The National Institute of Allergy and Infectious Diseases (NIAID) of the National Institutes of Health (NIH) intends to negotiate on an Other Than Full and Open Competition basis with Becton Dickinson & Co., 2350 Qume DR, San Jose, California 95131-1812, United States, to procure a 12-Month contract for maintenance of three (3) BD LSR Fortessa instruments. Specifications of requirement: Catalog# 648087 Units covered three (3) BD LSR Fortessa instruments listed below (including workstations and accompaniments): LSRFortessa SORP (No Lasers) Serial # H647794L6059 LSRFortessa SORP (No Lasers) Serial # H17700006 LSRFortessa SORP (No Lasers) Serial # H17700011 Coverage: Coverage includes the BD LSRFortessa Special Order System with one Computer Workstation (excluding lasers and printers) for labor, travel expenses and parts (excluding consumables), for the following: 2 Preventive Maintenance Inspections to be performed during a twelve-month period, including 2 PM Kits. Software Revisions released during the Agreement term. Unlimited service visits, Monday-Friday excluding holidays. Unlimited telephone support for instruments, reagents and applications will be provided at no additional charge. Every reasonable effort will be made to respond to a request for emergency on-site service (Monday through Friday, excluding holidays) within 48 hours. Catalog# 337755 Description: Service Contract FACS Flow Supply System Serial Numbers: S/N 349277N0693, S/N N3492774980 Coverage: This plan covers the FACS Flow Supply System for labor, travel expenses, and parts (excluding consumables) for the following: Unlimited service visits, Monday through Friday, excluding holidays. Unlimited telephone support for instruments, with reagents and applications provided at no additional charge. Place of Performance: Bethesda, MD 20814 Period of Performance: 05/25/2025 to 05/24/2026 The statutory authority for this sole source requirement is 41 U.S.C. 1901 (a) (1) as implemented by FAR 13.106-1 only one responsible source and no other supply of service will satisfy agency requirements. THIS IS NOT A REQUEST FOR PROPOSAL. All responsible sources that could provide this service may submit a capability statement along with a copy of an agreement with the manufacturer to include evidence of being capable of providing unlimited service visits, unlimited telephone support, with emergency on-site service (Monday to Friday). Requirement: * vendors must include evidence of capability to service BD LSR Fortessa instruments to be considered. Submissions must be received by 10:00 am EST, Saturday, May 17, 2025. All required documents must be submitted via the NIAID electronic SIMPLIFIED ACQUISITION SUBMISSION SYSTEM (eSASS) website at https://esass.nih.gov. All vendors must register in the eSASS system to submit their documentation. Instructions on how to register /submit documents are included on the website. All responses received by the closing date of this synopsis will be considered by the Government. Late submissions shall be treated in accordance with the solicitation provision at FAR 52.212-1(f). A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government.
