies of the United States; (b) a cashier’s check, certified check, bank money order or bank draft, in any case drawn and issued by a National Banking Association located in the State of Montana; (c) a bid bond or bonds executed by a surety corporation authorized to do business in the State of Montana. These securities will be forfeited to the Butte-Silver Bow Government as liquidated damages if the requirements in the way of contract are not entered into within fifteen (15) days after the date of award by the Council of Commissioners. Each bidder shall be required to have a Business license prior to acceptance of the bid. Federal Excise, local or state tax should not be included in the Bids as Butte-Silver Bow is exempt from it. All laborers and mechanics employed by CONTRACTOR or SUBCONTRACTORs in performance of the construction work shall be paid wages in accordance with the Montana Prevailing Wage Rates. The successful Bidder shall comply with all applicable Federal Regulations and Requirements which include but are not limited to, Section 2 Clause, Equal Opportunity Clause, Executive Order 11246 and 11624, Federal Labor Standards and Civil Rights Act. Accordingly, the City-County of Butte-Silver Bow reserves the right to negotiate an agreement based upon fair and reasonable compensation for the scope of work and services proposed, as well as the right toreject any and all bids and to accept the bid deemed to represent the best interests of the City-County of Butte-Silver Bow. The successful bidder shall be required to furnish a Construction Performance Bond and a Construction Payment Bond as security for the faithful performance and the payment of all bills and obligations arising from the performance of the Contract. CONTRACTOR and any of the CONTRACTOR’s SUBCONTRACTORs doing work on this project will be required to obtain registration with the Montana Department of Labor and Industry (DLI). Forms for registration are available from the Department of Labor and Industry, P.O. Box 8011, 1805 Prospect, Helena, Montana 59604-8011. Information on registration can be obtained by calling 1-406-444-7734. CONTRACTORs are required to have registered with the DLI prior to bidding on this project. The CONTRACTOR must ensure that employees and applicants for employment are not discriminated against because of their race, color, religion, sex or national origin. The project is funded in part with funding from the Renewable Resources Grant and Loan (RRGL) and the American Rescue Plan Act (ARPA) Programs. Award of the project will be contingent upon receiving funding and award concurrence from these agencies. In accordance with the provisions set forth in MCA Title 28-2-2115 – Alternate Billing Cycle, payment provisions will also be modified to allow coordination with this funding agency. This contract allows the OWNER to approve the CONTRACTOR's payment request within _30__days after it is received by the OWNER. No bid may be withdrawn after the scheduled time for the public opening of bids. The right is reserved to reject any or all proposals received, to waive informalities, to postpone the award of the contract for a period not to exceed sixty (60) days, and to accept the lowest responsive and responsible bid which is in the best interest of the OWNER.
