FBO ANNOUNCEMENT: PRESOLICITATION NOTICE, NOTICE OF INTENT ACTION CODE: SPECIAL NOTICE SUBJECT: Sole source Maintenance Services for Waters NIST Synapt XS w I-Class and APGC SOLICITATION NUMBER: NB646020-25-01330 RESPONSE DATE: 6/13/25 DESCRIPTION: The Material Measurement Laboratory is one of two metrology laboratories within the National Institute of Standards and Technology (NIST). The laboratory supports the NIST mission by serving as the national reference laboratory for measurements in the chemical, biological and material sciences. Our activities range from fundamental and applied research on the composition, structure and properties of industrial, biological and environmental materials and processes, to the development and dissemination of tools including reference measurement procedures, certified reference materials, critically evaluated data, and best practice guides that help assure measurement quality. Our research and measurement services support areas of national importance. Within this lab, a number of Water mass spectrometers are utilized and require a maintenance agreement to assure all the equipment stays fully operational. The National Institute of Standards and Technology (NIST) intends to negotiate on a sole source basis, under the authority of FAR 13.106-1(b) (1), with the Waters Corporation located in Milford, MA, for maintenance of this equipment. Sole Source justification is based on the following: Market research has shown that Waters Technology Corporation is the sole responsible source for service for this instrument. Waters trains and certifies only Waters technicians to service their instruments. Waters directly manufactures approximately 50% of all Waters parts as the sole source for these parts. Only Waters service engineers have access to the diagnostic tools used to service Waters instruments. Instrument and software upgrades for Waters systems are only available from Waters. NAICS code for this requirement will be 811210 Other Electronic and Precision Equipment Repair and Maintenance with a small business size of $34.0M. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested parties who regard themselves as capable of fulfilling these requirements are invited to submit responses to the Government for consideration. Responses received by 1:00AM EST on 6/13/25 will be considered by the Government. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
