    NOTICE OF INTENT TO AWARD (SOLE SOURCE) Notice of Intent Number: 52000PR260026835 1. Synopsis of the Requirement The Government hereby submits a notice of intent to award a sole-source, firm-fixed-price contract/purchase order to: Proposed Contractor: NAG, LLC Contractor Unique Entity ID (UEI): F3XKPA82MHQ5 CAGE Code: 1PL37 Contractor Address: 2901 Sabre ST STE 50, Virginia Beach, Virginia 23452-7376, United States Requirement Title: Coast Guard Machinery Control System (CGMCS) Computer Processor Units for USCGC 175' WLM Abbie Burgess Total Estimated Value: $108,328.00 It is the belief of the Government that this organization is the sole source to fulfill the need of one responsible source to satisfy the agency's requirement. NAG, LLC is the sole retailer for Rugged Machines and the authorized distributor for this specialized OEM equipment, which must integrate seamlessly with existing shipboard hardware developed by the Naval Surface Warfare Center – Philadelphia Division (NSWC-PD). (See attached justification [JOTFOC]). 2. Regulatory and Statutory Authority This sole-source contracting action is conducted in accordance with Federal Acquisition Regulation (FAR) Class Deviation / Revolutionary FAR Overhaul (RFO) guidelines. Under the RFO, simplified procedures for commercial acquisitions are consolidated under RFO FAR Part 12 [specifically RFO FAR 12.201-1 (Simplified procedures) and RFO FAR 12.102(a) for acquisitions valued at or below the Simplified Acquisition Threshold]. The statutory and regulatory authorities permitting other than full and open competition are: Regulatory Authority: RFO FAR 6.103-1, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements." Statutory Authority: 10 USC 3204(a)(1) (applicable to the United States Coast Guard as a military service under the Department of Homeland Security). 3. Acquisition Details North American Industry Classification System (NAICS) Code: 334111 SBA Small Business Size Standard: Small Business Product Service Code (PSC): 7B22 Requirement Summary: This procurement establishes a materials package for OEM Coast Guard Machinery Control System (CGMCS) computing hardware to support propulsion systems upgrades. Deliverables include six (6) MilAxon 4000 rugged standalone computers, two (2) 19-inch operator interface panels with integrated MilAxon 4000 computers and associated mounting kits and field-side connector kits. 4. Submission Instructions to Interested Parties This hereby constitutes a synopsis of the items included in this requirement. This notice is NOT a request for competitive quotes or proposals, and a written solicitation will not be issued. However, responses to this notice demonstrating clear and convincing evidence that competition would be advantageous to the Government, would not be cost or time prohibitive, and would not hinder critical mission objectives will be considered. The determination not to compete this proposed contract action is solely within the discretion of the Government. Information received will be considered solely for the purposes of determining whether to conduct a competitive solicitation for future requirements regarding this program. The Government will not be responsible for any costs incurred by responding to this notice. 5.
