THIS NOTICE IS A NOTICE OF INTENT TO SOLE SOURCE. THIS IS NOT A REQUEST FOR PROPOSAL.  IT DOES NOT CONSTITUTE A SOLICITATION AND SHALL NOT BE CONSTRUED AS A COMMITMENT BY THE GOVERNMENT.  RESPONSES IN ANY FORM ARE NOT OFFERS AND THE GOVERNMENT IS UNDER NO OBLIGATION TO AWARD A CONTRACT AS A RESULT OF THIS ANNOUNCEMENT.  NO FUNDS ARE AVAILABLE TO PAY FOR ANY RESPONSES TO THIS NOTICE.  ANY INFORMATION SUBMITTED BY RESPONDENTS TO THIS NOTICE IS STRICTLY VOLUNTARY. The Department of Labor, Office of the Senior Procurement Executive, intends to award a sole source contract on behalf of the Mine Safety & Health Administration (MSHA) under FAR Subparts 12 and 13.5 under the statutory authority 41 U.S.C. 3304(a)(1) as described in the Federal Acquisition Regulation section 6.302-1(a) (2)(c),  to Cole-Parmer Instrument Company, LLC, UEI SAM LY1NDJ5ZNJP3 , 5350 SW 1st Lane, Ocala, FL 34474, for certain mining products used by MSHA’s Mine Safety and Health Enforcement Division (MSHE Division).  The part numbers are as follows: Part Number 803463                        Respirable Dust Cassette           *Quantity: 25,000 Part Number 10011208                    Respirable Dust Cassette            *Quantity: 20,000 Part Number 456243                        Cyclone Assembly                       *Quantity: 900 Part Number 10087242                    Replacement Battery Packs        *Quantity: 600 Part Number P5-ELF-5-1-0-0         Escort Elf Pump                             *Quantity: 200 *Quantities shown are estimated annual maximums, not guaranteed. This action will result in a fixed-priced BPA award for a period of up to three years, with funded BPA calls placed on an as-needed basis.  The NAICS code for this requirement is 334519 – Other Measuring and Controlling Device Manufacturing with a size standard of 1,000 employees.
