    Description

    In keeping with its strategic plan, the Agency is now soliciting for Bids from qualified, licensed and insured entities to provide Security Services (Trade services) to the Agency.  All Bids submitted in response to this solicitation must conform to all of the requirements and specifications outlined within this document and any designated attachments in its entirety.

    Bids are due no later than 4:00 pm on Monday, August 24, 2026, through the Procurement Portal.

    Background

    Fresno Housing is a public housing agency responsible for providing safe, decent, and affordable housing to low-income families, seniors, and persons with disabilities within its jurisdiction. The Agency owns and/or manages multiple residential communities, administrative facilities, and related properties that require professional security services to support resident safety, protect the Agency's assets, and assist in maintaining a secure living environment.

     

    Fresno Housing is seeking qualified and licensed security service providers to furnish unarmed security personnel and related services at designated properties. Services may include routine patrols, monitoring of common areas, incident response, documentation of security-related activities, coordination with local law enforcement, and other duties as directed by the Agency. The selected contractor shall provide professional, reliable, and community-oriented security services that promote resident safety while respecting the rights and dignity of all residents and visitors. The contractor must comply with all applicable federal, state, and local laws, regulations, licensing requirements, and the Agency's policies.

     

    This procurement is being conducted in accordance with applicable U.S. Department of Housing and Urban Development (HUD) requirements and Fresno Housing's procurement policies.

    Evaluation Criteria

    • Quantities

      All quantities entered by the Agency herein and within the corresponding Pricing Items within the noted Internet System are for calculating purposes only.  

    • Per 2 CFR 200.321 (b)(3)

      Contracting with small and minority firms, women's business enterprise and labor surplus area firms.

      1. The grantee and subgrantee will take all necessary affirmative steps to assure that minority firms, women's business enterprises, and labor surplus area firms are used when possible.
      2. Affirmative steps shall include:
        • Placing qualified small and minority businesses and women's business enterprises on solicitation lists;
        • Assuring that small and minority businesses, and women's business enterprises are solicited whenever they are potential sources;
        • Dividing total requirements, when economically feasible, into smaller tasks or quantities to permit maximum participation by small and minority business, and women's business enterprises;
        • Establishing delivery schedules, where the requirement permits, which encourage participation by small and minority businesses, and women's business enterprises;
        • Using the services and assistance of the Small Business Administration, and the Minority Business Development Agency of the Department of Commerce; and
        • Requiring the prime contractor, if subcontracts are to be let, to take the affirmative steps listed in paragraphs (e)(2) (i) through (v) of this section.
    • Bid Bond

      The bid bond or guarantee shall be included in the bid package submitted by each bidder for any proposed fee that is greater than $25,000. This bond ensures that if awarded the contract, the bidder will accept and perform the work under the contract. It also ensures that the bidder will not attempt to withdraw or otherwise not fulfill the contract. Finally, the bid bond ensures that the bidder will execute the contractual documents that are required within the time specified in the solicitation or forfeit all or part of the guarantee. A certified check, bank draft, U.S. Government Bonds at par value, bid bond secured by an acceptable surety company, or other negotiable instrument may be accepted as a bid guarantee. If the successful bidder refuses to sign the contract after award, the bid bond is forfeited, and the award will then go to the next lowest responsive and responsible bidder. If a bid bond or guarantee is not submitted with the bid, the Agency will reject the bid as non-responsive. The Agency anticipates that it will not return any bid bonds until the contract has been awarded and the required performance and payments bonds have been furnished until all bids have been rejected; or the time specified for acceptance of bids has expired. In fairness to the other bidders, the Agency may also choose to return the bid bonds if the Agency has a firm and reasonable assurance that the responsive and responsible bidder who submitted the lowest cost will execute the contract. For Capital Fund work, a bid guarantee from each bidder equivalent to 5 percent of the bid price is required for each construction contracts see 24 CFR 905.316(d)(1) and one of the following:

      1. A performance and payment bond for 100% of the contract price; or
      2. Separate payment and performance bonds each for 50% or more of the contract price; or,
      3. A 20% cash escrow; or,
      4. A 10% irrevocable letter of credit with terms acceptable to HUD; or
      5. Any other payment acceptable to HUD.
    • Addenda

      Questions and requests for information are encouraged to be submitted through the Procurement Portal.

      All Questions and requests for information may be addressed in writing to the CF.  The CF will respond to all such inquiries in writing by addendum to all prospective bidders (i.e., firms or individuals that have obtained the IFB Documents).  During the IFB solicitation process, the CF will NOT conduct any ex parte (a substantive conversation—“substantive” meaning, when decisions pertaining to the IFB are made—between the Agency and a prospective bidder when other prospective bidders are not present) conversations that may give one prospective bidder an advantage over other prospective bidders.  This does not mean that prospective bidders may not call the CF—it simply means that, other than making replies to direct the prospective bidder where his/her answer has already been issued within the solicitation documents, the CF may not respond to the prospective bidder’s inquiries but will direct him/her to submit such inquiry in writing so that the CF may more fairly respond to all prospective bidders in writing by addendum.

    • Contract Form

      The Agency will not execute a contract on the successful bidder's form–contracts will only be executed on the Agency form (please see Sample Contract) and by submitting a bid, the successful bidder agrees to do so (please note that the Agency reserves the right to amend this form as the Agency deems necessary).  However, the Agency will during the IFB process (prior to the submittal deadline) consider any contract clauses that the proposer wishes to include therein and submits in writing a request for the Agency to do so; but the failure of the Agency to include such clauses does not give the successful bidder the right to refuse to execute the Agency's contract form.  It is the responsibility of each prospective bidder to notify the Agency, in writing, prior to submitting a bid, of any contract clause that he/she is not willing to include in the final executed contract and abide by. The Agency will consider and respond to such written correspondence, and if the prospective bidder is not willing to abide by the Agency's response (decision), then that prospective bidder shall be deemed ineligible to submit a bid.

    • Prior Agency Approval Required

      Please note that the successful bidder shall NOT conduct any additional work without the prior written authorization of the Agency representative (via delivery of a Task Order, which may take the form of an e-mail). Failure to abide by this directive shall release the Agency of any obligation to pay the successful bidder for any work conducted without the noted prior written authorization.

    • Ties

      In the case of bids, the award shall be decided as detailed within Section 6.12.C of HUD Procurement Handbook 7460.8 REV 3, by “drawing lots or other random means of selection.”

    • Workers Compensation Insurance

      An original certificate evidencing the proposer’s current industrial (worker’s compensation) insurance carrier and coverage amount;

    • Late Bids

      Bids received after the published deadline will not be accepted or considered.

    • Business License

      Provide proof of California Business License, General Liability, Auto-Insurance, Worker’s Compensation, and Other Liability Insurance.

    • Contract Execution Details

      By completing, executing and submitting the Form of Bid, the “bidder is thereby agreeing to abide by all terms and conditions pertaining to this IFB as issued by the Agency, including an agreement to execute the Sample Contractor Contract. Accordingly, the Agency has no responsibility to conduct after the submittal deadline any negotiations pertaining to the contract clauses already published.

    • Security Services (as needed)

      Fresno Housing is seeking qualified and experienced security service providers to deliver comprehensive Security Services on an as-needed basis. The selected Contractor(s) will be responsible for ensuring the safety and security of Fresno Housing properties, residents, staff, and visitors. The services will include, but are not limited to, on-site security personnel, mobile patrols, alarm response, and emergency services. The goal is to maintain a secure environment that deters criminal activity and ensures the well-being of all stakeholders.

      The successful contractor shall provide all labor, supervision, uniforms, equipment, communication devices, vehicles (if applicable), reporting, and incident documentation necessary to perform the services described herein.

      Services shall be provided on an as-needed basis. Fresno Housing does not guarantee any minimum number of work assignments, service requests, hours, shifts, patrols, properties, or contract value under this Contract. Services will be requested through individual work assignments, schedules, post orders, or other written or verbal service requests issued by Fresno Housing's authorized representative.

      Fresno Housing reserves the right, at its sole discretion, to add, remove, substitute, or reassign properties, facilities, buildings, developments, offices, parking areas, construction sites, or other Fresno Housing-owned or managed locations to be serviced under this Contract. Fresno Housing may also modify patrol schedules, service frequencies, staffing levels, hours of operation, post assignments, and service locations as operational needs change. Such modifications shall not constitute a change to the Contract provided the requested services remain within the general scope of this Contract. The Contractor shall provide services at any Fresno Housing property or facility upon request and in accordance with the Contractor's awarded pricing.

      Detailed Specifications

      The security services to be provided must meet the following specifications and standards:

      1. On-Site Security Personnel
        • Uniformed security officers to be present at designated Fresno Housing properties.
        • Officers must be licensed and certified in accordance with California state regulations.
          • Personnel Qualifications and Replacement- All security personnel assigned to this contract shall:

            • Possess a valid California Bureau of Security and Investigative Services (BSIS) Guard Card.
            • Meet all training requirements required by BSIS and applicable California law.
            • Successfully pass a criminal background check and pre-employment drug screening conducted by the Contractor prior to assignment. Fresno Housing reserves the right to request confirmation that assigned personnel meet these requirements.
            • Be properly licensed, trained, and supervised.
            • Wear the Contractor's approved uniform and company identification while on duty.
            • Conduct themselves in a professional, courteous, and respectful manner when interacting with residents, visitors, Fresno Housing staff, contractors, and members of the public.

            Fresno Housing reserves the right to request removal and replacement of any assigned security officer whose conduct, performance, appearance, professionalism, or qualifications are deemed unacceptable. The Contractor shall replace such personnel immediately when directed by Fresno Housing if removal is required for safety, security, misconduct, or licensing concerns. In all other circumstances replacement shall occur within twenty-four (24) hours.

          • Background Investigations and Personnel Qualifications

            Prior to assigning personnel under this Contract, the Contractor shall ensure each assigned security officer:

            • Possesses a valid California Bureau of Security and Investigative Services (BSIS) Guard Card and any other licenses or permits required by applicable law.
            • Has successfully completed all training required by BSIS and applicable California law.
            • Has successfully passed a criminal background investigation conducted by the Contractor in accordance with applicable federal and state law and BSIS requirements.
            • Is authorized to legally work in the United States.
            • Participates in a drug-free workplace program and successfully completes any pre-employment drug screening required by the Contractor.
            • Maintains a professional appearance and demeanor while performing services.
            • Possesses sufficient English language proficiency to effectively communicate with Fresno Housing staff, residents, emergency responders, law enforcement, and to accurately prepare written reports and documentation.
            • Possesses a valid California driver's license and maintains an acceptable driving record when assigned to mobile patrol or any position requiring operation of a motor vehicle.
            • Remains physically capable of performing the duties assigned under this Contract.
        • Officers must be trained in conflict resolution, emergency response, and customer service.
        • Officers must conduct regular patrols, monitor surveillance systems, and report any suspicious activities.
        • Minimum Staffing Requirements- The Contractor shall provide qualified security personnel for all scheduled shifts and patrols identified in this Scope of Work. The Contractor shall be solely responsible for providing relief personnel to ensure uninterrupted service. Under no circumstances shall scheduled shifts or patrol checks be missed due to staffing shortages, scheduling conflicts, illness, or other personnel issues. If an assigned security officer is unable to report for duty, the Contractor shall provide a qualified replacement prior to the beginning of the scheduled shift. Failure to provide staffing as required may be considered a material breach of the contract. The Contractor shall immediately notify Fresno Housing if any scheduled shift or patrol is at risk of being unfilled and shall identify the replacement officer assigned. 
      2. Mobile Patrols
        • Mobile patrol units to cover multiple properties as specified by Fresno Housing.
        • Patrol frequencies, schedules, and locations shall be established by Fresno Housing. Unless otherwise directed, patrols shall occur at random intervals to reduce predictability.
        • Patrol vehicles must be clearly marked and equipped with communication devices.
        • Patrol officers must document their activities and report any incidents immediately.
        • Patrol officers shall check designated buildings, common areas, parking areas, vacant units (when authorized), gates, lighting, and other locations identified by Fresno Housing.
      3. Alarm Response
        • Immediate response to alarm activations at Fresno Housing properties.
          • Response times shall begin upon notification by Fresno Housing or its designated monitoring service.
        • Officers must assess the situation, secure the area, and notify law enforcement if necessary.
        • Detailed incident reports must be provided for each alarm response.
      4. Emergency Services
        • The Contractor shall maintain the capability to respond to emergency service requests outside of regularly scheduled patrols when requested by Fresno Housing.
        • The Contractor shall provide Fresno Housing with a twenty-four (24) hour dispatch telephone number and an emergency management contact.
        • The Contactor shall provide 24/7 availability to respond to emergencies such as fire, medical incidents, or natural disasters.
          • For emergency service requests, the Contractor shall acknowledge the request immediately and arrive on-site within sixty (60) minutes unless otherwise authorized by Fresno Housing. 
        • Coordination with local emergency services and Fresno Housing management.
        • Provision of first aid and basic life support until professional medical help arrives.
      5. Reporting and Documentation
        • Daily activity logs and incident reports must be maintained and submitted to Fresno Housing management.
          • Incident reports shall include, at a minimum, the date, time, location, personnel involved, actions taken, witnesses (if applicable), photographs when available, law enforcement case numbers (if applicable), and recommendations for follow-up.
        • Monthly summary reports detailing security activities, incidents, and recommendations for improvements.
        • All reports must be accurate, detailed, and submitted in a timely manner.
          • Patrol Verification- The Contractor shall maintain documentation verifying completion of all scheduled patrols. Documentation may consist of electronic guard tour reports, GPS tracking records, electronic checkpoint scans, mobile reporting software, or other verifiable methods approved by Fresno Housing. Fresno Housing reserves the right to request copies of patrol verification records at any time during the contract term. Records shall be retained by the Contractor for a minimum of three (3) years after final payment or longer if required by applicable law or the Contract.

      6. Standards and Compliance
        • The Contractor shall perform all services in a professional manner consistent with accepted industry standards. Performance expectations include, but are not limited to:

          • One hundred percent (100%) attendance for all scheduled shifts and patrols.
          • Timely arrival for all scheduled services.
          • Accurate and complete documentation.
          • Professional appearance and conduct.
          • Compliance with all applicable federal, state, and local laws.
          • Immediate notification to Fresno Housing of emergencies or significant incidents.
          • Cooperation with law enforcement and emergency responders.
        • All services must comply with all applicable federal, state, and local laws, including California Bureau of Security and Investigative Services (BSIS) requirements. 
        • Security personnel must adhere to Fresno Housing policies and procedures.
        • Contractor must maintain all necessary licenses, certifications, and insurance coverage.
        • Contractor shall immediately notify Fresno Housing of any suspension, expiration, revocation, investigation, or disciplinary action affecting the Contractor's security license or any assigned officer's required licensing.
      7. Non-Performance and Corrective Action

        Failure to perform the services required under this Contract in accordance with the Contract Documents, Scope of Work, Work Orders, or Fresno Housing directives shall constitute non-performance and may result in corrective action by Fresno Housing.

        Examples of non-performance include, but are not limited to:

        • Missed shifts.
        • Missed patrols.
        • Failure to provide required staffing.
        • Late arrival for scheduled services.
        • Failure to respond within the required response time.
        • Failure to submit required reports or documentation.
        • Incomplete patrols.
        • Sleeping while on duty.
        • Leaving an assigned post without authorization.
        • Failure to notify Fresno Housing of significant incidents.
        • Failure to maintain required licenses, certifications, or insurance.
        • Unprofessional conduct toward residents, staff, visitors, contractors, or members of the public.
        • Failure to provide qualified replacement personnel.
        • Falsification of patrol logs, incident reports, or other required records.
        • Repeated performance deficiencies after notice from Fresno Housing.

        If Fresno Housing determines that the Contractor has failed to perform in accordance with the Contract, Fresno Housing may, in addition to any other remedies available under the Contract or applicable law:

        • Require immediate corrective action.
        • Require removal and replacement of assigned personnel.
        • Withhold payment for services not satisfactorily performed.
        • Issue a written Notice to Cure.
        • Suspend or reduce future work assignments.
        • Terminate the Contract for default in accordance with the Contract.

        Nothing contained herein shall limit any other rights or remedies available to Fresno Housing under the Contract or applicable law.

      Service Requirements

      The Contractor shall perform services including, but not limited to:

      • Maintain a highly visible security presence throughout the assigned shift.
      • Patrol the property on foot and observe for suspicious or criminal activity.
      • Monitor for trespassing, loitering, vandalism, theft, illegal dumping, drug activity, unauthorized camping, and other prohibited activities.
      • Deter criminal activity through active presence and professional engagement.
      • Respond promptly to disturbances and security concerns.
      • Utilize conflict de-escalation techniques whenever appropriate. Use only the level of force authorized by California law and Contractor policy. All use-of-force incidents shall be immediately reported to Fresno Housing. 
      • Contact law enforcement, fire department, EMS, or other emergency responders when necessary.
      • Report emergencies immediately to Fresno Housing's designated representative.
      • Inspect all common areas, laundry facilities, community areas, parking areas, walkways, stairwells, and landscaped areas.
      • Check vacant units for evidence of forced entry, vandalism, unauthorized occupancy, or safety hazards.
      • Report maintenance concerns presenting immediate health or safety risks.
      • Secure gates, doors, or common areas if found unsecured and notify Fresno Housing.
      • Assist in maintaining a safe environment for residents, visitors, and staff.
      • Cooperate with law enforcement and emergency responders as necessary.

      The contractor must meet the following service requirements:

      1. Availability
        • Contractor shall maintain the operational capability to provide services twenty-four (24) hours per day, seven (7) days per week, including holidays, upon request by Fresno Housing.
        • Contractor must provide a dedicated point of contact for coordination and communication with Fresno Housing.
      2. Response Time
        • Immediate response to emergency situations and alarm activations.
        • Non-emergency service requests shall be scheduled and performed within the timeframes established by Fresno Housing.
      3. Training and Certification
        • All security personnel must undergo background checks and drug testing.
        • Personnel must receive ongoing training in security protocols including fair housing awareness, customer service, conflict de-escalation, emergency response, and report writing.
        • Contractor must provide documentation of training and certification for all personnel.
      4. Equipment and Technology
        • Contractor must provide all necessary equipment, including uniforms, communication devices, and patrol vehicles.
        • Surveillance and monitoring technology must be up-to-date and properly maintained.
        • Contractor must ensure that all equipment is in good working condition and complies with industry standards.
        • Contractor shall be solely responsible for repair, replacement, and maintenance of all Contractor-furnished equipment.
      5. Quality Assurance
        • Regular performance evaluations and audits to ensure service quality and compliance.
        • Implementation of corrective actions for any identified deficiencies or areas for improvement.
        • Contractor must provide a mechanism for Fresno Housing to provide feedback and address any concerns
        • Fresno Housing reserves the right to conduct periodic performance reviews and accompany patrol personnel during inspections.

      Delivery Requirements

      The contractor must adhere to the following delivery requirements:

      1. Initial Setup
        • Prior to providing services, the Contractor shall coordinate with Fresno Housing regarding property-specific security procedures, reporting requirements, emergency contacts, and access protocols.
        • Develop and implement a customized security plan based on the assessment findings.
        • Coordinate with Fresno Housing management to ensure a smooth transition and setup.
      2. Ongoing Services
        • Provide continuous security services as specified in the contract.
        • Maintain open communication with Fresno Housing management to address any changes or updates in service requirements.
        • Ensure that all security personnel are briefed on property-specific protocols and procedures.
      3. Incident Reporting
        • Immediate notification to Fresno Housing management of any significant incidents or emergencies.
        • Critical incidents shall be reported immediately by telephone, followed by a written report within twenty-four (24) hours of the occurrence.
        • Regular updates on the status of ongoing investigations or security concerns.
      4. Monthly Reporting
        • Submission of monthly summary reports detailing security activities, incident trends, response statistics, and recommendations.
        • Reports must be submitted by the 5th of each month for the previous month's activities.
        • Contractor must be available to discuss the reports and address any questions or concerns from Fresno Housing management.
      5. Emergency Response
        • When requested by Fresno Housing and when personnel are available, the Contractor shall provide additional security personnel for emergencies or special events. 
        • Coordination with local law enforcement and emergency services as needed.
        • Provision of support and assistance to Fresno Housing residents and staff during emergencies.
      6. Confidentiality
        • The Contractor and its personnel shall maintain the confidentiality of all information obtained while performing services for Fresno Housing. Information regarding residents, applicants, employees, security procedures, surveillance systems, investigations, or incidents shall not be disclosed except as authorized by Fresno Housing or required by law. 

             G. Keys, Access Credentials, and Security Devices 

        • Fresno Housing may issue the Contractor or its assigned personnel keys, master keys, key cards, electronic access credentials, gate transmitters, alarm codes, lock combinations, access devices, parking permits, or other security-related equipment necessary to perform services under this Contract.

          The Contractor shall be solely responsible for the custody, safeguarding, accountability, and proper use of all such items issued by Fresno Housing. The Contractor shall establish and maintain written procedures to control the issuance, tracking, storage, return, and replacement of all keys and access credentials assigned to its personnel.

          The Contractor shall ensure that:

          • Keys, access credentials, alarm codes, and security devices are used only for purposes authorized by Fresno Housing.
          • Access credentials are not duplicated, copied, shared, loaned, transferred, or provided to any unauthorized person.
          • All issued keys, access devices, and security equipment remain under the direct control of authorized Contractor personnel.
          • Any employee whose assignment ends or who is removed from the Contract immediately returns all issued keys, access credentials, identification badges, and security devices to the Contractor.
          • All Fresno Housing-issued property is returned immediately upon request or upon expiration or termination of the Contract.

          The Contractor shall immediately notify Fresno Housing upon discovery of any lost, stolen, missing, duplicated, compromised, or unauthorized use of any key, access credential, alarm code, security device, or other Agency-issued property.

          The Contractor shall fully cooperate with Fresno Housing in investigating any loss or compromise involving Agency security systems or access credentials and shall provide all information reasonably requested by Fresno Housing.

          Fresno Housing reserves the right to require immediate replacement of locks, keys, access credentials, alarm codes, or other security devices if deemed necessary to protect Agency property, residents, staff, or operations. To the extent the loss or compromise resulted from the Contractor's negligence or failure to comply with the requirements of this Contract, the Contractor may be responsible for the reasonable costs associated with replacement, rekeying, or reprogramming, subject to the terms of the Contract and applicable law.

               H. Additional Services- Optional Work

        • Fresno Housing may request additional security services including special event security, vacancy watches, construction site security, emergency response, after-hours escorts, access control, or other related security services within the general scope of this Contract. Compensation shall be in accordance with the Contractor's awarded pricing.

      Fresno Housing reserves the right to modify the scope of work as needed to address changing security needs and priorities. The contractor must be flexible and responsive to any such modifications.

    • Site Assessment

      Contractors are encouraged to familiarize themselves with the general nature of Fresno Housing properties prior to submitting a bid. Property-specific orientations, post orders, access procedures, and security requirements will be provided by Fresno Housing prior to commencement of services under each Work Order or Task Order.

        • Section 16.5.A, Required Efforts.  Consistent with Presidential Orders 11625, 12138, and 12432, the Agency shall make every effort to ensure that small businesses, MBEs, WBEs, and labor surplus area businesses participate in Agency contracting.
        • Section 16.5.B, Goals.  The Agency is encouraged to establish goals by which they can measure the effectiveness of their efforts in implementing programs in support of contracting with disadvantaged firms.  It is important to ensure that the means used to establish these goals do not have the effect of limiting competition and should not be used as mandatory set-aside or quota, except as may otherwise be expressly authorized in regulation or statute.  Some localities have adopted minority contracting set-aside policies or geographic limitations, which may be in conflict with Federal requirements for full and open competition.
    • Required HUD Forms and Documents

      Contractors are to download and completed all required HUD forms indicated in the solicitation and contracting process. All HUD Forms are available at https://www.hud.gov/hudclips. All forms may not be modify without written HUD approval from the Assistant Secretary for Public and Indian Housing.

    • Performance Bond

      The performance bond is meant to ensure that the contract is successfully completed. The performance bond guarantees that if the Contractor is unable to complete the contract, the surety company will step in to finish the work. In the case of a letter of credit or cash escrow, the Agency may use these funds to complete the contract work.

    • Exterior of Sealed Proposal Package

      The package exterior must clearly denote the above noted IFB number and must have the proposer’s name and return address. Proposals received after the published deadline will not be accepted.

    • Business License

      Provide proof of California Business License, General Liability, Auto-Insurance, Worker’s Compensation, Other Liability Insurance and Bid Guarantee equivalent to 5% of the bid price and one of the following: Performance and payment bond for 100% of the contract price; separate payment and performance bond each for 50% or more of the contract price; 20% cash escrow; or 25% irrevocable letter of credit.

    • Performance Standards

      The Contractor shall perform all services in accordance with the performance standards established by Fresno Housing. Failure to meet these performance standards may result in corrective action, withholding of payment for services not performed, issuance of a Notice to Cure, termination for default, or other remedies available under the Contract.

      At a minimum, the Contractor shall meet the following performance standards:

      Emergency ResponseSecurity personnel shall respond to emergency service requests within sixty (60) minutes, unless otherwise directed by Fresno Housing.
      Incident ReportingWritten incident reports shall be submitted to Fresno Housing within twenty-four (24) hours of the incident, unless immediate reporting is otherwise required.
      Critical Incident NotificationContractor shall immediately notify Fresno Housing and, when appropriate, emergency responders of any critical incident involving life safety, criminal activity, significant property damage, or other emergencies.
      Complaint ResponseContractor shall acknowledge complaints or service concerns within one (1) business day and provide a corrective action plan upon request.
      Personnel ReplacementContractor shall replace any security officer deemed unacceptable by Fresno Housing immediately when required for safety or security reasons, and within twenty-four (24) hours for all other approved replacement requests.
      Professional ConductSecurity personnel shall maintain professional appearance, conduct, and compliance with all Contractor policies, BSIS requirements, and Fresno Housing policies while performing services.
      Licensing ComplianceContractor shall maintain all required business licenses, BSIS licenses, insurance, and certifications throughout the Contract term.
      DocumentationDaily activity logs, patrol verification records, and other required documentation shall be accurate, complete, and submitted in accordance with Contract requirements.
      Performance ReviewFresno Housing reserves the right to conduct periodic performance evaluations and contract compliance reviews throughout the Contract term. Contractor shall cooperate with all reviews and implement corrective actions when requested.
    • General Liability Insurance

      An original certificate evidencing General Liability coverage, naming the Agency as an additional insured, together with the appropriate endorsement to said policy reflecting the addition of the Agency as an additional insured under said policy (minimum of $1,000,000 each occurrence, general aggregate minimum limit of $2,000,000, together with damage to premises and fire damage of $50,000 and medical expenses any one person of $5,000), with a commercially reasonable deductible (e.g. “commercially reasonable,” meaning at least 1% of the “general aggregate minimum” of the policy, with a maximum deductible amount of $50,000;

    • More than One Award Possible

      The Agency reserves the right to complete award to one firm only or to complete award to multiple firms.  If award is made to more than one firm, such awards will be based on the Agency’s opinion that a firm can offer the Agency greater value for a certain service area as detailed within the scope of work.  The Agency reserves the right to make such decision at any time during the ensuing contract period(s) meaning, the Agency could initially make award to one firm only, then, at any time during the ensuing contract period(s), decide to make an additional award(s) if the Agency decides such is in its best interests to do so.

    • Protest

      An aggrieved bidder shall have three (3) business days after the date of issuance of the notice of intent to award, or notice of respondents selected to advance to a tier of competition, to submit to the CF, a written protest of the matter described in the award. The written protest must specify the grounds upon which the protest is based demonstrate the basis for the protestor’s status as an aggrieved bidder.

      A bidder is an aggrieved bidder only if the person or entity is one to whom a notice of selection of a competitive tier or notice of an intent to award has been, or should have been, sent and such person or entity has been erroneously denied the award of a Contract or has been erroneously eliminated from contract because:

      • All higher-ranked bidders were non-responsive or all higher ranked bidders clearly failed to meet the Standards of Responsibility;
      • The evaluation of bids was not conducted in accordance with the criteria or processes described in the Solicitation documents;
      • The evaluator abused his or her discretion in disqualifying the protestor’s bid as Nonresponsive or as failing to meet the Standards of Responsibility; or
      • The evaluation of bids or subsequent determination of award was otherwise made in violation of the Public Contracting Code or the Agency’s Public Contracting Rules.

      The COO, or other person so delegated by the Agency’s Executive Director, shall consider a written protest and issue a written decision on the protest. The COO may not consider a protest that is filed in an untimely manner or that fails to allege facts that would support a finding that the protestor is an aggrieved bidder. This decision may be appealed to the Agency’s Board of Commissioners by providing a written appeal to the Executive Director within three (3) business days after the date on which the COO sends his or her decision to the bidder’s postal address specified in the written protest. The decision of the Board, or if no timely appeal to the Board is made, the decision of the COO shall be the final decision of Agency on the protest.

    • IMPORTANT NOTICE! Entry of Proposed Fees.

      Except as provided for otherwise, bidders must submit a realistic cost for each and every Pricing Item detailed within the preceding Table. The eProcurement Portal will automatically perform all required calculations.

      1. Realistic Cost for each Pricing Item.
        Each bidder is strongly encouraged to enter, where provided within the eProcurement Portal a realistic cost for the Pricing Item. For example, if a bidder enters what the Agency deems to be an unrealistic sum such as $20,000 Pricing Item, then the $20,000 is what the successful bidder will charge the Agency to complete all of the requested security services that the Agency has listed herein. Accordingly, it is the Agency’s opinion that it is very much in the best interests of the bidder to propose a realistic firm-fixed fee for the Pricing Item. If, despite this warning, the successful bidder proposes a fee that the Agency deems is not realistic, then the Agency reserves the right to declare that the bidder is non-responsive, and the Agency may reject the bidder’s offer
        1. Review of the Entry of Proposed Fees.
          After a bidder has entered where provided within the eProcurement Portal his/her proposed unit costs for the Pricing Items, the Portal will automatically multiply the proposed firm-fixed fee that the Agency has published. The Agency strongly recommends that each bidder, after the entry of these proposed fees within the eProcurement Portal, print the receipt provided and review the entry to ensure that the bidder has entered the proposed fees correctly (the Portal will allow the bidder to immediately re-enter the Portal at any time prior to the posted deadline to correct any such entry). The bidder will NOT be able to correct this entry after the posted deadline has expired, which means that the Agency will utilize such entry, correct or incorrect, to determine the apparent low bidder
        2. No Post-submittal Deadline Corrections Allowed.
          The Agency WILL NOT, after the submittal deadline, negotiate an increase to any unit costs or fees proposed prior to the submittal deadline; accordingly, bidders are strongly cautioned to submit a realistic price for the Pricing Items.
    • Price Escalation of Firm-Fixed Fees

      There shall be no escalation of the proposed firm-fixed fee amounts proposed and awarded at any time during the ensuing contract periods (except for, as designated by HUD, appropriate Agency-approved change orders awarded for “unforeseen conditions” within the general scope of work). Prices shall remain firm during the initial contract term unless otherwise provided in the Contract. Adjustments during any renewal period shall only occur if expressly authorized by the Contract and approved in writing by Fresno Housing. 

    • Standards and Compliance

      Contractor shall immediately notify Fresno Housing of any suspension, expiration, revocation, investigation, or disciplinary action affecting the Contractor's security license or any assigned officer's required licensing.

      Federal Funding Requirements

      This Contract may be funded in whole or in part with federal funds administered by the U.S. Department of Housing and Urban Development (HUD). The Contractor shall comply with all applicable federal statutes, regulations, executive orders, HUD requirements, and all contract provisions incorporated into this solicitation and resulting Contract, including but not limited to 2 CFR Part 200, 24 CFR Part 85 (or successor regulations, as applicable), and all other applicable federal requirements.

      Prevailing Wage Applicability

      Fresno Housing owns and manages properties funded through various federal, state, and local funding sources. As a result, labor standards applicable to work performed under this Contract may vary depending on the property, funding source, program, or specific work assignment.

      Fresno Housing will identify within each Work Order, Task Order, Service Request, or other written authorization whether California Prevailing Wage, HUD Maintenance Wage Rates, Davis-Bacon and Related Acts, or other applicable labor standards apply to the requested services.

      The Contractor shall comply with all applicable labor standards identified by Fresno Housing for the assigned work, including payment of required wages, submission of certified payroll records or other labor compliance documentation, and compliance with all applicable federal, state, and local labor laws and reporting requirements.

      When labor standards are applicable, compensation shall be based upon the Contractor's awarded pricing for the applicable labor classification. When labor standards do not apply, compensation shall be based upon the Contractor's awarded standard pricing.

    • Assistance to Small and Other Business, Required Efforts

      Within our Agency Procurement Policy, it states that our Agency will:

      • Include such firms, when qualified, on solicitation mailing lists;
      • Encourage their participation through direct solicitation of bids or proposals whenever they are potential sources;
      • Divide total requirements, when economically feasible, into smaller tasks or quantities to permit maximum participation by such firms;
      • Establish delivery schedules, where the requirement permits, which encourage participation by such firms;
      • Use the services and assistance of the Small Business Administration, and the Minority Business Development Agency of the Department of Commerce;
      • Include in contracts, to the greatest extent feasible, a clause requiring contractors, to provide opportunities for training and employment for lower income residents of the project area and to award subcontracts for work in connection with the project to business concerns which provide opportunities to low-income residents, as described in 24 CFR Part 75 (so-called Section 3 businesses); and
      • Require prime contractors, when subcontracting is anticipated, to take the positive steps listed above. 
    • Payment Bond

      The payment bond is a method of ensuring that the Contractor pays the subcontractors and suppliers. By requiring payment bonds, the Agency avoids becoming entangled in disputes concerning payment of subcontractors and suppliers by the general contractor. The surety underwriting the payment bond ensures the contractors and suppliers will be paid. Often, performance and payment bonds are combined into a single document. Failure to pay subcontractors for work performed in commercial contracts may often lead to the subcontractor filing a mechanic’s lien against the property owners to obtain payment for services rendered. The Agency contract requires the payment bond to prevent this problem and ensure that no lien will be filed against any Agency building or lot of ground. As a reminder, Clause 24 of form HUD-5370, General Conditions of the Contract for Construction (Attachment G-1 attached hereto) clearly forbids the placement of any liens and is binding on any contractor, subcontractor, and material supplier.

    • HUD Forms

      Please note that the Agency has no legal right or ability to (and will not) at any time negotiate any clauses contained within ANY of the HUD forms included as a part of this IFB.

    • Professional Liability Insurance

      An original certificate showing the proposer's professional liability and/or "errors and omissions" coverage (minimum of $1,000,000 each occurrence, general aggregate minimum limit of $2,000,000), with a commercially reasonable deductible (e.g., “commercially reasonable,” meaning at least 1% of the “general aggregate minimum” of the policy, with a maximum deductible amount of $50,000;

    • Submission Conditions

      Do not fold or make any additional marks or notations on the documents to be submitted.  Bidders are not allowed to change any requirements or forms contained herein, either by making or entering onto these documents or the documents submitted any revisions or additions; and if any such additional marks, notations or requirements are entered on any of the documents that are submitted to the Agency by the proposer, such may invalidate that proposal.  If, after accepting such a proposal, the Agency decides that any such entry has not changed the intent of the proposal that the Agency intended to receive, the Agency may accept the proposal and the proposal shall be considered by the Agency as if those additional marks, notations or requirements were not entered on such.  By accessing the noted Internet System, registering and downloading these documents, each prospective bidders that does so is thereby agreeing to confirm all notices that the Agency delivers to him/her as instructed, and by submitting a bid, the bidder is thereby agreeing to abide by all terms and conditions published herein and by addendum pertaining to this IFB.

    • Required Licensing

      The Contractor(s) shall be in possession of any current appropriate licensing that may be required by the County of Fresno (and/or, if applicable, any city jurisdiction therein in which work will be performed) and/or the State of California. The Contractor shall be duly licensed in accordance with the State of California, and will eventually be required to provide the Agency proof of such current licensing.

    • Automobile Insurance

      An original certificate showing the proposer’s automobile insurance coverage in a combined single limit of $1,000,000.  For every vehicle utilized during the term of this program, when not owned by the entity, each vehicle must have evidence of automobile insurance coverage with limits of no less than $50,000/$100,000 and medical pay of $5,000.

    • Assignment of Personnel

      The Agency shall retain the right to demand and receive a change in personnel assigned to the work if the Agency believes that such change is in the best interest of the Agency and the completion of the contracted work.

    • Bonding Companies

      An acceptable surety (bonding) company is one that is authorized to do business in the State of California and is acceptable to HUD and the Agency. The surety must be listed on the most recently published U.S. Treasury Circular 570 (often referred to as the T-List). Individual sureties are not permitted. Circular 570 is available from the U.S. Department of the Treasury, Financial Management Service, Surety Bond Branch, Room #262C, 401 14th Street, S.W., Washington, D.C. 20227. The T-List may also be accessed on the Internet at: https://www.fiscal.treasury.gov/surety-bonds/circular-570.html.

    • Submission Responsibilities

      It shall be the responsibility of each bidder to be aware of and to abide by all dates, times, conditions, requirements and specifications set forth within all applicable documents issued by the Agency, including the IFB document, and any addenda and required attachments submitted by the proposer.  By virtue of completing, signing and submitting the completed documents, the proposer is stating his/her agreement to comply with all conditions and requirements set forth within those documents.  Written notice from the bidder not authorized in writing by the CF to exclude any of the Agency requirements contained within the documents may cause that proposer to not be considered for award.

    • No Deposits/No Retainers

      The Agency will NOT pay any deposits or retainer fees as a result of award of the ensuing contract (such is not allowed per relevant HUD regulation).  This means that the Agency will pay the successful proposer(s) for actual services provided only.

    • Local Contracts During Guarantee Period

      Subcontractors whose home office is outside the County of Fresno shall retain the services of appropriate specialty contractors located within Fresno County for repairs and/or adjustments required under the guarantees.  All such contractors must be approved by the Agency.  At the option of the Agency, such contracts shall be assigned to the Agency.

    • Prior Agency Approval Required

      Please note that the successful bidder shall NOT conduct any additional work without the prior written authorization of the Agency representative. Failure to abide by this directive shall release the Agency of any obligation to pay the successful bidder for any work conducted without the noted prior written authorization.

    • Unauthorized Sub-Contracting Prohibited

      The successful bidder shall not assign any right, nor delegate any duty for the work proposed pursuant to this IFB (including, but not limited to, selling or transferring the contract) without the prior written consent of the CF.  Any purported assignment of interest or delegation of duty, without the prior written consent of the CF shall be void and may result in the cancellation of the contract with the Agency, or may result in the full or partial forfeiture of funds paid to the successful proposer as a result of the proposed contract; either as determined by the CF.

    • City/County Business License

      If applicable, a copy of the proposer’s business license allowing that entity to provide such services within the City or County of Fresno.

    • Davis Bacon Federal Wage Rates and/or HUD Maintenance Wage Rates and/or State Prevailing Wage Rates

      Fresno Housing may issue work assignments under this Contract that are subject to California Prevailing Wage, HUD Maintenance Wage Rates, Davis-Bacon and Related Acts, or other applicable labor standards, depending on the property, funding source, or nature of the work.

      Bidders shall submit pricing as required in the Pricing Proposal. Fresno Housing will identify the applicable labor standard requirements in each Work Order, Task Order, or Service Request. The Contractor shall comply with all labor standards identified by Fresno Housing for the assigned work.

      As detailed within pertinent HUD and Federal regulations, the Contractor shall comply with either Federal Davis-Bacon Wage Rates (for all “construction contracts in excess of $2,000”), California Prevailing Wage Rates and/or Maintenance Wage Rates. Where difference exist, the higher wage rate shall apply. When labor standards are applicable, the Contractor shall comply with the labor standards identified by Fresno Housing for the applicable Work Order, Task Order, funding source, or project. 

      Pursuant to California Labor Code, Section 1771, 1774-1776, 1777.5, 1813 and 1815, the general prevailing wage rates for this project are those published by the Director of the Department of Industrial Relations for Fresno County, available at at the California Department of Industrial Relations website https://www.dir.ca.gov. The applicable wage determinations are those in effect at the time of advertisement for bids.  Prevailing Wage (ca.gov).

      The applicable Wage Rates pertaining to the work detailed herein are available at Wage Determinations | SAM.gov. These regulations can be found in the Title 29CFR, www.ecfr.gov/current/title-29. This work will be subject to all the requirements pertaining to Davis-Bacon work, including the applicable Federal forms and procedures (i.e., on-site interviews; certified payrolls; etc.).  

    • Communication

      The Agency shall be the primary on-site point of contact for the Contractor pertaining to this work. The Contractor shall be free to converse and communicate with the Agency during or between visits; however, Fresno Housing shall designate an Agency Representative responsible for coordinating services under this Contract. All requests for changes in scope, staffing, scheduling, or service locations shall be submitted to the designated Agency Representative for approval. The Agency anticipates that it will typically make a decision in such matters within 3 work days of receipt, though such response time-frame may be shorter or longer depending on the situation; accordingly, the Contractor shall be required to submit such written requests in as timely a manner as reasonably possible. When construction commences, all communication must be directed to the designated Agency contact person only.

    • State Business License

      If applicable, a copy of the proposer's license issued by the licensing authority allowing the proposer to provide the services detailed herein.

    • Notice of the Contractor

      Notice to the Contractor shall be issued to the Contractor by the Agency for any violation of the contract documents.  Failure to make corrections as specified shall result in the delay of funds for that portion of the work for which correction is required.

    • Work Standards

      It is the responsibility of the Contractor to ensure that each worker provided by the Contractor shall be fully trained and qualified to provide any assigned work. Accordingly, all work provided shall be guaranteed by the Contractor to be performed in a workmanlike manner and in accordance with all applicable laws, codes, and/or regulations, including those issued by, but not limited to, the County of Fresno (and/or, if applicable, any city jurisdiction therein in which work will be performed), and/or the State of California, or any applicable Federal Agency. Smoking is prohibited within the building and within the building property boundaries.

    • Profile of Firm Form

      The requested related information shall also be entered where provided for on the Profile of Firm Form (DO NOT ATTACH or SUBMIT COPIES WITHIN THE PROPOSAL SUBMITTAL--we will garner the necessary certificates from the successful proposer prior to contract execution).

    • Cyber Liability Insurance

      If the Contractor utilizes electronic reporting systems, mobile reporting applications, cloud-based data storage, surveillance technology, access control systems, or otherwise collects, stores, transmits, or maintains Fresno Housing information electronically, the Contractor shall maintain Cyber Liability Insurance covering data breaches, cyber incidents, network security liability, privacy liability, and costs associated with notification, credit monitoring, data restoration, and regulatory defense.

    • Employee Dishonesty/Fidelity Coverage

      The Contractor shall maintain Employee Dishonesty (Fidelity) Insurance covering losses arising from fraudulent or dishonest acts committed by the Contractor's employees. Such coverage shall include, at a minimum, theft, burglary, forgery, misappropriation of property, unauthorized use of keys, access credentials, security devices, or other property belonging to Fresno Housing, its residents, employees, or visitors.

    • Additional Requirements

      The Contractor shall immediately notify Fresno Housing of any cancellation, material modification, or non-renewal of any required insurance coverage. Evidence of insurance shall be provided upon request and maintained throughout the Contract term.

    • Key and Access Credential Responsibility

      The Contractor shall be responsible for all keys, key cards, access credentials, alarm codes, gate transmitters, and other security devices issued by Fresno Housing. The Contractor shall maintain appropriate internal controls for the issuance, safeguarding, return, and replacement of such items. The Contractor shall immediately notify Fresno Housing of any lost, stolen, or compromised key or access credential and shall be responsible for any costs incurred as a result of the Contractor's failure to adequately safeguard such items, to the extent permitted by law and the Contract.

    • Contractor Vehicles and Access for Emergency Vehicles

      The Contractor vehicles shall not block fire lanes, emergency access routes, ADA parking, resident access, or Agency operations.

    • Safety

      It shall be the responsibility of the Contractor to ensure, at all times during the performance of the work, to the maximum extent feasible, to protect the safety of Agency residents and staff, the Contractor's staff, and subcontractors, and the public. This shall include, but not be limited to, compliance with all OSHA-related Federal and local laws, codes, and regulations.

    • Working Hours

      Services shall commence upon issuance of a written Work Order, Task Order, Service Request, or other written authorization by Fresno Housing.

    • Contractor-Furnished Equipment- Tools/Equipment/Materials

      The Contractor shall furnish, maintain, and replace, at its sole expense, all personnel, equipment, supplies, uniforms, vehicles, communication devices, technology, and other resources necessary to perform the services required under this Contract, unless otherwise specifically provided by Fresno Housing.

      At a minimum, Contractor-furnished equipment shall include, as applicable:

      • Uniforms and visible company identification for all assigned security personnel.
      • Portable two-way radios, cellular telephones, or other reliable communication devices necessary to maintain continuous communication between security personnel, Contractor dispatch, and Fresno Housing when required.
      • Clearly identifiable patrol vehicles, when mobile patrol services are requested, maintained in safe operating condition and equipped with appropriate emergency and communication equipment.
      • Flashlights, reflective safety vests, first aid kits, and other standard security equipment appropriate for the assigned services.
      • Electronic reporting systems, guard tour verification systems, GPS tracking, or other approved technology necessary to document patrols, incidents, and service activities, when required by Fresno Housing.

      The Contractor shall ensure all equipment is maintained in safe working condition and replaced promptly if damaged, defective, or otherwise unsuitable for service. Fresno Housing shall not be responsible for providing equipment, vehicles, uniforms, communication devices, fuel, maintenance, or supplies necessary for the Contractor to perform the services required under this Contract.

    • Payroll Reports

      Certified payroll records shall only be required when prevailing wage, Davis-Bacon, or other applicable labor standards are identified by Fresno Housing for the applicable work assignment.

    • Request for Payment

      The Contractor shall submit invoices for services performed in accordance with the Contract and the applicable Work Order, Task Order, or Service Request. Unless otherwise approved by Fresno Housing, invoices shall be submitted monthly for services completed during the preceding billing period.

      Each invoice shall include, at a minimum:

      • Contractor name and invoice number.
      • Invoice date.
      • Fresno Housing Work Order, Task Order, or Service Request number (if applicable).
      • Property name and/or service location.
      • Dates and times services were performed.
      • Name or identification number of each assigned security officer.
      • Type of service provided (e.g., on-site security, mobile patrol, alarm response, emergency response, special event security).
      • Total hours worked by each security officer.
      • Applicable hourly billing rate(s), including standard or prevailing wage rates, as applicable.
      • Total amount due for the billing period.
      • Supporting documentation requested by Fresno Housing, including daily activity logs, incident reports, patrol verification reports, or other documentation necessary to verify services performed.

      When applicable, invoices shall also include all certified payroll records and other labor compliance documentation required by the applicable funding source, prevailing wage requirements, HUD Maintenance Wage Rates, Davis-Bacon labor standards, or other applicable laws and regulations.

      Payment shall be made only for services satisfactorily performed and accepted by Fresno Housing in accordance with the Contract. Fresno Housing reserves the right to withhold payment for services not performed, inadequately performed, or lacking the required supporting documentation.

    Submission Requirements

The proposer/bidder acknowledges that if any information is determined by the Agency to be false, misleading, or inaccurate, the Agency may reject the proposal/bid, decline to award a contract, or cancel any resulting award.
