THIS TIME.
This is a SPECIAL NOTICE. No proposals are being requested or accepted with this notice. The 772 ESS/PKA is soliciting feedback from the construction community addressing the potential use of PLA for a large scale construction projects (exceeding $35 million) at multiple locations (See Attachment 1). Projects would primarily be design/bid/build or design/build projects. NAICS Code: 236210- Industrial Building Construction, 236220-Commerical and Institutional Building Construction, 237990 Other Heavy and Civil Engineering Construction, and/or 2371 Utility System Construction. The magnitude of construction varies by project (See Attachment 1). General period of performance is anticipated to be approximately 18-48 months.
REVOLUTIONARY FEDERAL ACQUISITION REGULATION OVERHAUL (RFO) 22.502-1 DEFINITION:
Project labor agreement means a pre-hire collective bargaining agreement with one or more labor organizations that establishes the terms and conditions of employment for a specific construction project and is an agreement described in 29 U.S.C. 158(f).
RFO 22.503 POLICY:
(a) Executive Order (E.O.) 14063, Use of Project Labor Agreements for Federal Construction Projects, requires agencies to use project labor agreements in large-scale construction projects to promote economy and efficiency in the administration and completion of Federal construction projects.
(b) When awarding a contract in connection with a large-scale construction project, agencies must require use of project labor agreements for contractors and subcontractors engaged in construction on the project, unless an exception at 22.502-2(d) applies.
(c) Exceptions
(d) In consideration of the above factors, and any others which may be deemed appropriate, the construction community is invited to comment on the use of PLAs for each of the above locations in the United States. The Government intends to use the responses to the attached questionnaire for the (1) attached list of projects and (2) any other projects in same geographical areas (not yet identified) of similar scope/magnitude (for 18 months)
(e) Accordingly, Interested Parties are requested to respond to this RFI regarding PLA with the following information for each applicable project and/or location. Please fill out Attachment 1 as thoroughly as possible. Attachment 1 contains drop downs to help ensure consistency and accuracy for most general questions. Utilize the comment field to elaborate or provide additional details to support your responses for each project/location as needed. We may reach out to the responders directly to ask follow-up questions or get additional clarity for responses.
