A licensed Design Professional cannot be a fiduciary to its client as it cannot be required to put a client's interests above the interests and safety of the public. Additionally, accepting this type of relationship would require the Consultant to accept a standard of care which exceeds the industry Standard of Care provided by licensed Design Professionals performing similar services in the area where the Project is located. In addition, design professionals have no control over contractors, third parties, or their quality control programs. Under Florida law and generally accepted engineering practice, licensed engineers may only be responsible for the professional services they are retained to perform and cannot assume liability for the work of others.
