It is the intent of the City of Rochester to establish a contract for maintenance, installation and repair of ELECTRICAL SERVICES at various buildings owned, rented, leased or otherwise controlled by the City, or other buildings as directed by authorized City officials. The primary users of this contract will be the Bureau of Parks, the Rochester Public Library and the Building Services Division; however, other Departments and/or Divisions may utilize the contract. MWBE and Workforce Requirements All work awarded under this Contract shall comply with the City’s MWBE participation goals and workforce participation requirements as established by Ordinance No. 2018-54. Compliance with participation goals, utilization plans, documentation requirements, and good faith effort standards is mandatory. The City reserves the right to declare any bid informal and reject their bid if the required MWBE Form P pages are not submitted with their bid. Complete MWBE Form P requirements are found on page in Appendix E. MWBE Goals. This contract incorporates new MWBE and Workforce goal requirements, as required by Ordinance No. 2018-54. This contract has a 30% MWBE Goal. This contract has workforce goals of 20% M and 6.9% W. Details about these goals, and the contract requirements for meeting these goals, are provided herein and in Appendix E. MWBE Form P must be included with this Proposal and Goal Form P. Minority and Women Business Enterprise (MWBE) Requirements: The City has a Minority and Women Business Enterprise (MWBE) policy that ensures participation of Minority and Women-owned businesses on City public works projects, including demolitions. Ordinance No. 2018-54 established a goal that MWBE’s will receive 30% of the aggregate total annual contract awards for City public works contracts over $20,000, with the goal for minority owned businesses (M) being 15% and women owned businesses (W) being 15%. For the purpose of this contract and aggregate goal of 30% using any combination of M and/or W’s is acceptable. The requirements specified herein are established in order to accomplish these goals. Included within these bid documents are the following sections that identify the policy requirements, participation requirements, utilization requirements and good faith effort requirements. Information about MWBE goals may be obtained on an advisory basis by contacting the City of Rochester MWBE Officer at (585) 428-3673.Once the bid is awarded, MWBE forms A,B and C will be forwarded to the lowest Bidder and will become the final MWBE to be incorporated in the contract documents. Workforce Goals and Requirements Ordinance 2018-54 established a goal that 20% of the workers on this project are minorities (M) and that 6.9% of the workers on this project are females (W).The requirements specified herein are established in order to accomplish these goals. Workforce requirement procedures and documents and forms are provided on the City's website at http://www.cityofrochester.gov/mwbe/ and are hereby incorporated by reference. Commitment to Workforce Goals Bidders are required to affirm their understanding of and commitment to meet the 20% M and 6.9% W workforce goals by checking the box affirming their understanding and commitment found on the Bid Proposal Submissions Checklist. Workforce Staffing Plan The Contractor shall submit a Workforce Staffing Plan on forms required by the City and distributed before or at the pre-construction meeting. The form may be paper or on a web based system provided by the City. The workforce plan is to include, but not be limited to the following information: Name, l.D. (last 4 digits of social security number), ethnicity, gender, and if required OSHA-10 certification, for each employee the Contractor expects to employ on the job; Name of each subcontractor; Name, l.D. (last 4 digits of social security number),ethnicity, gender, and if required OSHA-10 certification, for each employee the each subcontractor expects to employ on the job; Should additional subcontractors be added during the term of the contract, the same information must be provided. Subcontractors shall mean subcontractors of any tier. If the Workforce Staffing Plan does not indicate that the Contractor will be able to meet the workforce required workforce goals, the City will require the Contractor to provide a revised workforce plan that indicates the Contractor's intent and ability to meet the workforce goals. Apprenticeship Training Requirements This Contract includes Apprenticeship Training requirements consistent with City rules governing public works construction contracts because the total annual amount of work covered by this contract may exceed $250,000. City Form AP1 and State Form AT-10 for the bidder’s Apprenticeship Program, or State Form AT-10 and City Form AP3 if the bidder is using sponsored Apprenticeship program, must be submitted with the Proposal as required by the rules and regulations for the Apprenticeship Training Program for Construction Contracts, which are included in Appendix E. The City reserves the right to declare any bid informal and reject their bid if the required apprenticeship forms are not submitted with their bid. Complete Apprenticeship Training Program requirements are found on page in Appendix D. Bidders without An Apprenticeship Program: Bidders who do not have an Apprenticeship Training program as outlined in the rules and regulations for the Apprenticeship Training Program for Construction Contracts may be considered for award. Bidders without an apprenticeship program shall not be awarded a contract more than $250,000.
