      Quotes shall be submitted electronically through the OpenGov website. No other method of submitting quotes will be accepted. Vendors may not submit bids by fax, email, telephone or other means; any quotes received through any other means than OpenGov will be returned unopened.

      Vendors are solely responsible for the on time submission of their electronic Quote. The City will only consider Quotes that have transmitted successfully and have been issued a confirmation number with a time stamp from OpenGov indicating that the Quote was submitted successfully. Transmission of Quotes by any other means will not be accepted. Vendors shall be solely responsible for informing itself with respect to the proper utilization of the online bid management system, for ensuring the capability of their computer system to upload the required documents, and for their stability of their internet service. The City shall not be responsible for any transmission errors or delays. Failure of the Vendors to successfully submit an electronic Quote shall be the Vendor’s sole risk and no relief will be given for late and/or improperly submitted Quotes.

      Neither the City, nor OpenGov , make any guarantee as to the timely availability of assistance, or assurance that any given problem will be resolved by the submission date and/or time.

    • Scope of Work

      Approximately 312 FT of 10 FT all black chain link fence (1 3/4" mesh) with industrial pipe, framework and four 4 FT walk gates, installed.

      Vendor agrees to hold the above pricing valid for a period of 90 days from the date listed above.

    • Delivery

      The City’s work plans are based upon the agreement that materials will be delivered to City by the date specified in the order. If deliveries are not made at the time agreed upon, City reserves the right to cancel or to purchase elsewhere, and hold Vendor accountable therefor.

    • Insurance & Indemnity

      Vendor agrees to provide the insurance and indemnification set forth in the Bid Terms and Conditions.

      By its signature below, Vendor represents that it has carefully examined the requirements for performing this work and agrees to all other terms and conditions set forth in this solicitation. Quotes offering terms other than those specified herein will be deemed to include only those terms that establish pricing and item descriptions.

    • Authorized Distributor

      Bidders must be the authorized distributor for the product they offer, or must submit documentation from an authorized distributor that they have purchased the specified product/equipment from that distributor and that the distributor will honor all of the manufacturer’s warranties with their bid.

    • Brand Names

      Manufacturer’s names, trade names, brand names, model and catalog numbers used in these specifications are for the purpose of describing and establishing general quality levels. Such references are not intended to be restrictive. Bids proposing substitute brands will be considered provided the substitute brand meets or exceeds the quality and requirements of the item listed in the specifications.

    • Brand Substitution

      Bids will be considered on equipment or material complying substantially with specifications, provided: 1) any deviation is stated in writing and 2) each substitution is described in detail explaining how the alternative equipment or material is equal to or better than the specified equipment or material. Standard catalog sheets or technical data will not be accepted in lieu of this requirement. The City will be the sole determiner of whether such substitutions are equivalent to the materials or equipment specified.

    • Rejection of Quotes and Waiver of Informalities

      The City of Sierra Vista reserves the right to waive any immaterial informalities or irregularities, to reject any bid, all bids, or any part of any bid presented and re-advertise for bids. The City reserves the right to cancel the solicitation and make no award. The City of Sierra Vista reserves the right to reject the bid of any Bidder who previously failed to perform adequately for the City of Sierra Vista or any other governmental agency. The City of Sierra Vista expressly reserves the right to reject the bid of any Bidder who is in default on the payment of taxes, licenses, or other monies due to the Sierra Vista.

    • Contract Amendments

      The Procurement Division has the sole authority to:

      • Amend the contract or enter into supplemental verbal or written agreements;

      • Grant time extensions or contract renewals;

      • Otherwise modify the scope or terms and provisions of the contract.

      This Contract shall only be modified with the approval of the Procurement Division. Except in the case of a documented emergency, approval must be granted prior to performance. Any contract modification not explicitly approved by the Procurement Division through a written contract amendment or change order is performed at the sole risk of the Bidder/consultant and may not be eligible for payment by the City.

      Requests for price adjustments after a PO/contract has been signed must be based on a price index adjustment that can be documented and provided to the City. The price adjustment must be itemized where applicable. The Procurement Division may approve the price adjustment or request modifications. Approval of the price adjustment shall only be demonstrated through a written contract amendment or change order signed by the Procurement Division.

    Q (Gate Layout): Are you just looking for access points at the center of every fence line, for the gates? Are the gates to be 10' tall as well?
