For a non-refundable fee of Forty-Nine Dollars ($49), interested firms may request and receive an Electric Download of the Bidding Documents. 2. For a non-refundable fee of Forty-Nine Dollars ($49), interested firms may request and receive a CD with electronic copies of the Bidding Documents. If the CD is to be shipped, the Bidder must furnish Avalon with the Bidder’s active UPS or Federal Express account number or pay Avalon for all shipping and handling costs. 3. For a non-refundable fee, printed copies of the Bidding Documents may be obtained from the Avalon Plan room. If the documents are to be shipped, the Bidder must furnish Avalon with the Bidder’s active UPS or Federal Express account number or pay Avalon for all shipping and handling costs. The Bidding Documents must be obtained through the Avalon Plan room in order to be considered a Plan Holder of record. Bidding Documents obtained from any other source are for examination only, are not considered complete and are not valid for bidding purposes. Bidding Documents also may be examined online through internet-based construction information subscription services. The date that the Bidding Documents are transmitted by the Issuing Office will be considered the Bidder’s date of receipt of the Bidding Documents. Partial sets of Bidding Documents will not be available from the Issuing Office. The City of Geneva will not be responsible for full or partial sets of Bidding Documents, including Addenda if any, obtained from sources other than the Issuing Office. Each bidder must deposit with his bid, security in an amount not less than five percent (5%) of the amount of the bid in the form and subject to the conditions set forth in the instructions to bidders. Upon acceptance of his bid, if the successful bidder fails to enter into a contract pursuant to the requirements of the City, then the check deposited as aforesaid and the money standing to the credit of the same shall be forfeited to the City as liquidated damages or the payment of the bound enforced for the benefit of the City. No bidder may withdraw his bid within sixty (60) days after the date set for opening thereof but may withdraw it at any time prior to closing item for the receipt of bids. Bidders shall not include sales and compensating use taxes on the cost of materials which are to be incorporated into this project. All work under this contract shall comply with all applicable ordinances, regulations, laws and with all rules of the State of New York Department of Labor. The City reserves the right to waive any informality in, or reject any or all bids, or to make an award to other than the low bidder.
