While a third-party Project Manager and their team can do everything in their power to complete the project on time, in the end, they don’t have control over the numerous vendors that have been contracted to provide all the equipment and installation of the project. Therefore, it would be difficult for a Project Manager to take the financial responsibility for the work of others. We understand completely why this clause has been requested and would absolutely do our utmost to make sure the project is substantially completed by the deadline. Since however, we ultimately do not control the many vendors working on this project, we respectfully request that the “Liquidated Damages” clause be removed from the RFQ. Would that be possible?
