Introduction
This is a notice of intent, not a request for a quotation. A solicitation document will not be issued and quotations will not be requested.

Purpose
The National Institute of Standards and Technology (NIST) intends to negotiate a firm-fixed priced purchase order on a sole source basis with Mitutoyo America Corporation (UEI: DWD6M3KJUGB7) located at 965 Corporate Boulevard, Aurora, Illinois 60502. The purchase order will be for acquisition of Metrology Software for a Mitutoyo Kogame Coordinate Measuring Machine. Delivery and installation will be required within thirty days after contractor receipt of order.

Authority
This acquisition is being conducted under the authority of FAR Subpart 13.106(b)(1) allowing the Contracting Officer (CO) to solicit from one source. The North American Industry Classification System (NAICS) code for this acquisition is 513210 – Software Publishers with a size standard of $47 million.

Sole Source Determination
The sole source determination is based on the following:
 

The NIST Engineering Laboratory owns and operates a Mitutoyo Kogame Coordinate Measuring Machine (CMM) in the Digital Twin Laboratory (DTL). As part of normal operation of the CMM, NIST uses two main softwares called MCOSMOS and MiCAT Planner which are proprietary to the original equipment manufacturer, Mituotyo Corporation. The CMM itself is also proprietary to this contractor.

The CMM owned by NIST uses dated software (MCOSMOS Version 4 and MiCAT Planner Versions 1.0~1.4) which must be updated to current versions to ensure optimal function of the machine. Mitutoyo Corporation operates using international divisions including Mitutoyo CTL Germany GmbH (Germany) and Mitutoyo America Corporation (MAC). MAC is the only authorized provider to United States for this commercial software requirement and is thus the only contractor capable of providing the required products to NIST.

Interested parties that believe they could satisfy the requirements listed above for NIST may clearly and unambiguously identify their capability to do so in writing by or before the response date for this notice. This notice of intent is not a solicitation.
