    Evaluation Criteria

    • INSURANCE REQUIREMENTS

      The bidder will be required to provide verification of insurance coverage in accordance with the parameters that follow. The successful bidder will have fifteen (15) calendar days to comply with this requirement, excluding County holidays and non-workdays, if applicable.

      The bidder must maintain the insurance coverage required by the County while this contract is in force, including automatic renewal terms, and shall provide documentation of such insurance in a form satisfactory to the County.

      In the event that the bidder changes their insurance carrier, new verification of insurance coverage must be provided to the County by the new insurance carrier within ten (10) days of the change of policy.

      The bidder shall purchase and maintain in force, at their own expense, such insurance as will protect them and the County from claims, which may arise out of or result from the bidder's execution of the work, whether such execution be by the bidder, bidder's employees, agents, sub-Contractors, or by anyone for whose acts any of them may be liable. The insurance coverage shall be such as to fully protect the Owner, the Engineer (if applicable) and the public from all claims for injury and damage resulting by any actions on the part of the bidder or bidder's forces as enumerated above. The bidder shall furnish a copy of an original Certificate of Insurance, naming Boone County as an additional insured. Certificate of Insurance must have an original signature. Should any of the policies be canceled before the expiration date, the issuing company will mail 30 days written notice to the certificate holder. The bidder shall furnish insurance in satisfactory limits, and on forms and of companies which are acceptable to the Owner's Attorney and/or Assistant County Administrator and shall require and show evidence of insurance coverages on behalf of any sub-Contractors (if applicable), before entering into any agreement to sublet any part of the work to be done under this Contract.

      The following insurance requirements are the Minimum Limits of Liability, Terms, and Coverage that will be acceptable:

      1. Commercial General Liability
        • $1,000,000 bodily injury and property damage each occurrence, including advertising and personal injury, products and completed operations
        • $2,000,000 products/completed operations, independent bidder's liability, contractual liability, and coverage for property damage from perils of explosion, collapse, or damage to underground utilities, commonly known as XCU
        • $2,000,000 general annual aggregate
      2. Auto Liability Insurance
        • $1,000,000 each person, bodily injury, and property damage, including owned, non‐owned and hired auto liability
      3. Workers’ Compensation
        • Statutory limits
      4. Employer’s Liability
        • $1,000,000 bodily injury by accident, each accident
        • $1,000,000 bodily injury by disease, each employee
        • $1,000,000 bodily injury by disease, policy aggregate
      5. Umbrella/Excess Liability
        • $2,000,000 each occurrence and annual aggregate
        • Underlying coverage shall include General Liability, Auto Liability, and Employer's Liability
        • $1,000,000 annual aggregate covering damages or liability arising or resulting from bidder's services rendered, or which should have been rendered, pursuant to the Contract
      6. Property
        • The bidder shall purchase and maintain property insurance covering machinery, equipment, mobile equipment, and tools used or owned by the bidder in the performance of services under the Contract. Boone County Fiscal Court shall in no circumstance be responsible or liable for the loss or damage to, or disappearance of, any machinery, equipment, mobile equipment, and tools used or owned by the bidder in the performance of services under the Contract.

      The bidder and their insurance company should carefully review the insurance requirements applicable to this agreement. All requirements herein must be met before the County will execute the contract.

    • Bid Submittal Instructions

      The Boone County Fiscal Court will receive sealed bids electronically via the County's electronic bidding system only until 2:00 pm (local time), Friday, June 5, 2026 from qualified vendors to perform the services associated with Fiscal Year 2027 Right-of-Way Mowing. Bids must be submitted electronically. Late, hand delivered (paper), emailed or facsimile bids will not be accepted. Bids will be opened online at the time listed above.

    • SPECIFICATIONS

      PRE-BID SITE VISIT

      Prior to submitting a bid, the Contractor is highly encouraged to conduct site visits with the Boone County Engineering Services Supervisor or their designated representatives. These site visits are to assist Bidders in confirming the exact locations and scope of work prior to bid submission.

      Appointments for site visits prior to the bid opening shall be addressed to Mr. Daniel Rice, Engineering Services Supervisor or his designated representative at (859) 334-3600.

      TERMS OF CONTRACT

      The term of this contract shall be for a period of one (1) year beginning July 1, 2026 and ending June 30, 2027. The County reserves the right to cancel the contract, at any time within the contract, if service falls below standards outlined and the Contractor fails to remedy service inadequacies after adequate written notification.

      COMPETENCY OF BIDDER

      No contract will be awarded except to qualified bidders capable of performing the class of work contemplated. Prior to award of a contract, Bidders may be required to provide evidence they have the necessary facilities, equipment, experience, personnel, and financial resources to perform the work per the specifications in a satisfactory manner and within the time stipulated. Equipment must be made available to be viewed by a County representative to ensure capability of performing the work at each location. If the contract contains special items for materials, work of a complicated nature or the character of which will depend upon the Contractor’s skill or experience, they shall be required to show proof that they have a satisfactory record of similar work performed or materials furnished. References will be required and must be submitted with the bid.

      CONTRACTOR RESPONSIBILITY

      The Contractor will provide their own labor, tools, equipment, trash bags, trash collection gear/equipment, traffic control devices, transportation, fuel, oil, incidental, and related items necessary to complete the work in accordance with this solicitation and scope of work. The Contractor will perform the mowing and trimming services in a professional manner, showing courtesy to the public at all times.

      The Contractor is responsible to protect all existing and newly installed work, materials, equipment, improvement, utilities, structures, and vegetation at all times during the course of the contract. Any property or incidental damage by Contractor during the course of this contract shall be repaired or replaced to the satisfaction of the Public Works Department at the Contractors expense.

      All work shall fully conform to all OSHA, FHWA, and KYTC safety and work zone traffic control requirements.

      INVOICE SUBMISSION PROCESS

      1. Vendor submits a draft invoice to the Boone County Requestor (typically a project lead, manager, supervisor, or director responsible for the work or services provided).

      2. The Requestor reviews the draft invoice for accuracy and works directly with the vendor to confirm or revise the invoice amount as needed.

      3. Once both the Requestor and the vendor agree on the amount to be invoiced, the vendor must submit the invoice electronically to: accountspayable@boonecountyky.org

      4. The Requestor should be copied (cc'd) on the email to ensure visibility and tracking.

      WORKMANSHIP

      With regard to this contract, the County representative will determine acceptability of all work and/or services performed. If the work and/or services are not acceptable, the Contractor will be called in to review and correct all problem areas without additional cost to the County. Upon notification by the County representative, the Contractor will correct repairs to deficient work and/or services in accordance with a schedule jointly agreed upon. If corrections are not made, Boone County will take off 25% of the bill for that mowing.

      The County reserves the right to make unannounced, periodic inspections of the work in progress.

      GRASS CUTTING AND MAINTENANCE

      The successful Contractor shall furnish all tools, labor, and material to provide grass cutting and maintenance in accordance with the following specifications:

      1. Preparations Before Mowing
        1. Prior to mowing, all trash, including paper, bottles, unauthorized signs, debris, etc., shall be collected and removed from the mowing areas, including right-of-way fences, roadway ditches, catch basins, drop boxes, drainage structures, areas behind guardrails, and behind medians, by the Contractor.  All tree branches shall also be picked up and removed prior to mowing the area. The Contractor shall remove all collected and bagged trash, branches and debris from the site. The Contractor shall provide their own disposal site for debris resulting from the operation of this contract requirement, at no additional cost to the County.
          1. If a fallen tree or branch is too heavy or unwieldy to remove, the Contractor shall immediately notify the Public Works Department of the size and location of the fallen tree or branch.
          2. Invoices shall include separate line items for Litter Removal
      2. General Cutting and Trimming
        1. Each prescribed area shall be cut at the direction of the Public Works Department per the cycles listed in the Bid Tabulation Form.
        2. For the newly added areas (2026-2027), considered high-frequency cut/mowing, the frequency will be on a biweekly basis during the average rainfall season. During the dry part of the season, the frequency will be scaled back at the direction of the Engineering Services Supervisor.  The maximum height of mowed vegetation shall be four inches (4").   All cutting machinery must be checked for sharpness and be adjusted on a regular basis. When mowing next to parking lots, curb lines, and sidewalks, mow as to throw clippings inward to lawn areas. All close trimmings will be done with the utmost care as to protect adjacent plant material and any pedestrians and vehicular traffic in the area.
        3. In case of drought, the Engineering Services Supervisor, or their representative will notify Contractor to stop mowing until further notice.
      3. Shoulder Mowing
        1. Shoulder mowing shall be performed on all areas where vegetation exists beyond the shoulder or pavement edge(s) along the roadways. 
        2. The average mow width is four feet (4’) beyond shoulder or pavement and not to exceed a maximum of six feet (6’). 
        3. The maximum height of mowed vegetation shall be four inches (4”). 
        4. The mowing route shall be at the discretion of Boone County Public Works.  
      4. Back Slope Mowing
        1. Back slope mowing shall be performed beyond ditches and behind guardrails. The mowing shall consist of grass, weeds, bushes and small trees.
        2. The average mow width is five feet (5’) beyond ditch and behind guardrail and not to exceed six feet (6’).
        3. The mowing route shall be at the discretion of Boone County Public Works.
        4. Boom type mower shall be used on back slopes and behind guardrails unless area allows for use of batwing type mower. 
      5. KYTC Right-of-Way Mowing (KY18, KY237, KY495 and KY1017)
        1. Mowing on KYTC right-of-way shall be subject to the same technical specifications as mowing on County right-of-way except mowing of the entire right-of-way shall be required on KYTC roads including the paved multi-use path areas. Contractor invoices for KYTC Right-of-way mowing shall be broken out by route with individual line items for Litter Pickup and Mowing.  
      6. Traffic Control Requirements
        1. High-Visibility Apparel - All employees are required to wear high visibility apparel meeting the requirements of MUTCD Section 6C.05 -High Visibility Safety Apparel that meets the Performance Class 2 or 3 requirements of ANSI/ISEA 107-2015. 
        2.  Temporary Traffic Control Zone Activities - Contractors shall comply with all requirements of the MUTCD Part 6 Temporary Traffic Control (TTC). 
          1. Equip all designated work zone vehicles (tractors, service trucks, litter removal vehicles and vehicles for supervisory personnel) with warning strobe lights and fluorescent red/orange flags.
          2. Perform mowing operations with the flow of traffic when operating along the edge of the pavement.
          3. Perform all work only during daylight hours.
          4. Provide warning signs that are at least 36 inches (36”) by 36 inches (36”) in size, diamond shaped with black letters on an orange background with black border.  Place warning signs with the message “Begin Mowing Zone” and with the message “End Work Zone” to designate a mowing work zone. Where the trimming or litter removal operations are not within the mowing work zone, place an additional set of warning signs with the message “Begin Work Zone” and with the message “End Work Zone”, to designate a work zone for trimming operations or a work zone for litter removal operations. Mount warning signs on multi-leg stands in a secure and visible manner. Move the warning signs and re-establish a work zone as work operations progress.  Remove warning signs from the job site after work operations cease at the end of each workday. 
          5. Enter and leave work areas in a manner that will not be hazardous to or interfere with the normal flow traffic. Do not park or stop vehicles except within designated work areas. Limit all employee pedestrian movement on the roadway to the protected work zone areas.
      7. Clean Up Requirements During and After Mowing
        1. Grass clippings are to be swept or blown from sidewalks, curbs, parking lots and paved areas. Trash bags shall be provided by the Contractor.
        2. Clean up at each location shall be done before crews leave the location (end of each working day). Failure to comply will be cause for funds to be withheld for this phase of the work. If it becomes necessary for Boone County employees to supplement cleanup effort, that cost will be deducted from the Contractor’s next billing.
        3. Contractor to notify Boone County Public Works Engineering Supervisor by email within 48 hours of completion at each site.
      8. Damage to Property
        1. Do not damage turf areas, slopes, trees, landscape flowers and shrubs, or other roadside features during mowing, trimming or litter removal operations. Do not mow when turf and soil conditions are wet to the point that turf damage or ruts will occur. When damage does occur to turf, slopes, trees, landscape flowers, shrubs or other roadside features as a result of mowing, trimming or litter removal operations, replace or repair the same in like kind at no cost to the County.  When damaged property resulting from mowing, trimming or litter removal operations has to be repaired or replaced by the County, the cost of the work will be deducted from any payment due the Contractor.
        2. Do not damage County signage or delineators during mowing, trimming or litter removal operations. When damage does occur to signs or delineators, replace the damaged sign or delineators in like kind at no cost to the County. When damaged signs or delineators resulting from the mowing, trimming or litter removal operations must be repaired by the County, the cost of the work will be deducted from any payment due the Contractor.
        3. Replace immediately any mailbox that has been damaged in a way it is unusable as a result of mowing, trimming or litter removal operations with a temporary mailbox that meets the minimum specifications of the United States Post Office.  Within seven (7) calendar days, replace the mailbox in like kind to the approval of the mailbox owner.
      9. Working Hours
        1. The Contractor will schedule work between the hours of 7:00 a.m. and 4:00 p.m., Monday through Friday, unless otherwise authorized by the County. No mowing on Sundays and holidays without approval by the County.
      10. Licenses and Permits
        1. The Contractor shall, at their expense, procure all necessary licenses and permits needed to conduct the work required under the terms of this contract.
        2. The successful Contractor will be required to obtain a Boone County Occupational License. If successful Contractor fails to obtain, it shall result in termination of the contract.
      11. Sub-Contractors
        1. The Contractor will not be allowed to sub-contract work under this contract unless written approval is granted by the County. The sub-Contractor, if approved, shall be bound by the conditions of the original contract between the County and the Contractor. All required notices, work orders, directives and request for emergency services will be directed to the Contractor. All directions given to the sub-Contractor in the field shall bind the sub-Contractor as if the notice had been given to the Contractor.
        2. Contractor‘s employees shall carry identification at all times while on Boone County Property. Contractor’s employees shall show identification when asked by Boone County staff.
      12. Execution of a Contract
        1. The successful Contractor shall, within fifteen (15) calendar days of written notice of selection as the successful Contractor, enter into a contract with the County of Boone on forms as included within. The bidding documents for the performance of work awarded shall simultaneously provide the appropriate bonds and insurance required hereunder.
      13. Location and Schedule of Work
        1. The County reserves the right to change, add, or delete areas or quantities of areas to be cut that is in its best interest. The amount of grass cutting to be performed is conditional on the total amount of funds budgeted for grass cutting. The County shall give notice to the Contractor of the areas to be cut. Cutting shall commence no later than three (3) days after the contract has been awarded and continued until completion unless otherwise notified by the County. Failure of the Contractor to comply with the approved cutting schedule shall be sufficient cause to give notice that the Contractor is in default of contract.
        2. The County reserves the right to assign and reassign work within and between proposal areas at its sole discretion to ensure timely completion, adherence to maintenance standards, and overall service effectiveness.

        3. In the event a contractor fails to meet performance expectations, the County may reassign any portion of the work to another awarded contractor without penalty to the County.
      14.  Payment Terms
        1.  The County will promptly issue payment for services rendered every 30 days after receipt of an approved invoice. Approved mowing checklists will be provided to Contractor for bi-weekly submission to the Engineering Services Supervisor for signature of completed work.
        2. Invoices must be submitted in duplicate to the Public Works Department at 5645 Idlewild Road, Burlington, KY 41005 and Accounts Payable at accountspayable@boonecountyky.org.  Under no circumstances will interest be paid.
      15. Use of Chemicals
        1. There will be no chemicals used at any of these locations unless requested in writing by the County.
      HIGH FREQUENCY TURF MOWING LOCATIONS
      The locations identified below (items A through J) are new additions added in 2024.  These locations were previously managed under a separate contract with the Boone County Parks Department.  These locations are highly visible to the traveling public and require a higher frequency turf mowing to assure the aesthetics are maintained to a high level (generally these areas are to be cut on a bi-weekly basis during average rainfall seasons and scaled back during the dry part of the season per direction of Boone County Public Works. 
       
      KYTC routes A, B, C, E and F require litter removal, bush hog mowing, and trimming the entire right-of-way five (5) times per calendar year. This is approximately 50 Acres.
       
      1. KY18 (Burlington Pike) median and sides from Orient Street in Burlington (MP 10.62) to Boone Aire Road (where median ends) in Florence (MP 14.026) (20 cuts). Both median and sides must be turf mowed.  This area encompasses approximately 3.4 miles. Maps have been created to assist in the identification of areas to be excluded. This area also requires 5 mowing cycles per year for the entire right-of-way. 
      2. KY 237 (North Bend Rd) South - median and sides from KY 18 overpass in Burlington (MP 6.269) to Wright Boulevard in Hebron (MP 8.771) (20 cuts).  Both median and sides, including the paved multi-use paths must be turf mowed.  This area encompasses approximately 2.5 miles. This area also requires 5 mowing cycles per year for the entire right-of-way and will extend up to the I-275 interchange for the 5 annual cuts.
      3. KY 237 (North Bend Rd) North/Roundabouts - median, sides & roundabouts from Tanner Road in Hebron (MP 11.288) to Graves Road in Hebron (MP 11.965) (20 cuts). Both median and sides must be turf mowed.  This area encompasses approximately 0.7miles. This area also requires 5 mowing cycles per year for the entire right-of-way. 
      4. KY 237/Pleasant Valley median and sides from Rogers Lane, Burlington in Hebron to Valley View Drive, Florence (20 cuts). Both median and sides must be turf mowed.  This area encompasses approximately 3.1 miles.
      5. KY495 (Graves Road) median and sides from Petersburg Road (MP 0) to North Bend Road (MP 2.206) in Hebron (20 cuts). Both median and sides must be turf mowed.  This area encompasses approximately 2.4 miles. This area also requires 5 mowing cycles per year for the entire right-of-way. 
      6. KY1017 (Aero Parkway) median and sides from KY 18 in Florence (MP 0) to Turfway Road in Florence (MP 2.297) (20 cuts).  Both median and south side to 1-swipe beyond the multi-use path must be turf mowed.  This area encompasses approximately 2.3 miles. This area also requires 5 mowing cycles per year for the entire right-of-way. 
      7. KY 338 (Richwood Rd) median, sides, roundabouts, and islands from Grand National Blvd to KY 25 (Dixie Hwy) (20 cuts)
      8. Oakbrook Road sides from KY 18 in Florence to Fox Run Lane in Florence. A section beginning 250' south of Sycamore Hill Rd to Shady Cove Ln includes only the west side of Oakbrook Road. (20 cuts). The sides must be mowed per the boundaries as shown in the aerial image in the attachments. This area encompasses approximately 1.2 miles.
        1. Oakbrook entrance - Duke Energy sub-station and opposite hill side (20 cuts)
      9. Cayton Road Residual Right-of-Way located at the intersection of Cayton Rd and Hopeful Church Rd as shown within the red boundary area on the aerial image in the attachments (15 cuts)
      10. Bullittsville Road Right of Way located at 3439 Bullittsville Road, Burlington as shown in the aerial image in the attachments (15 cuts). This area encompasses approximately 1.5 miles.
      11. Mt. Zion Islands - (20 cuts)
      12. KY 338 @ US25 - (20 cuts)
      13. KY 338 Mt. Zion Multi-Use Path - (20 cuts)
      14. KY 237 - Weed eating medians (20 cuts)

      Any purchase made without the proper purchase order number will not be paid. Also, quantities must not exceed the amount listed on the order.

      Vendor is responsible to ensure correct billing of materials provided to the County. Improper billing procedures and/or billing errors may result in contract termination.
