The City, at its sole and absolute discretion, shall have the option to extend the term for two (2) additional years for a total of four (4) years. Anticipated Contract Not to Exceed Amount: The not to exceed (“NTE”) amount for a contract awarded pursuant to this Solicitation cannot be anticipated at the time of this Solicitation but shall be based on the selected Proposal. LBE Subcontracting Participation Requirements and Good Faith Efforts: The LBE Subcontracting Requirements for the services of any contract awarded pursuant to this Solicitation shall be seven percent (7%), which shall be met with any combination of Micro and Small LBEs. Services provided by SBA-LBEs will not count toward meeting the LBE subcontracting participation requirement. LBE Good Faith Efforts: Proposers must undertake adequate good faith outreach to LBE subcontractors and demonstrate the efforts on CMD Form 2B and through supporting documents. If a contractor’s proposed LBE subcontracting participation exceeds the sum of all LBE Subcontracting Participation Requirements for a contract by at least thirty-five percent (35%), the Bidder is excused from documenting its good faith efforts as required in Form 2B. For this RFP with an LBE subcontracting participation requirement of 7.00%, a contractor’s proposed LBE subcontracting participation must be at least 9.45% to be excused from documenting its good faith efforts.
