    Patent and Trademark Guidelines Part 6.1.1 - Synopsis Technical Surveillance Countermeasures (TSCM) Services Notice ID: ACQ-26-0684 Reissued June 22, 2026 The United States Patent and Trademark Office (USPTO) has a requirement for Technical Surveillance Countermeasures (TSCM) Services for a 12-month base period and four, 12-month option periods, beginning on the date of award. The anticipated award date is June 25, 2026. The USPTO is exempt from various public procurement laws, including parts of the Competition in Contracting Act pursuant to the Patent and Trademark Office Efficiency Act (PTOEA), 35 U.S.C. § 2(b)(4)(A). The subject requirement is being procured using the Alternative Competition Method in accordance with the Patent and Trademark Office Acquisition Guidelines (PTAG), 78 Fed.Reg. 61185 (Oct. 3, 2013) and the PTOEA. In accordance with PTAG 5.1.2, the USPTO conducted market research by reaching out to businesses identified on the Small Business Administration Dynamic Small Business Search (SBA DSBS), GSA E-Library, the Federal Procurement Data System (FPDS), and SAM.gov, as well as by USPTO previous awards for similar work. The results of this market research indicate that a limited number of vendors are most likely to successfully meet the agency’s needs. As a result, the solicitation will only be issued to the limited number of qualified vendors. This procurement will be a total small business set-aside.
