FAR 52.232-18 Availability of Funds

Funds are not presently available for this contract. The Government’s obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer.

Upon the availability of funds, IAW FAR 13.106-1(b)(1)(i) The 122d Fighter Wing, Fort Wayne, IN intends to issue a sole source firm-fixed price contract to GasTOPS, Inc., Huntsville, AL 35806 for a ChipCHECK Kit part No. B179820, NSN 6650-01-665-6490, a field deployable general-purpose analytical wear debris analysis tool.

GasTOPS uses proprietary designs for their analyzer equipment. The Department of the Air Force currently has an IDIQ contract in place with GasTOPS for analyzer equipment and for additional service, training, and repairs.

All costs associated with responding to this Notice will be solely at the expense of the interested party.
