The Department of Public Works and Transportation is seeking surveyors to perform land surveying services on behalf of the Bureau of Engineering and Construction.
1. SCOPE OF WORK – GENERAL.
1.1 It is the intention of these specifications that the Contractor hereunder shall furnish and Baltimore County shall purchase surveying services covered by this contract which the County may require during the period of time specified. A budget of $250,000 per year has been projected for these services.
The following services shall be provided by the surveyor during the term of this agreement:
1.1.1 Topographic Surveys – including traverse, data collection, computations, plotting and editing of the field collected data. A final electronic version in the format of Baltimore County's current version of AutoCAD.
1.1.2 Boundary Surveys – including land record research, deed mosaic, traverse, data collection, computations, boundary worksheet, property corner stakeout and final plat signed and sealed by a Maryland registered Land Surveyor. A final electronic version of the deed mosaic, boundary worksheet and survey plat in the format of Baltimore County’s current version of AutoCAD.
1.1.3 Construction Stakeout – including computations for layout, field stakeout and cut sheet preparation.
1.1.4 Global Positioning System (GPS) Surveys – including "Survey-Grade" mission planning, field data collection, field stakeout and post processing of dual frequency GPS data capable of sub-centimeter accuracy. "Mapping-Grade" mission planning, field data collection, field stakeout and post processing of GPS data capable of sub-meter accuracy. All static GPS data to be submitted in a RINEX format with the field observation log sheets.
1.1.5 3D Digital Scanning – Baltimore County may be requesting specific surveys be performed using 3D digital scanning. Surveyors will be allowed to provide an hourly rate, which would be added to the field crews' rate, to cover the use/rental of the equipment. This fee would be used whether the work was performed using the surveyor "in-house" staff or if a Sub-Surveyor performed the work. Deliverables may be required in an electronic version in the format of Baltimore County’s current version of AutoCAD or Trimble Business Center.
1.2 The work to be done under this contract includes, but is not limited to; the providing of all labor, materials, supervision, equipment, services, maintenance of traffic, incidentals, and all related items necessary to complete the work in accordance with this specification and scope of work for surveying services at various sites within or near the boundaries of Baltimore County, Maryland on a time and materials basis. All items of cost, overhead, and profit are incidental to the contract pay items.
1.3 The County reserves the right to order services that may be required during the said period, and it also reserves the right not to order services bid upon by the Contractor, if it is found that such services are not required by the County during the period covered by this contract.
2. LOCATION OF WORK AND EXISTING CONDITIONS. The work sites are located at various locations within or near the boundaries of Baltimore County, Maryland.
3. WORK HOURS AND DELIVERY OF MATERIALS.
3.1 It shall be the surveyor’s responsibility to see that all tools, equipment and supplies are delivered within or adjacent to the work site as specified by the County. With regard to this contract, the Chief of the Land Survey Division, or his designated representative (hereafter collectively referred to as “the Chief”) shall determine acceptability of all work and/or services performed. If the work and/or services are not acceptable, the Contractor will be called in to review and correct all problem areas without additional cost to the County. Upon notification by the Chief, or his designated representative, the Contractor will effect repairs to deficient work and/or services in accordance with a schedule jointly agreed upon.
3.2 The County reserves the right to make unannounced periodic inspections of the work in progress. Contractor shall contact the Chief, or his designated representative, prior to beginning work at 410-887-3540.
3.3 Permits, licenses, and taxes shall be the responsibility of the Contractor at no additional cost to the County. Licensed surveyors must be licensed in the State of Maryland. Copies of all licensed surveyors licenses must be provided to the Purchasing Division by the successful bidders prior to award of contracts. Any unskilled laborers used as flaggers for maintenance of traffic must be Maryland State Highway Administration certified.
3.4 Contractor shall provide a complete, workmanlike, well executed job in accordance with these specifications and all applicable national and local codes. Any additional code requirements requested by Baltimore County shall be noted within. In cases of conflict between requirements; that requirement which is in compliance with all applicable codes and which is also, in the opinion of Baltimore County, more advantageous to Baltimore County, shall govern.
4.5 It is conditioned that the Contractor complies in all respects with the terms, conditions, and obligations of the agreement and his/her obligations thereunder including the specifications. In cases where delays are clearly not the Contractor’s responsibility (such as scheduling inspections and the like), the Contractor is responsible for notifying the Chief, or his designated representative, for explanation of the delay.
3.6 The County reserves the right to extend the terms and conditions of this contract to any and all other County Agencies requiring these commodities and/or services. A delivery order will be issued against the term contract, confirming the contracted pricing and giving quantity and delivery requirements.
3.7 In the interest of clarification, the following definitions shall apply to this contract:

3.8 The work described in this specification shall be done with the least inconvenience to Baltimore County Government. Vehicle must have egress capabilities at all times. The amount of time that normal operations are interrupted must be kept to an absolute minimum and shall be coordinated with the user agency at 410-887-3540.
3.9 The surveyor is responsible to protect all existing and newly installed work, materials, equipment, improvements, utilities, structures, and vegetation at all times during the course of this contract. Any property or incidentals damage during the course of this contract shall be repaired or replaced to the satisfaction of the Chief, or his designated representative.
4. CHANGES TO THE CONTRACT. The surveyor will notify the Chief, or his designated representative immediately by telephone of any unexpected emergency, subsurface or latent physical condition found; along with the recommendations for dealing with the matter. Any changes found necessary by the County or the surveyor not covered under the original scope of work, specification or drawing(s) shall be jointly agreed upon by the surveyor and the County. Any additional cost on the project must be submitted in writing by the surveyor and an amendment to the purchase order will be issued by the Purchasing Agent covering the change(s) before the work can proceed. The County assumes no responsibility for oral instructions or suggestions. All official correspondence in regard to the specifications should be directed to, and will be issued by the Purchasing Agent.
5. DEBRIS REMOVAL. The surveyor shall be responsible to remove all their debris from the site and clean effected work areas. The surveyor shall keep the premises free of debris and unusable materials resulting from their work and as work progresses; or upon request by a Baltimore County representative, shall remove such debris and materials from County property. The surveyor shall leave all affected areas as they were prior to beginning work.
6. WORK PROCEDURES.
6.1 It shall be the sole responsibility of the surveyor performing services for this contract to safeguard their own materials, tools, and equipment. Baltimore County shall not assume any responsibility for vandalism and/or theft of materials, tools, and/or equipment.
6.2 All work shall be done in a safe manner and comply with all governing regulations concerning safety. This shall include, but not be limited to OSHA, MOSHA, etc. All work being performed for and/or on Baltimore County property shall fully conform to all local, state, and Federal safety regulations.
6.3 The surveyor shall obtain the permission of the Baltimore County representative regarding any needed storage of materials and equipment. Surveyor shall be held responsible for any and all accidents caused by negligence. The County does not accept responsibility for losses of material or equipment regardless of approval to store at any of the County’s work sites.
6.4 The surveyor must physically pick-up the work site drawings within twenty-four (24) hours of written or verbal notification by the Chief, or his authorized representative to complete a written or verbal quotation of the work to be performed. If the Chief, or his authorized representative tells the Contractor that the work to be performed is an emergency, the Contractor must physically report to the site within two (2) hours and phone in a quotation to the Chief, or his authorized representative.
6.5 The Chief, or his authorized representative, shall stipulate whether the surveyor will quote prices for regular time, overtime, or a combination thereof. The surveyor shall only work overtime when specifically told to do so. The Chief, or his authorized representative, may determine what skill levels of workers and how many of each level shall work on any job under this agreement. The Chief, or his authorized representative, may indicate the types and quantities of materials incorporated in the work and shall approve all sources of supply. All materials incorporated in the work (stakes, paint, ribbons, and nails) may need approval by the Chief, or his authorized representative, prior to use on each job. Materials incorporated in the work that have not received prior approval by the Chief, or his authorized representative, shall be at the surveyor’s expense and not paid for by Baltimore County. After reviewing the drawings and the work site, the surveyor shall submit a written quotation based on the contract pricing. The surveyor shall respond with a fax or emailed estimate. Included in the quote shall be estimated labor and material cost, brief description of work to be done, and the work location.
When approved, the surveyor will be given a verbal Notice To Proceed or a delivery order by the Chief, or his authorized representative. Each verbal Notice To Proceed shall be confirmed by a fax or email. When emergencies occur, the surveyor shall call in the price quotation to the Chief, or his authorized representative, when the quote is agreed upon, the surveyor will be given the verbal Notice To Proceed. The surveyor shall commence emergency work immediately.
6.6 For all non-emergency work, once the surveyor has received the verbal Notice To Proceed or Delivery Order, the surveyor has five (5) calendar days to mobilize at the job site and begin work unless specified differently in the proposal approved by the Chief, or his authorized representative.
6.7 The surveyor shall not charge Baltimore County for travel time to and from the work site or workers' lunch breaks. Baltimore County shall pay only for actual work time on the job. The surveyor shall come prepared to the job site with the correct materials, tools, and equipment needed for the work. If the surveyor finds that they need materials, tools, or equipment not anticipated in the original scope of work, they may use work time to go to the closest supply house or company storage facility to pick up that part or material, tool, or piece of equipment. Only a maximum of one (1) man hour can be charged per day for such activity, if approved by the County on that day.
6.8 The surveyor invoice shall clearly state actual hours worked at labor rates quoted, actual cost of materials, thereof, and a complete description of work performed, location, and date. Accompanying their invoices the surveyors must also include copies of their manufacturer's/Contractor's invoices for material used thereby providing verification of actual material costs and copies of all daily work orders listing each skill level of labor and their individual hours worked. The surveyor’s personnel shall sign-in and sign-out on their work orders showing actual time of signing. All materials shall be listed on the work order. The Contractor must provide these work order forms.
6.9 If the surveyor foresees that he/she is going to exceed the original estimate, he/she must notify the Chief, or his authorized representative, for approval in order to proceed on the additional work. The County shall not pay for additional work if the surveyor performs the work without the County’s approval.
7. MAINTENANCE OF TRAFFIC.
7.1 This work shall consist of maintaining traffic, vehicular and pedestrian, on or along any transportation facility as specified in the Contract Documents. This Section sets forth the traffic control requirements necessary for the safe and continuous maintenance of traffic throughout the area affected by the work, and is intended to minimize inconvenience to the traveling public, while providing for the safety of motorists, pedestrians and workers.
Work shall be as specified in the latest Manual on Uniform Traffic Control Devices (MUTCD), Standard Specifications and Interim Specifications Addenda (ISA), the Administration’s (here meaning the SHA, not Baltimore County) Book of Highway Standards. Items used for temporary maintenance of traffic shall be removed from the project site when no longer needed.
Coverages Required:
Unless otherwise required by the specifications or the contract, the Contractor/Vendor shall purchase and maintain the insurance coverages listed herein.
Insurance Companies must be acceptable to Baltimore County and have an A.M. Best Rating of A-, Class X or better.
Verification of Insurance:
Before starting work on the contract or prior to the execution of the Contract on those bid, the Contractor/Vendor shall provide Baltimore County, Maryland with verification of insurance coverage evidencing the required coverages.
Baltimore County as Additional Insured:
The coverage required, excluding Worker’s Compensation and Employers’ Liability and Medical Malpractice Liability/Professional Liability/Errors and Omissions Liability, must include Baltimore County, Maryland as an additional insured.
Contractor's/Vendor's Responsibility:
The providing of any insurance herein does not relieve the Contractor/Vendor of any of the responsibilities or obligations the Contractor/Vendor has assumed in the contract or for which the Contractor/Vendor may be liable by law or otherwise.
Failure to Provide Insurance:
Failure to provide and continue in force the required insurance shall be deemed a material breach of the contract.
Prices quoted must remain firm for the period covered by the contract, unless price escalation is herein specified. Prices quoted shall include delivery costs and charges.
The estimated value for this contract is $____ during the entire term of the Agreement, including renewals thereof.
At any time during the normal business hours and as often as the County may deem necessary, the Contractor shall make available to and permit inspection by the County, its employees or agents, all records information and documentation of the contractor related to the subject matter of this contract, including, but not limited to, all contracts, invoices, payroll, and financial audits.
Baltimore County reserves the right to add additional services to this contract at any time during the term of this agreement. The Contractor will be notified of the County’s intent to include said services within the constraints of this agreement. The Contractor shall quote a price for the requested services. The quote shall be submitted in writing to the Purchasing Agent for review. Baltimore County reserves the right to accept or reject the Contractor’s proposal. If rejected, the County shall solicit bids on the open market for the required services. Award of new services to a current contractor’s agreement shall conform to the intent of the solicitation under section titled METHOD OF AWARD. Successful bidder will be notified in writing of the inclusion of the new services.
The unit of measure for prices quoted must agree with the unit of measure provided on the bid form. Math extensions will be verified and bids will be rejected if units of measures are not compatible.

Purchase orders will be issued from time to time by the purchasing agent for such quantities as to satisfy requirements of the County. Specific quantities and delivery information will be indicated on purchase orders. Each purchase order will refer to the supplier contract number. Purchase orders issued within the term of the contract, even if not completed within the term of the contract, shall continue to be bound by the terms and conditions herein.
Orders exceeding $2,500 in total will be placed via purchase order by the purchasing agent. Any orders under $2,500 will be placed by telephone by the using agency and shall be charged directly to agency's procurement cards. Purchase orders issued within the term of this contract, even if not completed within the term of this contract, shall continue to be bound by the terms and conditions herein.
Baltimore County reserves the right to extend the terms and conditions of this contract to any and all other County agencies requiring these commodities and/or services. A purchase order will be issued against the original supplier contract, confirming the contracted pricing and giving quantity and delivery requirements.
The vendor of this contract shall extend the same prices, terms and conditions to all Baltimore County Volunteer Fire Departments requiring these commodities and/or services. Any additional charges for deliveries to Volunteer companies must be negotiated with the individual companies. Baltimore County Fire Department and the Office of Budget and Finance are not responsible for payment of invoices for the Volunteer Fire Departments. All purchase and payment transactions will be made directly between the Vendor and the Volunteer Fire Departments.
Due to the critical nature of this requirement, liquidated damages resulting from failure to meet the delivery date shall be charged against the vendor at a rate of $ per calendar day for each day delivery is not made in accordance with the schedule. The assessed amount, if any, will be deducted from the final invoice.
Packaging shall be in accordance with the best commercial practices for proper protection. All materials must be securely containerized in metal/plastic containers. The interior of the container must be of such material so that the chemical components of the product do not adversely affect the container for the shelf life of the product. All containers shall be labeled indicating content and instructions for proper use.
Bidders must indicate what, if any, percentage of the products provided or used in performing this contract contain recycled components.
If the product herein described contains any ingredient or if the work to be performed under this contract requires the use of any product which contains any ingredient that could be hazardous or injurious to a person's health, a Safety Data Sheet (SDS) must be provided to the Purchasing Division, Room 148, Courthouse, 400 Washington Avenue, Towson, MD 2l204-4665.
If funds are not appropriated or otherwise made available to support contract continuation in any fiscal year, the County shall have the right to terminate the contract without any obligation or penalty.
Criminal background checks must be procured and provided to the County, at no cost to the County, for any and all Vendor or subcontractor personnel that have the ability to view or access any County data. The Vendor must provide copies of such background checks to the County before any such personnel will be permitted to access the County's data. If such background check is not provided to the County, or is determined to be unacceptable, the County reserves the right to require the Vendor or subcontractor to provide alternate personnel. In addition, failure to provide such background check may be deemed to be a default under the contract.
If deemed necessary by the County, the vendor will be asked, as indicated below, to instruct County employees in the maintenance and operation of the unit(s). The facilities and the minimum required number of instruction days are listed below.

Each bidder must visit the installation site in order to take all measurements that are required. Sizes listed are only approximate if shown. The act of submitting a bid is to be considered acknowledgment by the bidder that they have visited the site, taken field measurements and are familiar with the conditions and requirements affecting the work. Failure to do so will not relieve the successful bidder of his obligation to furnish all materials and labor necessary to carry out the provisions of the contract and to complete the work for the consideration set forth in this bid. During the progress of any job, the Contractor may suspend work via written permission of the Engineer, wholly or in part, for such period or periods as the Engineer may deem necessary, due to unsuitable weather, or such other conditions as are considered unfavorable for the suitable prosecution of the work. If it should become necessary to stop work for an indefinite period, the Contractor shall store all materials in such manner that they will not obstruct or impede traveling public unnecessarily, nor become damaged in any way, and the Contractor shall take every precaution to prevent damage or deterioration of the work performed, and erect temporary structures where necessary. When conditions permit resumption of work, the Contractor shall notify the Engineer 48 hours in advance and shall proceed with the work only when and if authority is granted by the Engineer. Any work performed without approval by the Engineer will be at the Contractor’s risk, and the Contractor shall be held liable for removal of any such work.
The Contractor and all Subcontractors must comply with the Prevailing Wage Law and Local Hiring Requirements contained in Baltimore County Code § 10-2-506 and § 10-2-507, respectively, as amended. Prevailing wage means the wage rate paid by employers that is determined by a governmental authority, based upon a particular geographic area, for a given class of labor and type of project. The County will use the prevailing wage established by the State of Maryland Commissioner of Labor and Industry for state funded construction contracts in the county at the time of award. These rates include the basic hourly rate and fringe benefits. Apprentices must be paid at least the rate that the state’s apprenticeship and training council sets for an apprentice in the trade involved, based on a percentage of the prevailing wage rate in that trade. The County reserves the right to make multiple awards, on an individual item basis, combination item basis or lump sum basis, whichever is in the best interest of the County, effectively the lowest responsive, responsible bidders. Past performance of bidders in furnishing goods and services to Baltimore County will be considered in determining the award.
If multiple awards are made, it is the intention of Baltimore County to issue work equally to all contractors in a general rotation, however, the assignment of work shall be at the sole discretion of Baltimore County. Any claim of any contractor against the County for extra compensation or damages, arising out of the assignment of work by the County, shall be deemed to have been waived by all contractors. In addition, the County reserves the right to award individual jobs on a specific rotation basis, based on demonstrated areas of experience and expertise, or based on job location.
