    Description

    The Town of Hingham is accepting sealed bids for the purchase of lights and poles for the Station Street Parking Lot located at 0 Station Park Street, Hingham, MA 02043, pursuant to C.30 B.

     

    The Hingham Municipal Light Plant in coordination with Hingham Department of Public Works will be responsible for installation.

     

    The Town Administrator and/or Select Board will act as the Awarding Authority for this IFB. 

     

    The Town of Hingham reserves the right to reject any or all bids if it is found to be in the Town’s best interest. The Town of Hingham also reserves the right to waive any minor informalities.

      The Town of Hingham is accepting electronic bid submissions. Bidders shall create a FREE account with OpenGov Procurement by signing up at https://procurement.opengov.com/signup. Once you have completed account registration, browse back to this page, click on "Draft Response", and follow the instructions to submit the electronic bid.

       

      All bids that are not submitted through the OpenGov Portal will be deemed not acceptable by the Town

    • Hingham Terms and Conditions - Sample Agreement

      A sample agreement is posted in the Attachments Section of this IFB.  The successful bidder must sign the Town's Agreement in order to perform the work.  NOTE: Certificate of Insurance will be required from the awarded bidder with the Town of Hingham additional insured.

    • Scope of Supplies and Services

      See the Attachments Section for the product specifications provided by the manufacturer. 

      Areas that are highlighted in yellow are the required pole specifications. 

    • Installation

      Hingham Municipal Light Plant will be responsible for installation of the lights and poles. 

    • Reserved Rights

      The Town of Hingham reserves the right to:

      1. Cancel this IFB at any time, with or without notice to prospective bidders. Reasonable efforts will be made to give timely notice.

      2. Accept or reject, in whole or in part, any and all bids as permitted by law.

      3. Award contracts as it deems best serves the interests of the Town of Hingham.

      4. Waive or adjust non-statutory bid requirements before or after bids are opened in whatever ways it deems best serves the interests of the Town of Hingham, while also being non-prejudicial to the interests of fair competition.

      5. Terminate the resulting Agreement at any time for convenience and without cause upon thirty (30) days prior written notice to the other party. 

       

      The Awarding Authority reserves the right to reject any and/or all bids, waive minor informalities and award the contract in the best interest of the Town

    • Record Keeping

      The Contractor shall make, and keep, at least six (6) years after final payment, books, records, and accounts which, in reasonable detail, accurately and fairly reflect the transactions and dispositions of the Contractor, and until the expiration of six (6) years after final payment, the Office of the Inspector General, and the Deputy Commissioner of Capital Planning and Operations shall have the right to examine any books, documents, papers or records of the Contractor or of his/her Subcontractors that directly pertain to, and involve transactions relating to the Contractor of his/her Subcontractors.

    • Tax Compliance

      Any company contracting with a municipality must certify that they have complied with all Tax Laws of the Commonwealth of Massachusetts, as provided with the Massachusetts General Laws, Chapter 62C, Section 49A. See Vendor Section. 

    • Method of Award - Lowest Responsible, Responsive Bid

      The award will be made to the responsible, responsive bidder submitting the lowest total bid price.

    • Addenda

      No interpretation of the meaning of the plans, specifications or other pre-Bid documents will be made to any Bidder orally. All information given to Bidders other than by means of the plans, specifications, or by addenda, as described below, is given informally and shall not be used as the basis of a claim against the Owner.

      Documents which, when issued, will be posted on the Town’s e-Procurement Portal no later than 48 hours before Wednesday, April 22, 202611:00 am. Notification of a newly posted document will be emailed to all registered bidders who are following the bid by clicking on “Follow” on the bid posting. Failure of any Bidder to receive any such addendum or interpretation shall not relieve such Bidder from any obligation under this bid as submitted. All addenda so issued shall become part of the Contract Documents.

    • Owner/Town/Awarding Authority

      Where the term Owner and/or Awarding Authority is used in these Specifications, and other Contract Documents, same refers to the ("Town") Town of Hingham, Massachusetts.

    • Warranty

      The bidder shall honor the standard manufacture warranty. 

    • Rule for Award

      An award will be made to the responsible, responsive bidder offering the lowest price (subject to the Town’s budget appropriation). 

    • Payment Method

      The awarded contractor shall invoice the Town upon delivery of supplies.

    • Timeframe of Award

      All bid prices submitted in response to this IFB must remain firm for 30 (thirty) days following the bid opening or until a contract is executed, whichever occurs first.

    • Addenda

      The Town may, during the bidding period, advise the Bidders by posted and published addenda of additions, omissions, or alterations in the Specifications and drawings. All such changes shall become a part of the contract and shall be included in the work covered by the bid.

       

      Failure to acknowledge any addenda may result in disqualification

    • Bidder Questions

      Answers to all questions will be published on the project portal and registered bidders will be notified when answers are published. It is the bidder's responsibility to check the portal for answers to submitted questions.  No other explanation or interpretation will be considered official or binding.

      Failure to request clarification of any inadequacy, omission, or conflict will not relieve the Bidder of any responsibilities under this Bid or subsequent contract.  

    • Sales Tax

      The Town of Hingham and all of its departments are exempt from Massachusetts Sales Tax.  A copy of the Certificate of Exemption is available upon request.

    • Applicable Laws

      In the event of any inconsistencies related to the solicitation, all applicable laws shall control. 

    • Vendor Submissions

      Failure to complete any information and/or documentation may result in vendor disqualification.

      The bidder agrees that upon notice of award as the Contractor, they will within ten (10) business days Saturday, Sunday, and legal Holidays excluded execute a contract in accordance with the terms of this bid and furnish sureties and insurance certificates as outlined in the conditions of this contract. 

      As set forth herein in accordance with these specifications, plans, and conditions, the undersigned agrees to enter into a standard contract form with the Owner’s awarding authority. 

      Subsequent to the award notice and prior to commencement of work, a compulsory contract agreement form with a place for signatures for the Owner authorized awarding agent and the awarded will be signed ratifying and finalizing the contract.

      The Bidder understands that all bids are subject to the applicable laws of the Commonwealth of Massachusetts and Town Bylaws. General Laws. The terms of this contract have been read and fully understood by the person whose signature appears below. By endorsing this contract the Bidder agrees to adhere to the general conditions, plans, and specifications of this contract. The parties agree to comply with the terms and conditions set forth on the preceding pages along with any addenda that may be issued.

      By confirming, the Contractor shall comply with all federal, state and local laws, regulations, bylaws and rules applicable to this Agreement and shall obtain all necessary bonds, licenses, permits and approvals applicable to this Agreement.

      By confirming, the Contractor certifies that the execution of this Agreement and the providing of labor, work and materials hereunder by the Contractor and any third party or subcontractor is and shall be in full compliance with the applicable conflict of interest laws including M.G.L. c. 268A and that there are no existing conflicts of interest which would prohibit the Contractor from providing labor, work and materials hereunder.
