NOTICE OF INTENT TO AWARD SOLE SOURCE - ANSYS COMMERCIAL SOFTWARE

The Air Force Research Laboratory (AFRL) intends to award a sole source contract to Ansys Government Initiatives (AGI) for the acquisition of Ansys Commercial Software, a commercial software product that meets the agency’s specific operational requirements. This acquisition is being conducted under the authority of FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The software is a commercial item as defined in FAR 2.101 and will be acquired using procedures outlined in FAR Part 12. Based on market research and direct engagement with industry, the Government has determined that AGI is the only known source capable of providing this software. The vendor has asserted proprietary rights and confirmed that no authorized resellers or distributors exist for this product. In accordance with FAR 5.203(a), the Government is utilizing a shortened publicizing period due to the commercial nature of the item and the urgency of the requirement. Interested parties may submit a capability statement by the response due date listed above. Submissions must clearly demonstrate the ability to provide the required software and meet the Government’s specifications. This notice is not a request for competitive proposals. However, all responsible sources may submit a capability statement, which shall be considered by the agency. A determination by the Government not to compete this proposed contract based on responses to this notice is solely within the discretion of the Government.
