General work description:

This project is subject to Build America, Buy America (BABA) procurement requirements. All equipment and applicable materials incorporated into the project, including items such as conduit, wire, steel, iron, and similar components, must be approved by the Indiana Office of Energy Development (IOED) for BABA compliance.
All bidders must propose to install one of the chillers pre-approved for BABA compliance by IOED. See the BABA certifications approved by the IOED in Exhibit (add exhibit letter) for the chiller equipment. The model numbers for the IOED BABA-approved chillers are provided on the BABA certifications.
No additional equipment or applicable materials have been pre-approved for BABA compliance by IOED. Acceptable manufacturers and models shall be limited to equipment for which the bidder provides current manufacturer certification demonstrating compliance with the BABA for the exact equipment and materials being furnished. Such certification shall be on manufacturer letterhead and shall include, at a minimum, the project name, date of certification, manufacturer address, exact model numbers proposed, item or part naming convention or SKU as applicable, material classification under 2 CFR Part 184, an affirmative statement of BABA compliance, and signature of an authorized manufacturer representative.
The selected contractor shall submit all BABA certifications for applicable materials to the City within sixty (60) days of being awarded a contract. The City will submit the BABA certifications to the IOED for approval. No materials or equipment shall be installed until BABA certification approval is received from IOED.

For projects $200,000 or higher, a Bid Bond or a cashier’s check, or certified check drawn on an acceptable bank equal to five (5%) percent of the total amount of bid is required.

Each bid shall be accompanied by a certified cashier’s check, or bid bond, in the amount of 5% of the total bid price, payable toCity of Bloomington, as a guarantee that the bidder, if its bid is accepted, will promptly execute the Agreement. The bidder shall guarantee the total bid price for a period of 60 days from the date of the bid opening.

The contract shall be executed by the successful bidder and shall be returned, together with the Payment Bond, Performance Bond and Certificate(s) of Insurance to City of Bloomington so that it is received within 14 working daysafter the bidder has received the contract for execution. Failure to do so shall be just cause for forfeiture of the proposal guaranty.
