The proposed project is an adaptive reuse development located in the City of Fresno, California (APN 449-324-11). The project site consists of approximately 63,574 square feet (1.46 acres) and includes the rehabilitation and conversion of two existing motel buildings into permanent affordable housing.
The development will create a total of 42 residential units consisting primarily of studio and one-bedroom apartments, along with one three-bedroom manager's unit. This certification is a material representation of fact upon which reliance was placed when this transaction was made or entered into. Submission of this certification is a prerequisite for making or entering into this transaction imposed by section 1352, title 31, U.S. Code. Any person who fails to file the required certification shall be subject to a civil penalty of not less than $10,000 and not more than $100,000 for each such failure.

Performance Bond and Payment Bond Certification
By executing and submitting this form, the Bidder acknowledges, agrees, and certifies that, if selected for award, it shall furnish all required Performance Bonds and Payment Bonds, or other Agency-approved assurances of contract performance and completion, in the amounts and form prescribed within the solicitation documents.
The successful Bidder shall provide such bonds or assurances within the timeframe established by the Agency following Notice of Award and prior to contract execution and/or commencement of any work. All bonds shall be issued by a surety authorized to transact business in the State of California and otherwise comply with all applicable federal, state, and local laws, regulations, and solicitation requirements.
Failure to timely furnish the required Performance Bond, Payment Bond, or other approved assurance of completion may result in the Agency withdrawing the award, declaring the Bidder non-responsive to post-award requirements, and pursuing any other remedies available under the solicitation documents, contract documents, and applicable law.
The undersigned proposes to enlist the following subcontractors for the duration of this project. It is understood that no substitutions or deletions or additions will be made to this list without the approval of the Agency and under the procedures required by law. Contractors are encouraged to utilize Section 3 Business Enterprises, Disabled Veteran Business Enterprises (DVBE), Minority and/or Women-Owned Business Enterprises (MBE/WBE), and LGBTQ+ Business Enterprises.
