INTENT TO SOLE SOURCE: NINJA TRX SYSTEM

This notice is for informational purposes only. The 27 Special Operations Contracting Office, Cannon AFB, NM, intends to award a sole source GSA Delivery Order to Black River Systems Company, Inc. fo SS-365-SW-CS Ninja Annual Software Support, Library Updates, & Customer Service / Help Desk Support / Support Web-portal Access; SS-365-HW-GEN2 Ninja Gen2 System Hardware Warranty Extension (RMA Mgmt, Factory Repairs); and SS-365-HW-TRX Ninja TRx System Hardware Warranty Extension (RMA Mgmt, Factory Repairs), under the authority of FAR 8.405-6(a)(1)(i)(B), due to proprietary specialized equipment replacement and Dept of the Air Force Program of Record requirements. 

Please note that this is not a request for competitive quotes. However, all interested parties who believe they can meet the
requirements are invited to submit in writing information describing their ability to satisfy the requirement listed above. A
determination by the Government to compete this requirement based on responses to this notice is solely within the discretion of
the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive
procurement.

Per FAR 52.232-18 Availability of Funds. 

Availability of Funds (Apr 1984)

Funds are not presently available for this contract. The Government’s obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer.
