    Description

    The Buffalo and Erie County Industrial Land Development Corporation (ILDC) invites sealed bids for work at the Renaissance Commerce Park including providing all labor, materials, machinery, tools, equipment and other means of construction necessary and incidental to the completion of the work shown on the Contract Documents, in accordance with the Contract Plans and Specifications attached hereto. Sealed bids shall be received at the ILDC, 95 Perry St. Suite 403, Buffalo, New York 14203. Bids will be opened on Thursday, March 26th, 2026 at 3:00 PM at the ILDC’s office and read aloud. Bidders may attend the bid opening. Faxed, emailed or electronically submitted bids will not be accepted. There will be a non-mandatory pre-bid conference call on Tuesday, February 24th, at 10:00am and a site walkover on Thursday, February 26th at 10:00am. Everyone attending the site walkover will be required to bring and wear their own PPE (hard hat, safety shoes, hi-vis vest or other attire) and sign a liability waiver consent form. This is the only time a site visit will be offered. Information for the conference call and instructions for the site walkover are included following this section. The Contract is to provide all the necessary services, material, equipment, labor and superintendents necessary to perform the construction work in accordance with the standards of the New York State Department of Transportation (NYSDOT), the Federal Railroad Administration (FRA), the South Buffalo Railway (Genesee and Wyoming), the American Railway Engineering & Maintenance of Way Association (AREMA), the County of Erie, the Buffalo and Erie County Industrial Land Development Corporation (ILDC), and the contract documents. Summary of Work Items Included in the Contract Retirement of the Wye Yard Tracks in its entirety extending northward from the track switch diverging from the East Harbor Lead Track located immediately west of the railroad bridge over NYS Route 5 (Hamburg Turnpike). Retired track materials will either be saved for reuse to constructed the Poco Yard expansion or salvaged by the Contractor. All rail material related to the Wye Yard is to be clear of the site upon completion. Three (3) new tracks will be constructed immediately west of Highway 9 and parallel to the existing Poco Yard. The leads to the three (3) new tracks will connect into the existing Poco Yard lead tracks. A widened track center between new tracks P-1 and P-2 will be finished with a gravel base and surface for use as a transload area. Rail and track materials saved from the Wye Yard retirement will be used to construct the body of the three (3) new Poo Yard storage tracks. The overall project also includes site grading which will be performed under a separate earthwork contract. The Contractor must ensure that employees and applicants for employment are not discriminated against because of their race, color, religion, sex or national origin. Prevailing wage rates will be required in this contract. No bid shall be considered unless it is accompanied by a Bid Bond, safeguarding the County of Erie and the ILDC, executed by an acceptable surety, in amount equal to ten percent (10%) of the total of bid. Tecumseh Redevelopment, Inc. (Cleveland-Cliffs LLC) is one of the property owners of area within the project site(s) and requires all Contractors and Subcontractors be ISNetworld certified with an A or B rating prior to commencing any work on their property. Bidders are required to submit a complete list of Subcontractor partners with their bid. The ILDC reserves the right to reject any or all bids or to waive any informality in the bidding. Bids may be held by the ILDC for a period not to exceed sixty (60) calendar days from the date of the opening of bids for the purpose of reviewing the bids and investigating the qualifications of bidders (prospective Contractors), prior to awarding of the Contract. No bids will be withdrawn during this period without the consent of ILDC. ILDC hereby notifies all bidders that it will affirmatively insure that with regard to any Contract entered into pursuant to this Request for Bids, Minority, Women and Service Disabled Veteran-owned Business Enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, religion, color, sex, or national origin in consideration of an award. The County of Erie has established the following Minority Business Enterprise (MBE), Women’s Business Enterprise (WBE), and Service-Disabled Veteran Enterprise (SDVOB) participation goals for this contract. The goals are expressed as a percentage of the total bid price. It is the Contractor’s responsibility to secure participation in the work of the contract by MBE/WBE/SDVOB in satisfaction of the goals, or to document satisfactory good-faith efforts taken to fulfill the goals. Participation is measured as the amount actually paid to MBE/WBE/SDVOB’s, not the contract bid price for the work. Minority Business Enterprise (MBE) Participation Goal 10.00% Women’s Business Enterprise (WBE) Participation Goal 15.00% Service-Disabled Business Enterprise (SDVOB) Participation Goal 6.00% Should there be a need for consultant work to perform professional services for this project, the consultant contract shall require MBE/WBE/SDVOB participation at a minimum of 20% MBE, 10% WBE, and 6% SDVOB or higher. All bidders and prospective Contractors are subject to follow Erie County Local Law 2-2006, regarding apprenticeship if applicable. Distribution of Bid Documents will commence on Tuesday, February 17th, 2026. Bid documents will be available for download at www.ecidany.com. No paper copies of the Bid Documents will be reproduced or distributed by the ILDC.
