Shaffer County Manager Date: March 11, 2026 TO: Procurement File FROM: Bill Taylor, Procurement Manager RE: Sole Source Determination Pursuant to Section 13-1-126 NMSA 1978 for the Provision of Providing Professional Engineering Services Contract with AE COM Technical Services, Inc. to Complete Design Services for Section B of the Santa Fe River Greenway Project, for a Total Contract Amount of $281,224.00, Exclusive of NM GRT BACKGROUND In 2021, Santa Fe County Purchasing Division issued a Request for Proposals (RFP) No. 2021-0150- PW/KE and entered Agreement No. 2021-0150-PW with AE COM Technical Services, Inc.in August 2021 to provide engineering services for the design of a public greenway and trail along the Santa Fe River, also known as the Santa Fe River Greenway Project. The project scope included the completion of design services of Section B of the Santa Fe River Greenway, which is the remaining Section between Siler Road and San Ysidro Crossing. AE COM completed design of Section B in 2023, however multiple property acquisitions and access to private properties resulted in delays for the bidding and negotiation phase of design services and the term of Agreement No. 2021-0150-PW reached the maximum term of 4-years, pursuant to NMSA 1978, 13-1-150. Multiple term contracts. specified period. The County needs to complete the project and requires the Engineer of Record to continue with providing design services. DETERMINATION Although there are other engineering firms that can provide design services, AE COM has produced and completed the full design solution of Section B of the Santa Fe River Greenway Project. It would not be in the best interest of the County to re-solicit the design services for the following reasons: 1. Another Engineer would not be liable or responsible for the design solution that was produced by the Engineer of Record, AE COM. AE COM would have an unfair advantage in the RFP selection with their extensive knowledge of the project. Due to the specific and technical intent of the original project scope, strategic plan, procurement and Agreement for Engineering Services, the County has determined that the procurement of the required design services meets the intent of a sole source procurement, pursuant to 13-1-126, NMSA 1978. Based on this determination it is in the best interest of Santa Fe County to negotiate and enter into a new contract with AE COM to complete the original intent of the procurement and contract.
